Oklahoma Child Support: Guidelines, Calculation, and Enforcement

Oklahoma child support is set under an Income Shares formula that combines both parents’ gross monthly incomes, pulls a base support figure from a statutory schedule, and divides it in proportion to what each parent earns. The noncustodial parent pays their share, usually through automatic wage withholding, until the child turns 18 (or 20 if still in high school). The rules, the worksheet, and the enforcement tools all live in Title 43 of the Oklahoma Statutes and the Department of Human Services administrative code.

Who Pays and for How Long

Both biological parents owe financial support, married or not. The parent with primary physical custody receives payments; the noncustodial parent sends them. The amount turns on income, not on fault for a breakup.

For a child born outside marriage, no support order issues until paternity is legally established. That happens one of three ways: both parents sign an Acknowledgment of Paternity, a judge rules after genetic testing, or the mother was married at the time of birth (which presumes her husband is the legal father). If the mother was married to someone other than the biological father, the husband must sign a Denial of Paternity before the biological father can be recognized.1Oklahoma Department of Human Services. Support usually ends at 18. If the child is still enrolled in high school at 19, support continues until graduation or the child’s twentieth birthday, whichever comes first.2Oklahoma Department of Human Services. Child Support Services Frequently Asked Questions

Disabled Adult Children

Courts can order support to continue indefinitely for an adult child with a physical or mental disability if the disability (or its cause) existed before the child turned 18 and prevents the child from being self-supporting. The court weighs care needs, each parent’s resources, and available public benefits. A child 18 or older can be designated to receive the payments directly.3Justia. How the Amount Is Calculated

The Income Shares Model in 43 O.S. § 118 starts from the idea that a child should get roughly the same share of parental income they would have in a joint household. Combine both gross incomes, read the base number off the statutory table, then split it by each parent’s percentage of the combined total.4Justia. Oklahoma Code 43-118 – Child Support Guidelines

What Counts as Gross Income

Gross income is defined broadly: wages, salaries, commissions, bonuses, overtime, royalties, self-employment earnings, pensions, trust income, unemployment benefits, and most other recurring money. Self-employment income is gross receipts minus ordinary and necessary business expenses. Fringe benefits like a company car or housing allowance count when they reduce the parent’s personal living costs.

When a parent’s reported income is missing or clearly understated, the court can impute income based on education, training, work history, prevailing wages in the parent’s industry and area, voluntary unemployment or underemployment, and the parent’s actual lifestyle. The floor for imputation is at least 25 hours per week at minimum wage.5New York Codes, Rules and Regulations. Oklahoma Code 43-118B – Self-Employment Income, Fringe Benefits

Reading the Guideline Schedule

Combined gross monthly income is looked up on the Child Support Guideline Schedule in 43 O.S. § 119, which lists base obligations for one through six or more children at each income level. At $5,000 combined monthly income with two children, the base is $943. At $10,000 combined, two children, the base is $1,537.6Justia. Oklahoma Code 43-119 – Computation of Child Support, Child Support Guideline Schedule

The schedule caps at $15,000 combined monthly income. Above that, the court uses $15,000 as the floor and has discretion to add more. For more than six children, the court starts from the six-child figure and adjusts upward.6Justia. Oklahoma Code 43-119 – Computation of Child Support, Child Support Guideline Schedule

Splitting the Obligation

Each parent owes the same percentage of the base amount as their percentage of combined income. A parent earning 60% of the total owes 60% of the base. The custodial parent’s share is presumed spent directly on the child; the noncustodial parent’s share is paid as monthly child support.7New York Codes, Rules and Regulations. Oklahoma Code 43-118D – Computation of Child Support as Percentage of Parents Combined Gross Income

The Child Support Computation Form, an Excel worksheet from DHS, runs the full calculation. Both parents need documentation of gross monthly income (pay stubs, tax returns, profit-and-loss statements), the cost of work-related childcare, and the child’s health insurance premium. The signed form attaches to any order establishing or modifying support.8Oklahoma Department of Human Services. Guidelines and Computation

Parenting Time Adjustment

When the noncustodial parent has the child for 121 or more overnights a year, the base obligation is adjusted downward because that parent is already covering direct costs during those stays. With multiple children on different schedules, overnights are averaged across the children in the case.9Justia. Oklahoma Code 43-118E – Parenting Time Adjustment

The combined base obligation is multiplied by a factor that shrinks as overnights rise:

  • 121 to 131 overnights: base multiplied by 2
  • 132 to 143 overnights: base multiplied by 1.75
  • 144 or more overnights: base multiplied by 1.5

The adjusted amount is split by income shares, each parent’s share is multiplied by the percentage of time the child spends with the other parent, and the higher owing parent pays the difference. The DHS computation spreadsheet handles the arithmetic.9Justia. Oklahoma Code 43-118E – Parenting Time Adjustment

Medical Support

Every Oklahoma support order includes medical support. The court can require a parent to carry health insurance for the children, pay cash medical support, or both. Insurance is “reasonable in cost” only when the parent’s premium share for the children stays within 5% of that parent’s gross monthly income.10Justia. Oklahoma Code 43-118F – Medical Support Order for Health Care Coverage

