If you sell into Ohio from outside the state, Ohio remote seller sales tax kicks in once your Ohio sales pass either $100,000 in gross receipts or 200 separate transactions in the current or preceding calendar year. Hit one benchmark and you have to register, collect the destination-based rate on taxable sales, and file returns, even without any physical presence in the state. The rule flows from the U.S. Supreme Court’s 2018 decision in South Dakota v. Wayfair, Inc., which let states tax out-of-state sellers based on economic activity alone.1Supreme Court of the United States. South Dakota v. Wayfair, Inc.
The Two Thresholds That Trigger Collection
Ohio presumes a remote seller has substantial nexus when, in the current or prior calendar year, either gross receipts from Ohio sales exceed $100,000 or the seller completes 200 or more separate transactions with Ohio consumers.2Ohio Legislative Service Commission. Ohio Revised Code 5741.01 – Definitions Only one has to be met. A seller with 250 small orders totaling $30,000 has nexus on the transaction count. A seller with 50 orders totaling $120,000 has nexus on the dollar amount.
Because both tests look at the current year and the year before, crossing $100,000 last year gives you nexus for all of this year regardless of how the current year is trending. Watch both numbers as they grow, not at year-end.
When You Have To Start Collecting
Ohio expects registration, collection, and the first return promptly after you cross a threshold. The Department of Taxation’s own example: a business that reaches $100,000 in Ohio sales on October 15 must register and collect tax immediately, then file its first return by November 23. The same timeline applies to the 200-transaction line. There is no grace period for individual remote sellers.3Ohio Department of Taxation. Sales and Use Tax
Marketplace facilitators get a bit more runway: their collection duty begins on the first day of the first month that falls at least 30 days after they establish nexus.
Waiting until quarter-end or year-end to register is a common and expensive mistake. Back taxes, interest, and penalties run from the date you should have started collecting, not the date you actually signed up.
The Rate You Charge
Ohio’s state rate is 5.75%.4Ohio Legislative Service Commission. Ohio Revised Code 5739.02 – Levy of Sales Tax Counties and regional transit authorities add local rates in 0.05% increments up to a combined 8.75% cap. As of late 2025, the highest combined rates reach about 8.00% in counties like Cuyahoga and Franklin, while the lowest sit around 6.50%.5Ohio Department of Taxation. Sales and Use Tax Rate Map
Sales are sourced to the delivery location, not your home state. For services, sourcing runs to where the customer first uses the service. If you don’t have a delivery address, fall back to the customer address in your records.6Ohio Department of Taxation. ST 2009-03 – Sales and Use Tax: Sourcing
Ohio’s free rate-lookup tool, “The Finder,” returns the correct combined rate for any Ohio address, ZIP code, or GPS coordinate at thefinder.tax.ohio.gov. What Ohio Taxes When You Ship In
Most tangible personal property sold to Ohio buyers is taxable. Ohio also taxes prewritten computer software regardless of delivery method, streaming services, e-books, downloadable music and movies, and business data processing and electronic information services. Custom software written for a single client and separately stated on the invoice is generally exempt. Bundle taxable and nontaxable items on one line and Ohio treats the whole sale as taxable.8Ohio Department of Taxation. Sales and Use Taxability
Most grocery food sold for off-premises consumption is exempt, along with bottled unsweetened water and beverages containing milk or milk substitutes. Soft drinks are always taxable. Ohio defines a soft drink as a sweetened nonalcoholic beverage without milk or a milk substitute that isn’t more than 50% fruit or vegetable juice by volume. Alcohol, dietary supplements, tobacco, and prepared food eaten on-site fall outside the food exemption.9Ohio Department of Taxation. Food Service Industry
Clothing is not broadly exempt in Ohio. It is taxable year-round, except during Ohio’s annual sales tax holiday, typically three days in early August, when clothing at $75 or less, school supplies at $20 or less, and instructional materials at $20 or less are temporarily exempt. Remote sellers shipping to Ohio during that window need to honor the holiday.10Ohio Department of Taxation. Ohio Sales Tax Holiday
If a buyer claims an exemption (resale, nonprofit, government, manufacturing equipment), collect a completed exemption certificate before skipping the tax. The standard blanket form is the STEC B, and it covers all future purchases from that buyer.11Ohio Department of Taxation. Sales and Use Tax Blanket Exemption Certificate Keep certificates on file permanently; without one, you owe the uncollected tax if audited.
