Oklahoma Earned Income Tax Credit: Eligibility, Amount, and Filing

The Oklahoma earned income tax credit is worth 5% of your federal Earned Income Tax Credit, and it is fully refundable, meaning you get the money even if you owe no state income tax. You claim it on Form 511 using the Form 511-EIC worksheet, and eligibility follows the federal EITC rules almost exactly.1Justia Law. A refundable credit works like this. If you owe $50 in Oklahoma tax and your credit comes to $150, the state cancels the $50 and sends you the remaining $100 as a refund. Who Qualifies

Oklahoma ties its credit to Section 32 of the Internal Revenue Code, so if you qualify for the federal EITC and you’re an Oklahoma resident or part-year resident, you qualify for the state credit.2Legal Information Institute. Part-year residents prorate the credit by the ratio of their Oklahoma adjusted gross income to their federal adjusted gross income.1Justia Law. The federal rules you have to satisfy:

  • You need earned income from wages, salary, tips, or self-employment. Interest, dividends, and other passive income do not count toward the earned income requirement.
  • Your filing status must be single, head of household, married filing jointly, or qualifying surviving spouse. Married filing separately generally does not qualify.
  • You, your spouse if filing jointly, and any qualifying children must all have valid Social Security numbers.
  • Your investment income for the year cannot exceed roughly $11,950 for 2025 (the IRS adjusts this each year).

How Much the Credit Is Worth

Because the Oklahoma credit is 5% of the federal amount, the income ceilings that determine your federal EITC also determine whether you can claim anything in Oklahoma. For 2026 the approximate federal figures are:

  • No qualifying children: federal credit up to $664, phasing out around $19,540 (single or head of household) or $26,820 (married filing jointly).
  • One qualifying child: federal credit up to $4,427, phasing out around $51,593 (single) or $58,863 (joint).
  • Two qualifying children: federal credit up to $7,316, phasing out around $58,629 (single) or $65,899 (joint).
  • Three or more qualifying children: federal credit up to $8,231, phasing out around $62,974 (single) or $70,224 (joint).

At the top of the scale, a family with three or more qualifying children claiming the maximum federal EITC would see an Oklahoma credit of roughly $412. A childless worker at the federal maximum would see about $33. The Oklahoma amount is calculated on its own worksheet rather than lifted straight off your federal return, so the state figure may not equal exactly 5% of your federal EITC in every case.

How to Claim It on Your Oklahoma Return

File your federal return first. You need the completed federal calculation before you can work through the state forms. Then:

  • Complete Oklahoma Form 511-EIC, the Earned Income Credit Worksheet, to calculate your Oklahoma credit amount.
  • Transfer the result to Schedule 511-G of your Oklahoma Form 511.

Mismatches are a common cause of processing delays.

Deadline and Refund Timing

The 2025 Oklahoma return is due April 15, 2026.6Oklahoma Tax Commission.   • E-file with paper check: about 6 weeks.
  • Paper return with direct deposit: about 10 to 12 weeks.
  • Paper return with paper check: about 11 to 13 weeks.

What Happens If You Claim the Credit in Error

If the IRS decides you claimed the EITC through reckless or intentional disregard of the rules, you lose the credit for the next two years. A finding of actual fraud extends that ban to ten years.3Office of the Law Revision Counsel. 26 USC 32 – Earned Income Because the Oklahoma credit depends on federal eligibility, a federal ban blocks the state credit too.

At the state level, if an incorrect credit leaves you underpaid, the Oklahoma Tax Commission adds a 5% delinquency penalty on the unpaid amount plus 1.25% monthly interest running from the original due date.10Oklahoma Tax Commission.
