Oklahoma state income tax runs on a graduated scale from a low bracket up to 4.5 percent for tax year 2026, after HB 2764 trimmed every bracket.1Oklahoma Tax Commission. Summary of 2025 Tax Legislation You start with the federal adjusted gross income from your federal return, apply Oklahoma-specific additions and subtractions, and then run the result through the state brackets. Most full-year residents file Form 511 by April 15.
2026 Rates and Brackets
Oklahoma uses six brackets. The top rate of 4.5 percent applies once a single or married-filing-separate filer’s taxable income passes $7,200. For married couples filing jointly, heads of household, and qualifying surviving spouses, the 4.5 percent rate starts above $14,400.1Oklahoma Tax Commission. Summary of 2025 Tax Legislation Joint thresholds are exactly double the single thresholds, so filing status alone does not push a couple into the top rate sooner than two singles.
Because the brackets are narrow, the top rate ends up doing most of the work for anyone with a typical full-time income. A single filer with $50,000 of Oklahoma taxable income pays 4.5 percent on everything above $7,200, with only modest savings from the lower brackets underneath.
Who Has to File
Whether you owe a return depends on residency and gross income. Full-year residents must file once gross income reaches these levels:2Oklahoma Tax Commission. Oklahoma Resident Individual Income Tax Forms and Instructions
- Single or married filing separately: $7,350
- Married filing jointly: $14,700
- Head of household: $10,350
- Qualifying surviving spouse: $13,700
- Dependents (single or married): $6,350
Nonresidents and part-year residents follow a different rule. If you earned $1,000 or more from Oklahoma sources during the year, you file an Oklahoma return no matter what your total income was.3Oklahoma Tax Commission. Help Center – Individuals Income Tax
File even when you fall below these thresholds if Oklahoma income tax was withheld from your pay. That is the only way to get the withholding refunded.
How Your Taxable Income Is Built
Oklahoma does not ask you to recalculate income from scratch. You take the federal adjusted gross income from your federal return and then adjust it using state-specific items.4Justia. Oklahoma Code 68-2358 – Adjustments to Arrive at Oklahoma Taxable Income
The most common addition is interest from out-of-state municipal bonds. It is federally tax-free, but Oklahoma requires you to add it back, because the state exemption only covers bonds issued by Oklahoma or its local governments.5Oklahoma Tax Commission. Oklahoma Municipal Tax Exempt Bonds Interest from Oklahoma-issued municipal bonds stays tax-free at both levels.
What Oklahoma Lets You Subtract
Social Security
Any Social Security benefits that showed up in your federal adjusted gross income can be subtracted in full on your Oklahoma return.3Oklahoma Tax Commission. Help Center – Individuals Income Tax You claim it on Schedule 511-A for residents or Schedule 511NR-B for nonresidents and part-year residents. In practice, Oklahoma does not tax Social Security.
Other Retirement Income
For non-Social Security retirement income — private pensions, 401(k) distributions, government retirement plans — each person can exclude up to $10,000, and the exclusion cannot exceed what was actually in your federal adjusted gross income.3Oklahoma Tax Commission. Help Center – Individuals Income Tax On a joint return where both spouses receive retirement benefits, each spouse gets a separate $10,000 exclusion.
Military Retirement Pay
Military retirement pay is fully exempt from Oklahoma income tax. The 100 percent exclusion took effect for tax year 2022 under Senate Bill 401, with no income cap.6Oklahoma State Senate. Military Pensions Now Exempt from State Income Tax It is claimed separately from the general $10,000 retirement exclusion.
Oklahoma 529 Contributions
Contributions to an Oklahoma 529 college savings plan are deductible: up to $10,000 per year for single filers, up to $20,000 for joint filers.4Justia. Oklahoma Code 68-2358 – Adjustments to Arrive at Oklahoma Taxable Income Anything over the annual limit carries forward for the next five years. Contributions made between January 1 and the April filing deadline can be claimed on either the current or prior year’s return, but not both.