Selling Through a Marketplace vs. Your Own Site
If your sales go through a platform that handles checkout and payment, Ohio treats that marketplace facilitator as the retailer. The platform calculates, collects, and remits tax on those sales and handles destination sourcing.6Ohio Department of Taxation. ST 2009-03 – Sales and Use Tax: Sourcing
A marketplace seller can ask the Tax Commissioner for a waiver so a specific facilitator isn’t treated as the seller for their transactions, but the seller then takes on the collection and remittance duties directly.12Ohio Legislative Service Commission. Ohio Revised Code 5741.071 – Waiver for Facilitator Not To Be Treated as a Seller
Sell through both a marketplace and your own website and you have two separate channels. The facilitator covers its platform’s sales; you collect and remit on your direct sales. Both revenue streams count toward the $100,000 and 200-transaction thresholds, including the sales the platform handles.
How To Register
You have two ways in. The Ohio Business Gateway at gateway.ohio.gov opens a seller’s use tax account directly with the state.13Ohio Business Gateway. Ohio Business Gateway The Streamlined Sales Tax Registration System lets you register for Ohio and other member states in one application; Ohio is a full member.14Streamlined Sales Tax. Have your Federal Employer Identification Number, exact legal business name from your IRS records, NAICS code, responsible-officer information including Social Security numbers and home addresses, and bank routing and account numbers ready for electronic payment setup. A confirmation number appears on screen when you submit, and the Department of Taxation typically emails a permanent account number within a few business days. That confirmation marks the official start of your collection duties.
Filing, Paying, and the Vendor Discount
Most remote sellers file monthly. Returns and payment are due by the 23rd of the month after the reporting period. January’s tax is due February 23.3Ohio Department of Taxation. Sales and Use Tax File a return every period your account is active, even for a zero-sales month.15Ohio Department of Taxation. Sales and Use Tax Filing Deadline Reminder
Sellers whose annual sales tax liability exceeds $75,000 must pay by electronic funds transfer and make accelerated payments: 75% of the estimated current month’s liability is due by the 23rd along with the reconciled return for the prior month.16Ohio Department of Taxation. Accelerated and Electronic Sales and Use Tax Payments Sellers under that threshold can still pay electronically through the Gateway, and most do.
File and pay in full by the due date and you keep 0.75% of the tax collected as a vendor discount. Starting January 1, 2026, the discount is capped at $750 per license per monthly period.17Ohio Department of Taxation. ST 2025-02 – Vendor Timely Filing Discount Miss the deadline by a day and you forfeit it entirely.
What Late or Missed Collection Costs
Ohio charges interest on overdue sales tax at 7.0% per year for 2026, roughly 0.58% per month, running from the original due date until payment.18Ohio Department of Taxation. Interest Rates
Sellers in the accelerated-payment program face an additional charge of up to 5% on any underpayment if their estimated monthly payment comes in below 75% of the actual liability for that month. That penalty doesn’t apply if the estimate equals or exceeds 75% of the same month’s liability from the prior year, giving a safe-harbor path based on last year’s figures.16Ohio Department of Taxation. Accelerated and Electronic Sales and Use Tax Payments
The bigger risk is an audit. Ohio can assess back taxes for periods when you should have been collecting but weren’t, which often catches sellers who crossed a threshold without noticing. Registering when you first cross the line, and filing on time after that, is far cheaper than reconstructing years of uncollected tax later.
