Ohio’s 1099-NEC filing requirements have two levels that often get confused. At the state level, you file Form 1099-NEC with the Ohio Department of Taxation only for contractors from whom you withheld Ohio individual income tax or Ohio school district income tax during the year; if you did not withhold, no state filing is required.1Ohio Department of Taxation. 1099-NEC Upload Specifications When state filing does apply, it must be done electronically through OH|TAX eServices, and for tax year 2025 the due date is February 2, 2026.
Municipal reporting to RITA or CCA is a separate obligation with its own deadlines and thresholds. Federal filing with the IRS runs on its own track and applies to any $600-plus payment to an unincorporated service provider.2Internal Revenue Service. When Ohio Requires a State 1099-NEC
The trigger for filing with the Ohio Department of Taxation is withholding, not payment volume. Ohio’s upload specifications require submission of 1099-NEC data for every recipient from whom you withheld Ohio individual income tax or Ohio school district income tax during the year. If nothing was withheld from a contractor’s payments, filing with the ODT is not required for that contractor.1Ohio Department of Taxation. 1099-NEC Upload Specifications
Most payers do not withhold Ohio tax from contractor payments, so the state filing obligation simply does not arise for them. Their federal 1099-NEC still goes to the IRS. One clarification about the state form: the “Local Income Tax Withheld” field on Ohio’s upload format refers to school district income tax, not municipal income tax. Municipal tax reporting happens through the local agency, not through the ODT.1Ohio Department of Taxation. 1099-NEC Upload Specifications

How to File With the Ohio Department of Taxation
Ohio requires electronic filing through the Upload Income Statement feature on OH|TAX eServices. This is not limited to large filers. Ohio Revised Code sections 5747.07 and 5747.071 and Ohio Administrative Rule 5703-7-19 mandate electronic filing for any payer that files and pays employer withholding taxes electronically.1Ohio Department of Taxation. 1099-NEC Upload Specifications
The ODT follows the IRS Publication 1220 layout. You upload a text file through OH|TAX eServices and select “1099-NEC” from the income statement drop-down.5Ohio Department of Taxation. Information You Need Before You File
Collect a completed IRS Form W-9 from each contractor before you pay them. The W-9 gives you the contractor’s legal name, address, and Taxpayer Identification Number, either a Social Security Number or an Employer Identification Number.7Internal Revenue Service. Forms and Associated Taxes for Independent Contractors The IRS permits electronic W-9 systems, including fax, as long as the system can verify the submitter’s identity, produce a hard copy on request, and capture an electronic signature under penalties of perjury mirroring the paper form’s language.8Internal Revenue Service. Instructions for the Requester of Form W-9
On your side, you need your federal Employer Identification Number and your eight-digit Ohio Withholding Tax Account Number. Ohio withholding account numbers begin with 51, 52, 53, or 54, and numbers that do not start with one of those prefixes will be rejected.9Ohio Department of Taxation. Scan Specifications for the 2019 Ohio IT 3 Contractor information on the 1099-NEC must exactly match the W-9 and your federal filing. Mismatches between state and federal submissions are a common cause of rejections.
Municipal Reporting: RITA and CCA
More than 600 Ohio municipalities levy a local income tax. Municipal tax on 1099-NEC payments is generally a net profit tax owed by the contractor rather than a withholding obligation on you, so most payers do not withhold municipal tax from contractor payments the way they do from employee wages. You may still have a reporting obligation to the municipality if your business has facilities there or contractors performed work within its boundaries.
Most Ohio municipalities are administered by one of two regional agencies, and the requirements differ.
RITA-Administered Municipalities
If your business operates in a RITA-member municipality, electronic filing of 1099-NEC data is required when you issue 10 or more forms in a calendar year. RITA requires its own 1099 Transmittal Form to accompany the data, filed separately from the Form 17 reconciliation.10Regional Income Tax Agency. Business FAQs – Employer Withholding – Submitting W-2s/1099-MISC/1099-NEC Under 10 forms, paper is acceptable.
