Ocean City Beach Rules: Hours, Alcohol, Pets, and Permits

Ocean City beach rules cover the ten-mile stretch of Atlantic shoreline that the town keeps free and open to the public, with no beach tags or entrance fees. The beach is accessible daily from 5:00 a.m. to midnight, lifeguards patrol from 10:00 a.m. to 5:30 p.m. during the summer, and a short list of ordinances governs what you can bring, where you can sit, and what you can do once you’re on the sand.1Town of Ocean City, MD. Ocean City Town Ordinance

Hours and Overnight Sleeping

The beach is open 5:00 a.m. to midnight. Between midnight and 5:00 a.m., the town runs heavy equipment across the sand to clear debris, and the beach is off-limits.1Town of Ocean City, MD. Ocean City Town Ordinance Sleeping on the beach is separately prohibited between 10:00 p.m. and 6:00 a.m., so the window for lingering after dark is narrower than the posted hours suggest. Anyone found sleeping or camping during the no-sleep window faces removal and possible citation.

Alcohol Is Banned in Public, Year-Round

Drinking alcoholic beverages in any public area of Ocean City is illegal. The ban covers streets, sidewalks, alleys, the beach, parking lots, and vehicles in those areas. Possessing an open container of any alcoholic beverage in public is separately prohibited.1Town of Ocean City, MD. Ocean City Town Ordinance This is one of the most commonly written citations on the beach. Enforcement runs year-round, and violations carry fines and the possibility of jail time.

Canopies, Tents, and the Lifeguard Line

The rules for shade have changed, and older guidance online is no longer accurate. Tents with enclosed sides are banned outright. Open-sided canopies are still allowed, but with specific restrictions:1Town of Ocean City, MD. Ocean City Town Ordinance

  • Open on all four sides. Walls or flaps make it a tent, which is not permitted.
  • Maximum footprint of 15 feet by 15 feet.
  • At least three feet of buffer between your canopy and your neighbor’s setup.
  • Stakes and anchors must stay inside the canopy’s footprint.
  • No unattended canopies before 10:00 a.m. You cannot drop one off to save a spot.
  • All canopies must sit west of the lifeguard line, behind the lifeguard stand.
  • Small pop-up baby shelters are allowed if they don’t exceed 3 feet by 3 feet by 3 feet.

Lifeguards set a line running parallel to the ocean to keep their sightline clear. Beach umbrellas, ball playing, and other accessories cannot sit east of that line. The lifeguard stand’s position is the reference point, so check where the line falls before you set up.1Town of Ocean City, MD. Ocean City Town Ordinance

Pets Are Banned From May Through September

Dogs are allowed on the beach and boardwalk only between October 1 and April 30. From May 1 through September 30, pets are prohibited from both the sand and the boardwalk. During the permitted months, dogs must be leashed at all times, and owners must pick up and dispose of waste left on public or private property.2Ocean City, Maryland. Pet Friendly

Service animals trained to perform specific tasks for a person with a disability are exempt from the seasonal ban. Under the Americans with Disabilities Act, officials may ask only whether the dog is a service animal required because of a disability and what task the dog has been trained to perform. They cannot demand paperwork, a vest, or a demonstration. Emotional support animals do not qualify for this exemption and are treated as pets. Handlers of service dogs still have to clean up after the animal.

Smoking and Vaping Are Limited to Designated Areas

The boardwalk, beach accessways, dune crossings, Ocean City parks, and covered bus stop shelters are all smoke-free. The rules apply to cigarettes, cigars, pipes, e-cigarettes, and anything containing tobacco.3Town of Ocean City, MD. Smoking Policy on the Beach and Boardwalk

On the beach itself, smoking and vaping are allowed only within designated smoking areas. Each designated area has a waste receptacle, and you must stay within 15 feet of that receptacle while smoking. The town expects voluntary compliance but can issue citations.

Glass, Grills, and Vehicles

Glass containers are not permitted on the sand. Open flames, grills, and cooking equipment are banned. Private vehicles are not allowed on the beach at any time. Amplified sound equipment that interferes with public safety broadcasts or lifeguard communication is restricted as well.1Town of Ocean City, MD. Ocean City Town Ordinance Bonfires are the one exception to the open-flame rule, and only with a permit from the Fire Marshal’s Office.4Town of Ocean City, MD. Permit Applications

Where You Can Surf

Ocean City uses a rotating surfing beach system. Designated surf-only areas shift two city blocks south each day. A north surf beach rotates between 146th Street and 67th Street, and a south surf beach rotates between 66th Street and Caroline Street. A permanent surfing beach sits at the Inlet at the southern tip of the island, open on weekdays except holidays.5Town of Ocean City, MD. Surf Beaches

Surfing restrictions are in effect during guarded hours, 10:00 a.m. to 5:30 p.m. The season runs May 1 through September 30 for beaches from the Inlet to 27th Street, and from Memorial Day weekend Friday through September 30 for all other beaches. During those hours, only surfers on surfboards may enter the water at designated surf beaches. Yellow stands mark the boundaries. Surfers must wear a leash, ride one person per board, and follow standard surfing etiquette.5Town of Ocean City, MD. Surf Beaches During inclement weather, the Beach Patrol captain may open all beaches to surfers if they stay at least 50 yards from non-surfers and use an ankle leash.