Standard Deduction and Credits
Oklahoma has its own standard deduction, well below the federal amount. If you took the standard deduction federally, you have to use the state version here:7Oklahoma Tax Commission. Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents
- Single or married filing separately: $6,350
- Married filing jointly or surviving spouse: $12,700
If you itemized federally, you can itemize on your Oklahoma return as well, though you are not required to. Some filers do better itemizing at the state level even after taking the federal standard deduction, especially those with sizable state and local taxes that got capped federally.
A few credits are worth checking:
Sales Tax Relief Credit. $40 per qualifying household member as a partial rebate of sales taxes paid during the year.8Legal Information Institute. Oklahoma Administrative Code 710-50-15-96 – Sales Tax Relief Credit You qualify if household gross income is $20,000 or less, or $50,000 or less when you are 65 or older, have a qualifying disability, or claim a dependent.9Oklahoma Tax Commission. Form 538-S Claim for Credit Refund of Sales Tax It is refundable.
Child Care and Child Tax Credit. The greater of 20 percent of your federal child care expense credit or 5 percent of your federal child tax credit. Your federal adjusted gross income must be $100,000 or less, and you attach a copy of your completed federal child care schedule.10Legal Information Institute. Oklahoma Administrative Code 710-50-15-71 – Credit for Child Care/Child Tax Part-year residents and nonresidents prorate based on Oklahoma AGI over federal AGI.
Earned Income Credit. Oklahoma has a refundable state EIC using the federal calculation rules in effect for tax year 2020. You use the EIC table in the Form 511-EIC worksheet rather than a flat percentage of the federal amount.11Oklahoma Tax Commission. Form 511-EIC Earned Income Credit Worksheet
Forms, Filing, and the Deadline
Full-year residents file Form 511. Part-year residents and nonresidents file Form 511NR, which includes schedules for allocating income between Oklahoma and other states.12Oklahoma Tax Commission. Oklahoma Individual Income Tax Forms and Instructions for Nonresidents and Part-Year Residents Both packets are on the Oklahoma Tax Commission site.13Oklahoma Tax Commission. Forms
You can file electronically through OkTAP, the Oklahoma Taxpayer Access Point at oktap.tax.ok.gov, or mail a paper return to the Oklahoma Tax Commission in Oklahoma City.14Oklahoma Tax Commission. File Taxes Electronic filing gives immediate confirmation; if you mail, use certified mail for proof of the filing date.
The deadline is April 15, matching the federal date. Oklahoma grants an automatic six-month extension to October 15, but only if you already have a federal extension from the IRS and owe no Oklahoma tax.15Oklahoma Tax Commission. Help Center Attach a copy of the federal extension when you file. If you do owe state tax, use Form 504-I to request the extension and submit payment. The extension moves the filing deadline, not the payment deadline, and interest starts running on any unpaid balance after April 15 either way.
Estimated Payments When Income Isn’t Withheld
If you have self-employment earnings, rental income, investment gains, or anything else without withholding, you may need to pay quarterly estimates. Oklahoma requires them when you reasonably expect your tax liability to exceed withholding by $500 or more, and your withholding will come in under either 70 percent of this year’s tax or 100 percent of last year’s.16Oklahoma Tax Commission. Pay Taxes
Farmers with at least two-thirds of gross income from farming are exempt from the estimated payment requirement. For everyone else, underpayment interest runs at 20 percent per year on each quarter’s shortfall. No underpayment interest applies when total tax liability for the year is under $1,000.16Oklahoma Tax Commission. Pay Taxes
What Late Filing or Underpayment Costs
Oklahoma has two penalties that can hit at once. Pay less than 90 percent of your tax by the original due date, and the unpaid amount is treated as delinquent with a 5 percent penalty added.16Oklahoma Tax Commission. Pay Taxes If you fail to file after the Tax Commission sends a written demand, the Commission can assess a separate 25 percent penalty on the deficiency.17Justia. Oklahoma Code 68-217 – Interest and Penalties on Delinquent Taxes
Interest accrues at 1.25 percent per month on any delinquent balance, from the original due date until the tax is paid.16Oklahoma Tax Commission. Pay Taxes That is 15 percent annually, and it compounds the cost of leaving a balance unresolved. Even an on-time return with a short payment owes interest on the gap. Payments go through OkTAP by electronic funds transfer or credit card, or by check in the mail.