CCA-Administered Municipalities
The Central Collection Agency serves Cleveland and dozens of other municipalities. CCA requires employers with facilities in a CCA municipality to report payees who received 1099-NEC non-employee compensation. The rules by volume:
- 10 or more payees: file electronically through CCA’s DropSecure service using a conformant data file.
- Fewer than 10 payees: paper copies of the 1099-NEC forms with all required federal information clearly shown are acceptable.
- Payroll agents and CPAs filing on behalf of one or more employers: electronic filing is required regardless of payee count.
All CCA filers must also submit a written W-3 Annual Reconciliation, even when the 1099 data is filed electronically. The CCA deadline for tax year 2025 filings is March 2, 2026.3Central Collection Agency. 2025 Annual Reconciliation of Municipal Income Tax Withheld
If contractors worked in a RITA city and a CCA city during the same tax year, you file separately with each agency under its own rules. There is no consolidated statewide municipal filing.
Backup Withholding When the W-9 Is Missing or Wrong
If a contractor does not provide a valid TIN, or the IRS notifies you that the TIN is incorrect, you must withhold 24% of every payment as federal backup withholding. Non-employee compensation reported on Form 1099-NEC is specifically listed among the payment types subject to backup withholding.11Internal Revenue Service. Backup Withholding
You report and deposit any backup withholding on Form 945, the Annual Return of Withheld Federal Income Tax, due February 2, 2026 for tax year 2025. If your total Form 945 liability for the year is under $2,500, you can pay it with the return. Above that, you must deposit through EFTPS or IRS Direct Pay on a monthly or semiweekly schedule based on prior-year liability.4Internal Revenue Service. 2025 Instructions for Form 945
Penalties and Personal Liability
Under Ohio Revised Code Section 5747.15, the penalty for failing to file or filing late is the greater of $50 per month (capped at $500) or 5% per month of the taxes that should have been reported (capped at 50%). Each partial month counts as a full month.12Ohio Legislative Service Commission. Ohio Revised Code 5747.15 – Failure to File or Remit Tax
A separate penalty of up to $500 applies if a return is so incomplete the ODT cannot judge its accuracy, or if the filing appears designed to delay or obstruct tax administration.12Ohio Legislative Service Commission. Ohio Revised Code 5747.15 – Failure to File or Remit Tax
Ohio law also holds corporate officers, LLC members and managers, and employees who control tax filing responsibilities personally liable for failures to file or pay. That personal liability survives dissolution and bankruptcy of the business.13Ohio Legislative Service Commission. Ohio Revised Code 5747.07 – Employers to File Return and Pay Withholding Anyone whose name sits on the withholding account carries that exposure.
At the federal level, the IRS charges interest on unpaid tax, penalties, and accumulated interest until the balance is paid. Interest compounds daily and the underpayment rate for the first quarter of 2026 is 7%.14Internal Revenue Service. Quarterly Interest Rates
Fixing Errors After You File
To correct a state filing, upload a new file through OH|TAX eServices. The corrected file replaces the erroneous data, and the system will confirm the submission or flag remaining errors. Because Ohio’s penalty structure counts every partial month as a full month, moving quickly limits exposure.
For federal corrections, file a corrected 1099-NEC with the IRS using the correction procedures in the IRS instructions. If the error changed the amount of backup withholding reported, you may also need to amend Form 945.
How Long to Keep Records
The IRS requires employment tax records to be kept at least four years after the tax becomes due or is paid, whichever is later.15Internal Revenue Service. How Long Should I Keep Records For 1099-NEC records, that covers the filed forms, each contractor’s W-9, and documentation supporting the payment amounts. If income is underreported by more than 25% of what the return shows, the IRS can look back six years rather than three; fraudulent returns have no time limit.16Internal Revenue Service. Time IRS Can Assess Tax For Ohio, matching the federal four-year floor is reasonable, and holding records for six years builds in a buffer against the extended federal assessment window.
