Ohio’s 1099 filing requirements apply to any employer or payer that either paid an Ohio resident or withheld Ohio income tax from a payment, and almost all filers must submit their forms electronically through OH|TAX eServices. The deadline is January 31 following the tax year. Who Has to File 1099s With Ohio
Ohio Revised Code 5747.07 requires every employer that withholds Ohio income tax to file returns and submit income statements to the Ohio Department of Taxation (ODT).2Ohio Legislative Service Commission. Ohio Revised Code 5747.07 The obligation reaches businesses domiciled in Ohio, out-of-state payers that withheld Ohio state or school district tax, and retirement system payers distributing benefits to Ohio residents.
Two triggers force a 1099 into Ohio’s system. The first is residency: if the recipient is an Ohio resident, you report the payment even when no tax was withheld. The second is withholding: if Ohio income tax came out of the payment, you report it regardless of where the recipient lives.3Ohio Department of Taxation. 1099-MISC Upload Specifications The state uses resident-payment data to verify that individuals report their income correctly.
Dollar thresholds match the federal rules. The $600 floor for non-employee compensation on Form 1099-NEC applies at the state level, and Ohio does not impose a lower reporting amount. Federal exemptions carry over too, so payments to C corporations or S corporations for services stay outside 1099-NEC reporting for Ohio purposes just as they do for federal.
Which Forms Ohio Wants
The ODT requires copies of the following federal forms:
- Form 1099-NEC for non-employee compensation, including payments to independent contractors.
- Form 1099-MISC for miscellaneous income such as rents, royalties, medical and health care payments, and attorney fees.3Ohio Department of Taxation. 1099-MISC Upload Specifications
- Form 1099-R for distributions from pensions, annuities, retirement plans, and IRAs.4Ohio Department of Taxation. 1099-R Upload Specifications
Form 1099-G and Form W-2G may also be required when Ohio tax was withheld. Every submission must carry the recipient’s valid Social Security Number or Taxpayer Identification Number and the payer’s federal Employer Identification Number.
School District Withholding
Ohio is one of the few states that levies a school district income tax, and this creates an extra data point on your 1099 filings. When you withhold school district tax, the amount goes in the electronic file’s “Local Income Tax Withheld” field. Despite the label, that field is used exclusively for Ohio school district income tax.3Ohio Department of Taxation. 1099-MISC Upload Specifications Leaving it blank when tax was actually withheld triggers mismatches during ODT compliance reviews.
Form IT-3 Transmittal
Electronic filers do not send a separate Form IT-3. When you upload through OH|TAX eServices, the portal generates the transmittal automatically from the data you submit.5Ohio Department of Taxation. Employer Withholding Paper filers who have received an exemption from electronic filing must still include a completed IT-3.
The Deadline and How to Extend It
Ohio’s due date for 1099 submissions is January 31, matching the federal deadline for furnishing recipient copies and for filing 1099-NEC with the IRS.6Ohio Department of Taxation. Due Dates When that date falls on a weekend or federal holiday, it shifts to the next business day; for tax year 2025 filings, the deadline is February 2, 2026.
Your IT 941 annual reconciliation of Ohio income tax withheld is due the same day, and the W-2 and 1099 uploads accompany that reconciliation. Missing the 1099 upload effectively means missing the annual reconciliation too.
If you need more time, request an extension through OH|TAX eServices by uploading a completed copy of federal Form 7004 with a reason for the delay.7Ohio Department of Taxation. Request an Extension (MELT) An extension to file is not an extension to pay. Tax owed is still due on the original date, and interest accrues on any unpaid balance from that date forward.
How to File Electronically
Ohio Administrative Code 5703-7-19 requires every person filing withholding returns to do so electronically unless the Tax Commissioner grants a written exemption.8Ohio Legislative Service Commission. Ohio Administrative Code 5703-7-19 In practice, virtually every business filing 1099s with Ohio uses the electronic system. The exemption process requires a written request on a form prescribed by the Commissioner, and approvals are decided case by case.
