Oklahoma Form 511-NR for Nonresidents and Part-Year Filers

If you lived outside Oklahoma all year or only part of the year and earned income connected to the state, Oklahoma Form 511-NR is the return you file. It is required when your gross income from Oklahoma sources reaches $1,000 for the tax year, and it uses an apportionment method so you pay Oklahoma tax only on the portion of your income actually sourced to the state.1Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents

Who Has to File

You file Form 511-NR if you are a nonresident or part-year resident of Oklahoma and your gross income from Oklahoma sources is $1,000 or more during the tax year.1Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents A nonresident is someone whose permanent home was outside Oklahoma for the entire year. A part-year resident is someone whose permanent home was in Oklahoma for part of the year because they moved into or out of the state.

File anyway if you fall below $1,000 but had Oklahoma income tax withheld from a paycheck or made estimated payments to the state. Filing is the only way to recover that money. Check the box on the form indicating you are filing solely to claim a refund.

Mixed-Residency Couples

When an Oklahoma resident is married to a nonresident and they filed a joint federal return, they have two options. They can file separately for Oklahoma, with the resident using Form 511 and the nonresident using Form 511-NR. Or they can file a joint Oklahoma return on Form 511, treat all income as if both were residents, and then claim a credit on Form 511-TX for taxes paid to the other spouse’s home state.1Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents

What Counts as Oklahoma-Source Income

Oklahoma can tax a nonresident only on income connected to the state. Different kinds of income are sourced differently.

Wages. Pay for services counts as Oklahoma income only when you physically performed the work in Oklahoma.1Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents If you worked partly in Oklahoma and partly elsewhere, you split the income based on the time worked in each place. Pay for work done entirely outside Oklahoma is not taxed by Oklahoma, even if your employer is headquartered there.

Remote work. Oklahoma sources wages to where the work is physically performed. Working from home in another state for an Oklahoma employer is generally not Oklahoma-source income. The question is where you were when you did the work, not where the employer’s office sits. Incorrect Oklahoma withholding on remote-worker paychecks is common, which is one reason to file even if you otherwise wouldn’t owe.

Real property. Rent, royalties, and gains from selling real estate or tangible property in Oklahoma are always Oklahoma-source income, including oil and gas royalties from Oklahoma wells.1Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents

Business and pass-through income. If you run a business, practice a profession, or provide services in Oklahoma, that income is sourced there. Nonresidents who are partners or S corporation shareholders in an entity doing business in Oklahoma report their share of its Oklahoma-apportioned income. Oklahoma law requires the pass-through entity to withhold tax at the top marginal rate on distributions to nonresident members, so you may already have had Oklahoma tax taken out before you received the money.2Justia Law. Oklahoma Code Title 68 Section 2385-30 – Withholding by Pass-Through Entity

Investment income. Interest, dividends, and capital gains from stocks and other intangibles are generally not Oklahoma-source income for nonresidents. That passive income follows your home state. The main exception is gambling winnings from Oklahoma sources, which Oklahoma taxes.

How the Tax Is Calculated

The 511-NR calculation looks dense but the idea is simple. Oklahoma figures what your tax would be if all your income were Oklahoma income, then charges you only the percentage that came from Oklahoma sources.

Step 1: Report All Income, Then Split It

Start with your federal adjusted gross income from your Form 1040, entered in the “Federal Amount” column. Schedule 511-NR-1 then separates out the Oklahoma-source portion.1Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents Every line gets two columns: the total amount and the Oklahoma amount.

Step 2: Apply Oklahoma Additions and Subtractions

Schedule 511-NR-A adds income the federal return excluded but Oklahoma taxes, such as interest from other states’ bonds. Schedule 511-NR-B subtracts income that Oklahoma exempts, such as Social Security benefits included in federal AGI.3Oklahoma Tax Commission. 2025 Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents – Developer Packet Apply the adjustments to both columns. You end up with two figures: adjusted gross income from all sources, and adjusted gross income from Oklahoma sources.