Swimming Safely and Handling Rip Currents

Beach Patrol Surf Rescue Technicians guard the water from 10:00 a.m. to 5:30 p.m. daily, Memorial Day weekend through the third Sunday after Labor Day.1Town of Ocean City, MD. Ocean City Town Ordinance Swimming near a lifeguard stand dramatically reduces drowning risk; the United States Lifesaving Association puts the odds of drowning at a guarded beach at 1 in 18 million.6Town of Ocean City, MD. Beach Patrol Safety – Rip Currents

Rip currents are the most serious hazard in the surf zone. Watch for channels of choppy water, color differences, or lines of foam and seaweed moving steadily away from shore. Polarized sunglasses make these clues easier to spot. If you get caught in one, stay calm, don’t fight it, and swim parallel to shore until the pull weakens before angling back in. Float and signal for help if you can’t swim out. Never swim after someone caught in a rip without a flotation device.6Town of Ocean City, MD. Beach Patrol Safety – Rip Currents

Surf Fishing Rules and Licenses

Surf fishing from public beaches is illegal during guarded hours, 10:00 a.m. to 5:30 p.m., from Memorial Day weekend Friday through September 30, unless you have permission from the Mayor and Council. Outside those hours, casting is still prohibited within 50 yards of anyone swimming, walking, sitting, or standing on the beach.7Town of Ocean City, MD. Surf Fishing in Ocean City

A Maryland saltwater fishing license is required. Resident annual licenses cost $15, and non-resident annual licenses cost $22.50.8Maryland Department of Natural Resources. Maryland Sport Fishing and Crabbing Licenses Anglers under 16 are exempt, as are people fishing from licensed charter or party boats. Virginia saltwater license holders can fish in Maryland waters but must register online with the state.

Two options exist for fishing without a license. The Oceanic Pier and Ocean Pier both carry blanket pier licenses covering anyone fishing from them. Ocean City also has two free fishing zones: the bulkhead from 2nd to 4th Street and Northside Park at 125th Street. The free zones still require a free registration, available by phone at 1-855-855-3906 during daytime hours.7Town of Ocean City, MD. Surf Fishing in Ocean City Crabbing and clamming require no license.

Drones

The Town of Ocean City discourages flying recreational drones within city limits. Anyone who violates federal operating rules, whether flying as a hobbyist or under a Part 107 commercial certificate, will be referred to the local FAA Flight Standards District Office for enforcement.9Ocean City, Maryland. General OC Information The crowded beach and boardwalk make compliance with FAA line-of-sight and safety requirements difficult in practice. Commercial flights, including real estate photography, require at minimum a Remote Pilot Certificate under 14 CFR Part 107.10Federal Aviation Administration. Recreational Flyers and Community-Based Organizations

Beach Accessibility

The town provides both beach access mats and free beach wheelchairs. Blue access mats are placed on designated streets from Memorial Day weekend through Columbus Day weekend, creating a firm path from the boardwalk to the sand. Mats may be pulled temporarily during storms or special events; call Public Works Construction at 410-524-4733 to confirm availability.11Town of Ocean City, MD. ADA – Americans with Disabilities

Beach wheelchairs are available free of charge from Memorial Day through Labor Day, with a 300-pound weight capacity. Beach Patrol loans them 10:30 a.m. to 5:00 p.m. (call 410-520-5231 between 10:00 a.m. and 4:00 p.m. or visit a lifeguard stand), with return required before 5:00 p.m. The Welcome Center loans them 8:30 a.m. to 3:00 p.m. with return before 3:00 p.m. Both require a day-use waiver and driver’s license information. To reserve ahead, call the Welcome Center at 410-289-2800.11Town of Ocean City, MD. ADA – Americans with Disabilities

Permits for Weddings, Bonfires, and Events

Beach weddings, organized group gatherings, memorials, and any activity involving vendors or equipment setup require a special event permit through the Fire Marshal’s Office. Bonfire permits run through a separate application at ocbonfires.com. Larger canopies or temporary structures tied to an organized event need a tent or special event application.4Town of Ocean City, MD. Permit Applications Submit applications well in advance; approval is not guaranteed and popular dates fill quickly.