Filings go through the Upload Income Statement feature on OH|TAX eServices. You register on the platform, navigate to the employer withholding section, and use the upload function to send your data files.1Ohio Department of Taxation. 1099-NEC Upload Specifications
File Format
The ODT accepts data files in a fixed-length text (.txt) format that follows the record layout in IRS Publication 1220. Each record must be exactly 750 characters long.3Ohio Department of Taxation. 1099-MISC Upload Specifications Ohio does not accept PDF files or files converted from PDF. The ODT publishes a separate specification document for each form type (1099-NEC, 1099-MISC, 1099-R), and field positions differ between them. Most payroll software can generate the required format; if you’re building the file by hand, download the current year’s specification and follow it exactly, because a misplaced field or wrong record length will cause the upload to reject.
Combined Federal/State Filing for 1099-R Only
Ohio participates in the IRS Combined Federal/State Filing (CF/SF) program, but only for Form 1099-R. Under CF/SF, the IRS forwards your electronically filed 1099-R data to Ohio, which can eliminate the need for a separate state upload. Ohio’s CF/SF state code is 39.4Ohio Department of Taxation. 1099-R Upload Specifications The ODT asks that only 1099-R forms be included in CF/SF submissions to Ohio. Forms 1099-NEC and 1099-MISC still have to be uploaded directly to OH|TAX eServices whether or not you use CF/SF. Code each Payee “B” record with Ohio’s state code, or the IRS will not route the data. Some filers also confirm directly with the ODT that their CF/SF participation was recognized, since the IRS only forwards the data.9Internal Revenue Service. Paper Filing Is the Exception
Paper filing is available only to payers who have received a written exemption from the electronic requirement under Ohio Administrative Code 5703-7-19.8Ohio Legislative Service Commission. If you file electronically, do not also mail paper copies. The ODT explicitly warns against duplicate submissions.
Fixing Mistakes After You File
Corrections run through the same OH|TAX eServices upload process. You fix the data and re-upload the file, flagging the correction using the Corrected Return Indicator in position 6 of the Payee “B” record.1Ohio Department of Taxation. 1099-NEC Upload Specifications File the correction as soon as you find the error. The ODT can assess penalties on incorrect returns the same way it does on late ones.
Penalties for Late or Missing Filings
Under Ohio Revised Code 5747.15, the penalty for failing to file a required return on time is the greater of $50 per month (capped at $500) or 5 percent of the tax due per month (capped at 50 percent of the total tax). The penalty applies for each month or partial month the return is late, starting from the due date including any approved extension.11Ohio Legislative Service Commission. If you withheld Ohio income tax but did not remit it, a separate penalty of up to 50 percent of the delinquent payment can apply.11Ohio Legislative Service Commission. Ohio Revised Code 5747.15 – Failure to File or Remit Tax Interest also accrues on unpaid balances. For calendar year 2026, the ODT interest rate on underpayments is 7 percent, calculated by adding 3 percentage points to the rounded federal short-term rate.12Ohio.gov. If the ODT sends a notice of non-compliance, you can request penalty abatement by showing reasonable cause. The abatement requires documented circumstances beyond your control rather than willful neglect, and supporting documentation must accompany the request. Respond within the timeframe stated in the notice to avoid escalation into collections and additional interest.
Federal Penalties Stack On Top
The IRS imposes its own per-return penalties for failing to file correct information returns or furnish correct payee statements on time. For returns due in 2026:
- Filed up to 30 days late: $60 per return.
- Filed 31 days late through August 1: $130 per return.
- Filed after August 1 or not filed at all: $340 per return.
- Intentional disregard: $680 per return.13Internal Revenue Service. Information Return Penalties
Federal penalties apply separately to the return filed with the IRS and to the statement furnished to the recipient, so a single missed 1099 can generate two penalties. Combined with Ohio’s, even a small batch of late forms adds up.
Records to Keep
Ohio requires payers to retain copies of filed 1099 forms and supporting records for at least five years after the calendar year in which the payment was made.