Step 3: Calculate a Hypothetical Full-Resident Tax

Calculate what your Oklahoma tax would be if you were a full-year resident on your total income from all sources. Subtract the Oklahoma standard deduction (or itemized deductions, if you itemized federally) and your personal exemption from all-source AGI. Look up the tax on that amount using the brackets in the next section. Oklahoma generally requires you to itemize on the state return if you itemized federally.

Step 4: Multiply by the Oklahoma Percentage

The Oklahoma Percentage is Oklahoma-source AGI divided by all-source AGI. Multiply that percentage by the hypothetical tax. The result is your Oklahoma income tax.

For example, with $20,000 of Oklahoma-source AGI and $80,000 of all-source AGI, the Oklahoma Percentage is 25%. If the hypothetical tax on all income came to $2,800, Oklahoma tax is $700.

Credit for Taxes Paid to Another State

Nonresidents cannot claim Oklahoma’s Form 511-TX credit for taxes paid to another state. That credit is reserved for Oklahoma residents and part-year residents who, while living in Oklahoma, earned income that was also taxed by another state.6Oklahoma Tax Commission. 2025 Form 511-TX Credit for Tax Paid to Another State As a nonresident, you claim a credit on your home state’s return for the tax you pay Oklahoma, not the other way around.

Deadlines, Extensions, and How to File

Form 511-NR is due April 15, the same day as your federal return. If you file electronically, the deadline extends to April 20, but any balance due must also be paid electronically by that date to count as timely. Estimated Payments, Penalties, and Interest

If your Oklahoma liability will exceed your withholding by $500 or more, you likely owe quarterly estimated payments on Form OW-8-ES. The requirement applies when expected withholding is less than 70% of your current year’s tax or less than your prior year’s total tax.10Oklahoma Tax Commission. Oklahoma Individual Estimated Tax – Form OW-8-ES For calendar-year filers the quarterly due dates are April 15, June 15, September 15, and January 15 of the following year.

Oklahoma does not charge underpayment interest if the total tax shown on your return is less than $1,000.10Oklahoma Tax Commission. Oklahoma Individual Estimated Tax – Form OW-8-ES Many nonresidents with modest Oklahoma income can skip estimated payments on that basis. When estimated-tax interest does apply, the rate is 20% per year on the underpaid amount for the period of underpayment.11Oklahoma Tax Commission. Pay Taxes

Missing the April 15 payment deadline carries a 5% delinquent penalty on unpaid tax when less than 90% of your liability is paid by the due date.11Oklahoma Tax Commission. Pay Taxes If the balance remains unpaid more than 30 days after becoming delinquent, an additional 10% penalty applies.12Justia Law. Oklahoma Code Title 68 Section 217 – Interest and Penalties on Delinquent Taxes Interest accrues at 1.25% per month, or 15% per year, from the original due date until paid.

Ignoring a written OTC demand to file raises the stakes further. If you still fail to file within 10 days after the demand, the penalty jumps to 25% of the assessed amount. Fraud triggers a 50% penalty on top of the deficiency and interest.12Justia Law. Oklahoma Code Title 68 Section 217 – Interest and Penalties on Delinquent Taxes

Military Service Members and Spouses

Under federal law, a service member keeps the legal home they had when they entered service. A nonresident service member stationed in Oklahoma does not become an Oklahoma resident because of military orders, and military pay earned in Oklahoma is taxable only by the home state.

Military spouses have similar protection under the Military Spouses Residency Relief Act. If your spouse is active-duty stationed in Oklahoma and you moved to Oklahoma to be with them while sharing their domicile, your earned income in Oklahoma is exempt from Oklahoma withholding and income tax. File Form OW-9-MSE with your employer to stop Oklahoma withholding.13Oklahoma Tax Commission. Form OW-9-MSE Annual Withholding Tax Exemption Certification for Military Spouses
