Oklahoma Veteran Tax Exemptions: Property, Sales, and Vehicle

Oklahoma gives a veteran with a 100 percent permanent service-connected disability rating four separate tax breaks: no property tax on the homestead, no sales tax on up to $25,000 in purchases per year, no excise tax on one vehicle every three years, and no state income tax on military retirement pay. Each benefit is authorized by a different statute, filed with a different office, and carries its own proof requirements. Property Tax on Your Home

Article 10, Section 8E of the Oklahoma Constitution exempts the entire assessed value of a qualifying veteran’s homestead from property tax. The disability must have resulted from military action, an accident during service, or a disease contracted while serving, and it must be certified by the U.S. Department of Veterans Affairs at the 100 percent permanent rate.150 Constitutions. You must own the home, live in it as your primary residence, and be eligible for the standard homestead exemption on it. The exemption passes to an unremarried surviving spouse who continues to occupy the home.2Oklahoma State Senate. Oklahoma Constitution Article X – Revenue and Taxation

File OTC Form 998, “Application for 100% Disabled Veterans Real Property Tax Exemption,” with the assessor in the county where the home is located. Attach a current VA letter certifying the 100 percent rating. The assessor may ask you or the VA for more information to confirm eligibility.3Oklahoma Tax Commission. March 15 is the deadline that matters. File by March 15 and the exemption applies to that tax year. File later and it takes effect the following year. Sales Tax Card

Under 68 O.S. Section 1357, a qualifying veteran pays no state or local sales tax on up to $25,000 in purchases each year. Purchases above the cap create a direct sales tax liability that the Oklahoma Tax Commission can collect, with penalties and interest.5Justia Law. Oklahoma Code 68-1357v4 – Exemptions

The exemption is not automatic. The Tax Commission issues a physical card, and you have to present it at checkout for the retailer to skip the tax. A VA letter alone will not do it, and neither will a verbal claim. To get the card, send the Business Tax Services Division at the Oklahoma Tax Commission in Oklahoma City a VA letter certifying your 100 percent rating along with proof that you have registered with the veterans registry kept by the Oklahoma Department of Veterans Affairs under 72 O.S. If you cannot always be at the store, your spouse or another household member can shop on your behalf. Request a separate card in that person’s name using OTC Form 13-55.7Oklahoma Tax Commission. Oklahoma Sales Tax Exemption Packet

Vehicle Excise Tax

Oklahoma waives the vehicle excise tax on one vehicle every three years for a qualifying veteran. You must be named as an owner on the title, and the vehicle must have been purchased on or after July 1, 2005. The three-year clock runs from the purchase date of the exempt vehicle, so a second excise-free purchase inside that window is not allowed.8Legal Information Institute. One exception. If the insurer declares your exempt vehicle a total loss, you can apply the exemption to a replacement before three years are up. Bring the insurer’s total loss documentation. At the tag agency, prove eligibility by showing either your Oklahoma Tax Commission sales tax exemption card or a VA letter certifying the 100 percent rating.8Legal Information Institute. Military Retirement Pay on Your State Return

Starting with tax year 2022, Oklahoma excludes 100 percent of military retirement pay from state income tax. The full exclusion applies to retirement benefits from any branch of the Armed Forces and is not tied to your disability rating.9New York Codes, Rules and Regulations. VA disability compensation is a separate benefit. Federal law excludes it from taxable income, which keeps it off your Oklahoma return as well. The same treatment applies to Dependency and Indemnity Compensation paid to surviving spouses and dependents. If VA disability payments and military retirement are your only income, your Oklahoma income tax is likely zero.

Surviving Spouses

An unremarried surviving spouse of a qualifying veteran can claim the property tax exemption on the homestead and the sales tax exemption, but the sales tax cap drops to $1,000 per year. For the sales tax card, the spouse submits a VA letter from the Muskogee, Oklahoma office certifying status as the unremarried spouse of a qualifying veteran. The surviving spouse of a service member who died in the line of duty submits a certified copy of DoD Form DD-1300 instead.6Legal Information Institute. Moving to a New Oklahoma Home

The property tax exemption does not follow you automatically. Sell your exempt home, buy another one in Oklahoma, and you have to file a fresh Form 998 with the assessor in the new county. Bring the original VA letter with the raised seal and your identification.

The Constitution builds in portability for mid-year moves. If you transfer your exempt homestead on or after January 1, the new home qualifies for the same exemption for the rest of that year and every year after, as long as you continue to meet the requirements.2Oklahoma State Senate.