To isolate the children’s share of a premium, the court subtracts the cost of covering the parent and other adults, divides the remainder by the total dependent children on the plan, and multiplies by the number of children in the case. Coverage must also be accessible, with providers within 60 miles of where the children live.10Justia. Oklahoma Code 43-118F – Medical Support Order for Health Care Coverage

When no private coverage is available, or the only coverage is a program like Medicaid, the court orders cash medical support instead. It’s capped at the parent’s pro rata share of actual monthly medical costs or 5% of the obligor’s gross monthly income, whichever is lower.8Oklahoma Department of Human Services. When a Judge Can Depart From the Guidelines

The guideline number is presumed correct, but a judge can set a higher or lower amount if the standard figure would be unjust or against the child’s best interests. Any deviation requires written findings. A court cannot deviate so far that the custodial household can’t cover basic housing, food, and clothing.

Typical grounds include extraordinary medical needs beyond insurance, extreme economic hardship, extraordinary educational expenses, and reunification plans where a parent in a DHS case needs to establish adequate housing. Parents represented by attorneys can agree to a different amount, but the court must still find the agreed figure serves the child’s best interests.11Oklahoma Statutes. How to Open a Case

There are two routes to a support order: through DHS Child Support Services (CSS) or through district court with a private attorney.

CSS handles cases administratively at no application fee. You apply at a local child support office, and the state locates the other parent, establishes paternity if needed, and calculates the obligation. Hearings go through the Office of Administrative Hearings (OAH), which can establish paternity, set ongoing support, and determine back support. OAH orders carry the same legal weight as district court orders. OAH cannot decide custody or visitation, so disputes over those issues have to go through district court.12Oklahoma Department of Human Services. Office of Administrative Hearings FAQ

The district court route is typical when child support is wrapped into a divorce, legal separation, or paternity action where custody and visitation are also on the table. You’ll pay county filing fees and either hire a lawyer or represent yourself.

How Payments Flow

Nearly all Oklahoma child support runs through the state’s Centralized Support Registry, which tracks every payment in and out and settles disputes about whether money changed hands.13Oklahoma Administrative Code. Oklahoma Administrative Code 340:25-5-350.3 – Payment of Support Through Centralized Support Registry

Most orders include an immediate income assignment that tells the obligor’s employer to withhold support from each paycheck and remit it to the Registry within seven days. Income assignment is required in virtually every case unless the court finds good cause for an alternative or both parents sign a written agreement for a different method.14New York Codes, Rules and Regulations. Oklahoma Code 12-1171.3 – Income Assignment Proceedings

Recipients get funds through direct deposit or an Oklahoma MasterCard debit card.15Oklahoma Department of Human Services. Oklahoma Child Support Services: Oklahoma MasterCard Debit Card Obligors not on wage withholding can pay through the state’s online portal, by mail, or at authorized walk-in locations.

Changing an Existing Order

Oklahoma allows modification whenever there’s a material change in circumstances. The statute lists examples: a significant income increase or decrease, changes in childcare costs, changes in health insurance costs, a child reaching the age of majority, and incarceration of a parent for more than 180 consecutive days.16Justia. Oklahoma Code 43-118I – Modification of Child Support Orders

One trap worth flagging: when one child in a multi-child order turns 18, the amount does not drop automatically. You still have to file for modification.

For CSS-handled cases, the administrative code sets a sharper test. A modification is warranted when the recalculated amount would change by at least 20% and at least $30 from the current order.17Legal Information Institute. Oklahoma Administrative Code 340:25-5-198.2 – Modification Either parent can also request a formal review at least every three years without pointing to any particular change.18Office of Child Support Services. What Happens If Payments Fall Behind

Oklahoma’s enforcement tools escalate as arrears grow.

Contempt of court is the main judicial enforcement mechanism. A parent who ignores a support order can be held in indirect contempt and face jail time. The court sets a purge amount that, once paid, ends the detention. The point is to pressure payment, not to punish past debt.19Oklahoma Department of Human Services. Child Support Contempt

License actions reach beyond driving. Oklahoma can revoke, suspend, or refuse to issue or renew driver’s licenses, professional licenses, and recreational licenses like hunting and fishing permits for parents out of compliance.19Oklahoma Department of Human Services. Child Support Contempt

Federal tax refund intercept lets the state seize a delinquent parent’s federal refund and apply it to past-due support. A new spouse on a joint return can file an injured spouse claim on IRS Form 8379 to recover their share.

Passport denial kicks in at $2,500 in arrears. The U.S. State Department will refuse to issue or renew a passport until the debt is resolved.20U.S. Department of State. Passports and Child Support Debt

Interest on past-due support accrues at 2% per year. The rate is modest, but child support arrears cannot be discharged in bankruptcy, so the balance follows the obligor indefinitely.21Justia. Oklahoma Code 43-114 – Interest on Court-Ordered Past-Due Child Support
