Where Indoor Smoking Is Banned
The Smoking in Public Places and Indoor Workplaces Act reaches any indoor space open to the public, any indoor workplace, and any vehicle used for public transportation. - Buses and taxis.
- Lobbies, hallways, and elevators in apartment buildings and condominiums.
- Elevators, hallways, and shared spaces in hotels and motels.
- Retail stores and restaurants.
- Hospitals, nursing homes, and clinics.
- Theaters and auditoriums.
- Classrooms, libraries, and instructional areas at schools, colleges, and universities.
- Meetings of public bodies and licensed child care facilities.
Commercial airport operators have separate authority to prohibit smoking anywhere on airport property open to the public, indoor or outdoor.
The 25-Foot Rule at Building Entrances
Outside doesn’t automatically mean legal. You cannot smoke tobacco or marijuana, or vape marijuana, within 25 feet of the entrance or exit of any building covered by the ban.2Justia. Medical Marijuana Is Covered the Same as Tobacco
An Oklahoma medical marijuana patient license does not create a smoking exception. Nicotine Vaping Sits in a Gap
This one trips up smokers and business owners alike. Oklahoma’s Clean Indoor Air Act has not been amended to treat nicotine vaping like tobacco smoking. E-cigarettes and nicotine vape devices are not banned by state law in the same indoor locations that prohibit lit tobacco. That silence is not a green light. Vaping is banned on state-owned or state-leased property, including government buildings, land, and vehicles. Municipalities, individual businesses, and property owners can and do prohibit vaping under their own rules. Restaurants, offices, and event venues around Oklahoma often ban vaping through policy even though state law does not force them to. Ask before you exhale.
Where Smoking Is Still Allowed
Stand-Alone Bars and Cigar Bars
Bars that earn at least 60% of revenue from alcoholic beverage sales and admit no one under 21 can allow indoor smoking. Cigar bars qualify under the same framework. Retail Tobacco Shops
Stores that primarily sell tobacco products may allow smoking on their premises if they restrict entry to adults. Hotel and Motel Smoking Rooms
Hotels can designate a portion of guest rooms for smoking, provided those rooms are physically separated from non-smoking rooms and properly ventilated. Common areas stay smoke-free no matter what.
Nursing Facility Smoking Rooms
Licensed nursing facilities can set aside smoking rooms for residents and their guests. The rooms must be fully enclosed, directly exhausted to the outside, and kept under negative air pressure so smoke does not leak when a door opens.1Justia. Private Homes
Your own home is generally outside the ban. The exception applies when the home operates as a licensed child care or licensed healthcare facility; during operating hours, the ban kicks in. Renters should read the lease. Landlords are free to prohibit smoking as a lease term, and many Oklahoma complexes do.
Outdoor Designated Areas
Workplaces, restaurants, and entertainment venues can create outdoor smoking areas. Those areas have to sit outside the 25-foot buffer and be positioned so smoke does not drift back into any smoke-free building.
Tribal Casinos Follow Their Own Rules
Oklahoma’s tribal gaming compacts contain no smoking restrictions, so tribal casinos are not bound by the state’s indoor smoking ban.5American Gaming Association. Some casinos allow smoking across the gaming floor, others split the floor into smoking and non-smoking sections, and some have gone fully smoke-free. Apartments and Public Housing
State law already keeps smoking out of apartment lobbies, hallways, and elevators. What happens inside your unit comes down to the lease. Oklahoma does not require landlords to adopt building-wide bans, and it does not stop them from doing so. No-smoking clauses are common.
Federal public housing is stricter. Since 2018, every public housing authority in the country must prohibit smoking inside living units, in indoor common areas, and in outdoor areas within 25 feet of housing buildings. The ban covers cigarettes, cigars, pipes, and hookahs. Tenants whose asthma or chronic bronchitis is aggravated by secondhand smoke drifting from a neighboring unit may have rights under the federal Fair Housing Act. Where the condition substantially limits breathing, a housing provider may be required to make reasonable accommodations, which could include a no-smoking policy or a unit transfer.
Penalties

Property owners and employers covered by the ban have to post conspicuous no-smoking signs at entrances and in prominent spots inside the building.8Justia. Age 21 for Tobacco and Vaping Sales
Oklahoma matches federal law on the sales age. Selling, giving, or otherwise furnishing any cigarette, cigar, chewing tobacco, nicotine product, or vaping product to anyone under 21 is a misdemeanor, punishable by a fine of $25 to $200 and 10 to 90 days in county jail.9Justia. A minor caught with tobacco who refuses to tell a police officer or school official where they got it can be charged with a misdemeanor: up to $5 in fines or up to five days in jail for anyone 16 or older, and juvenile court for younger minors.11Oklahoma Legislature.
