The Oklahoma sales tax starts at a 4.5% state rate, but what you actually pay at the register is almost always higher because cities and counties add their own taxes on top. Combined rates across the state average around 9% and can push past 11% in some locations. The biggest recent change for shoppers: as of August 29, 2024, groceries are exempt from the 4.5% state portion, though local grocery taxes still apply.
The State Rate and What It Covers
Oklahoma’s baseline sales tax is 4.5% of the gross receipts from each taxable sale. That rate applies to tangible personal property such as clothing, electronics, furniture, and household goods. It also covers natural gas, electricity, and other utilities (except water, sewage, and refuse), along with telecommunications services that originate or terminate in Oklahoma.1Oklahoma Legal Information System. Oklahoma Code 68-1354 – Tax Levy – Rate – Sales Subject to Tax Every retailer in Oklahoma applies this same 4.5% as a starting point.
Why the Total You Pay Depends on Where You Shop
Cities and counties have broad authority to add sales taxes on top of the state rate. Any incorporated city or town may levy a sales tax for general or specific municipal purposes with voter approval,2Justia. Oklahoma Code 68-2701 – Authorization to Tax for Municipal Purposes and counties can levy their own sales taxes for purposes like emergency medical services, again subject to voter approval.3New York Codes, Rules and Regulations. Oklahoma Code 68-1370.10 – County Sales Tax – Consumer Sales Tax – Voter Approval
Combined rates typically land between 8% and 11%, with some jurisdictions higher. Because voters can add or repeal local levies, the total shifts from one zip code to the next. The Oklahoma Tax Commission maintains an online rate locator so you can look up the exact rate for a specific address.4Oklahoma Tax Commission. Oklahoma Tax Commission – Publications
Groceries: State Exemption, Local Tax Still Applies
Under HB 1955, “food and food ingredients” and certain prepared foods are exempt from state sales and use tax as of August 29, 2024.5Oklahoma Tax Commission. State Sales Tax on Food and Food Ingredients That removes the 4.5% state share from grocery receipts.
Local sales taxes on groceries still apply. Your city and county taxes are collected on food purchases the same way as before. In a city with a 4% combined local rate, that means you pay 4% on groceries instead of the 8.5% you would have owed under the old rules.
Other Common Exemptions
Prescription drugs prescribed for the treatment of human beings are exempt, along with insulin and medical oxygen. Over-the-counter drugs are not exempt. Prosthetic devices bought by an individual for personal use qualify, but corrective eyeglasses, contact lenses, and hearing aids do not.6Justia. Oklahoma Code 68-1357v2 – Exemptions – General
Feed, supplies, and equipment bought by businesses that raise animal life for market (including fish, worms, and poultry) are exempt when the buyer certifies in writing on the invoice that the items will be used for that purpose.6Justia. Oklahoma Code 68-1357v2 – Exemptions – General Sales to government entities and qualifying nonprofits are generally exempt, though vendors must keep detailed records of each exempt transaction.7Oklahoma Tax Commission. Oklahoma Sales Tax Vendor Responsibilities Exempt Sales
If you buy goods specifically to resell them, you can purchase tax-free by giving your supplier a valid resale certificate. Oklahoma participates in the Streamlined Sales Tax system, so the certificate works across participating states, and you must include your Oklahoma sales tax ID number. A certificate can cover a single purchase or serve as a blanket certificate good for future purchases from the same vendor, provided transactions occur no more than 12 months apart.8Oklahoma Tax Commission. Streamlined Sales Tax Certificate of Exemption The buyer is responsible for actually qualifying for the exemption; claim one you’re not entitled to and you owe the tax, interest, and possible penalties.
