Oklahoma bar reciprocity requirements let an experienced out-of-state attorney join the Oklahoma bar without sitting for the exam, through a process called admission on motion. You need an active license in good standing in a reciprocal state, at least three years of qualifying practice within the five years before you apply, a law degree from an ABA-accredited school, and a Multistate Professional Responsibility Examination scaled score of at least 80. The Oklahoma Supreme Court sets these rules under Rule 2 of the Rules Governing Admission to the Practice of Law, and the Board of Bar Examiners handles the review.
The Four Eligibility Requirements
Rule 2 requires all four of the following:
- A J.D. from a law school accredited by the American Bar Association.
- An active law license in good standing in a reciprocal state.
- Actual and continuous practice of law for at least three of the five years immediately before you apply.1New York Codes, Rules and Regulations. Oklahoma Title 5 Attorneys and State Bar – Rule 2 Admission Upon Motion Without Examination
- A scaled score of at least 80 on the MPRE.2Oklahoma Board of Bar Examiners. Frequently Asked Questions
One point worth double-checking against outdated guides: an older version of Rule 2 required five years of practice within the preceding seven, and that language still appears in a 2017 Oklahoma Supreme Court order.3Justia. In Re Amendment of Rule 2 of Rules Governing Admission to the Practice of Law The current standard is three of five.1New York Codes, Rules and Regulations. Any past suspension or disbarment is a serious problem. The Board’s investigation will find it, and unresolved discipline in any jurisdiction can disqualify you.
What Practice Counts Toward the Three Years
Rule 2 defines qualifying practice broadly, not just courtroom work:
- Private practice or firm work — advising clients, drafting, and representing parties in proceedings.
- Corporate or in-house counsel work, so long as your primary duties were legal.1New York Codes, Rules and Regulations. Oklahoma Title 5 Attorneys and State Bar – Rule 2 Admission Upon Motion Without Examination
- Government attorney work for federal, state, or local government, the armed services, or a sovereign Indian nation, with the same legal-duties standard.
- Service as a judge, magistrate, referee, or law clerk in a position open only to attorneys.
- Full-time teaching at an ABA-accredited law school.
There’s a catch that trips up applicants who have moved around. Your qualifying practice must have taken place under the supervision and disciplinary authority of a reciprocal state’s bar or supreme court. Time spent practicing in a non-reciprocal state doesn’t count, even if the work itself is the kind Rule 2 lists. If two of your last five years were in California or Florida, those years can’t help you clear the three-year bar.
Which States Are Reciprocal With Oklahoma
Oklahoma applies strict reciprocity. If your home state admits Oklahoma attorneys on motion, Oklahoma will do the same for you. If it makes Oklahoma lawyers sit for its exam, Oklahoma will make you sit for the Oklahoma bar exam.3Justia. In Re Amendment of Rule 2 of Rules Governing Admission to the Practice of Law
The Board of Bar Examiners currently recognizes reciprocity with: Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, District of Columbia, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, South Dakota, Tennessee, Texas, Utah, Vermont, Virgin Islands, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.2Oklahoma Board of Bar Examiners. States not on that list include California, Delaware, Florida, Hawaii, Louisiana, Nevada, Rhode Island, and South Carolina. If your license is in one of those, admission on motion isn’t available. You would need to take the Oklahoma bar exam or transfer a qualifying UBE score. Reciprocity can shift when other states change their own rules, so confirm your state’s current status with the Board before you invest time in an application.
UBE Score Transfer if Motion Isn’t an Option
Oklahoma has adopted the Uniform Bar Examination, which gives a second route. A UBE scaled score of 260 or higher transfers into Oklahoma with no additional exam.4Justia. In Re Uniform Bar Examination Minimum Passing Score The Oklahoma Supreme Court lowered the threshold from 264 to 260 effective July 1, 2024.
Timing is the constraint. Your UBE score has to be less than three years old when you apply.5Oklahoma Board of Bar Examiners. Applications Oklahoma used to accept scores between three and five years old; that option is gone. The application fee for a UBE transfer is $2,000, the same as admission on motion.
Which path fits depends on where you are in your career. UBE transfer suits newer attorneys who recently passed the bar in another UBE jurisdiction but don’t yet have three years of practice. Admission on motion suits experienced attorneys whose exam scores may be long expired. If you qualify for both, motion admission is usually cleaner because it has no score-expiration deadline.
What to File and What It Costs
The admission-on-motion application has several moving parts, and incomplete packages are the most common cause of delay.
- The formal application form from the Board of Bar Examiners website. The employment section is what the Board uses to verify your three years, so fill it out carefully.
- A character and fitness report ordered through the National Conference of Bar Examiners at ncbex.org. NCBE charges its own fee for this, separate from the Board’s filing fee.
- Your MPRE score, sent directly to the Board, with the minimum scaled score of 80.6National Conference of Bar Examiners. Oklahoma Bar Admission
- A $2,000 non-refundable filing fee. Payment by check, cash, money order, or credit or debit card is accepted; card payments carry a 3% surcharge.7Oklahoma Board of Bar Examiners. Admission on Motion – Reciprocity
Do not send Certificates of Good Standing with your initial package. The Board asks you to wait until it approves your application, then request a current certificate and present it to the Oklahoma Supreme Court.7Oklahoma Board of Bar Examiners. Admission on Motion – Reciprocity Sending them early doesn’t speed anything up and can cause a headache if they expire before the Court acts.
What Happens After You File
The Board conducts a character and fitness investigation once your application is in. Investigators verify employment history, check references, and review your financial and criminal background through the NCBE report. Expect the process to take several months.
The Board itself doesn’t admit anyone. It sends a report and recommendation to the Oklahoma Supreme Court, which makes the final decision. The Court is not bound by the Board’s recommendation and can approve, deny, or take any other action.8Oklahoma Board of Bar Examiners. Handling an Oklahoma Matter While You Wait
If a single case brings you into Oklahoma before you’re admitted, pro hac vice appearance is the mechanism, not a substitute for admission on motion. It requires a written application and affidavit to the Oklahoma Bar Association, a $350 non-refundable fee (with $350 annual renewals if the case runs past a year), association with local Oklahoma counsel who signs pleadings and appears at hearings, and a written motion asking the specific judge for permission to appear.9Oklahoma Bar Association. Out-of-State Attorneys The judge can deny it. If you plan to handle multiple Oklahoma matters, full admission is the right path.
Dues and CLE Once You’re In
Active bar dues are $350 per year. Attorneys admitted to practice in any state for fewer than three years pay a reduced rate of $150 per year.10New York Codes, Rules and Regulations. Oklahoma Bar Association – Section 1 Annual Dues
Continuing legal education starts the calendar year after you’re admitted. Newly admitted attorneys are exempt from MCLE for the remainder of the year they’re admitted; the exemption is recorded automatically. From the following year on, you owe 12 approved CLE credits annually, including at least two in legal ethics.11Oklahoma Mandatory Continuing Legal Education.