The Annual Sales Tax Holiday
Oklahoma holds a three-day sales tax holiday every year, running from 12:01 a.m. on the first Friday in August through midnight Sunday. During the window, clothing and footwear priced under $100 per item are exempt from both state and local sales taxes. Accessories, athletic-specific gear, and protective footwear people wouldn’t normally wear outside those activities are not covered, and rentals are excluded.9Oklahoma Tax Commission. When You Owe Use Tax Instead
Buy something from an out-of-state seller that doesn’t collect Oklahoma tax and you owe use tax on that purchase. The state use tax rate is the same 4.5%, applied to the price of tangible personal property stored, used, or consumed in Oklahoma.10Justia. Oklahoma Code 68-1402 – Excise Tax on Storage, Use or Other Consumption of Tangible Personal Property Cities and counties can add local use tax at their local sales tax rate, so the total use tax mirrors what you would have paid buying the item locally.11New York Codes, Rules and Regulations. Oklahoma Code 68-1411 – Additional Excise Tax on Storage, Use or Other Consumption of Tangible Personal Property Most large online retailers now collect Oklahoma tax at checkout, but if yours didn’t, the responsibility to remit is yours.
Rules for Remote Sellers
Since November 1, 2019, out-of-state sellers who exceed $100,000 in aggregate sales of taxable goods delivered into Oklahoma during the current or preceding calendar year must collect and remit Oklahoma sales or use tax, whether or not they have any physical presence in the state.12Oklahoma Tax Commission. Wayfair Frequently Asked Questions The threshold measures taxable sales only, not total revenue. Sellers below it are treated as small sellers and are not required to collect. Once a remote seller crosses the line, it must register with the Oklahoma Tax Commission and collect the appropriate state and local tax for each delivery address.
Getting a Permit and Filing Returns
Any business making taxable sales in Oklahoma needs a sales tax permit from the Oklahoma Tax Commission before selling. The permit costs $20 plus a handling fee and renews every three years.13New York Codes, Rules and Regulations. Oklahoma Code 68-1364 – Permits to Do Business You apply through OkTAP, the Tax Commission’s online portal, using your Federal Employer Identification Number or Secretary of State filing number.14Oklahoma.gov. Obtain Licenses and Permits Each business location needs its own permit, and the permit must be displayed conspicuously where customers can see it.
Most permit holders file monthly, with the return for each month due by the 20th of the following month. If your business remits less than $50 per month in sales tax, you qualify for semi-annual filing instead. Semi-annual returns are due January 20 (covering July through December) and July 20 (covering January through June).15Oklahoma Tax Commission. Help Center – Businesses Returns go through OkTAP, and the system accepts ACH debit, ACH credit, credit card, cash, check, or money order. Keep the confirmation number and your underlying records; the Tax Commission can audit at least three years back.
Penalties, Interest, and How Far Back Auditors Can Go
Missing a deadline gets expensive fast. Unpaid tax accrues interest at 1.25% per month from the delinquency date, which works out to 15% per year. A 10% penalty is added if the tax stays unpaid more than 15 days past delinquency.16Justia. Oklahoma Code 68-217 – Interest and Penalties on Delinquent Taxes The Tax Commission will waive the 10% penalty if you pay the tax and interest within 60 days of receiving a proposed assessment, or if you voluntarily file an amended return.
The standard audit lookback is three years from the filing date. If your business never filed a return for a given period, that three-year cap doesn’t apply and auditors can go back further. The same extended lookback applies to out-of-state purchases where use tax was never reported.17Oklahoma Tax Commission. Is Your Business at Risk Filing late is bad; not filing at all is worse.
Deducting Oklahoma Sales Tax on Your Federal Return
If you itemize on your federal return, you can deduct state and local sales taxes in place of state income taxes. For 2026, the combined deduction for state and local income, sales, and property taxes is capped at $40,400 ($20,200 if married filing separately). That cap phases down if your modified adjusted gross income exceeds $505,000 ($252,500 if married filing separately), but it will not drop below $10,000 ($5,000 if married filing separately).18Internal Revenue Service. Correction to State and Local Income Tax Deduction Amount in the 2026 Form 1040-ES
Because Oklahoma has a state income tax, most filers get a bigger deduction by choosing income tax rather than sales tax. If you made unusually large purchases or have low state income tax liability, run the numbers both ways. The IRS provides optional sales tax tables on Schedule A to simplify the sales tax calculation.
