Online Divorce in Washington: Costs, Filing, and the 90-Day Wait

Yes, a Washington online divorce is legitimate, but only in a narrow sense: the websites that advertise it are document-preparation services, not law firms, and they work only when you and your spouse already agree on everything. The platform turns your answers into the official Washington Courts forms. You still print them, file them with the Superior Court, wait out the state’s 90-day cooling-off period, and get a judge to sign the final decree. No website finalizes a divorce for you.

What You’re Actually Paying For

An online divorce service sells you a completed packet of forms. You answer a questionnaire about your marriage, assets, debts, and children, and the software drops your answers into the standardized templates the court requires. The service never appears in court, never contacts your spouse’s attorney, and never gives legal advice.

A typical package runs $150 to $500, separate from the court’s filing fee. That is a fraction of what a contested case with a family law attorney costs, and the tradeoff is that you are responsible for whether the agreement is fair and complete. Miss a retirement account, undervalue a house, agree to a lopsided parenting schedule, and the service will not flag it.

A few things separate a legitimate platform from a bad one. Watch for sites that claim they can “finalize” your divorce without court involvement, services that lock your completed documents behind recurring subscriptions, and platforms using outdated forms. A legitimate service discloses that it is not a law firm, uses current-year forms from the Washington Courts system, and charges a single flat fee.

When Online Divorce Works in Washington

Two conditions have to be true before an online service makes sense.

First, residency. At least one spouse must be a Washington resident, or an active-duty servicemember stationed in the state, on the date the petition is filed.1Washington Courts. Family Law Handbook There is no minimum length of residency; being a resident on the filing date is enough. The other spouse can live anywhere.

Second, your case has to be uncontested. That means you and your spouse agree on every issue: who keeps the house, how debts are split, the parenting schedule, decision-making for the kids, whether anyone pays spousal maintenance, and so on. One unresolved disagreement makes the case contested, and a contested case needs a mediator or an attorney before the court will approve an agreed decree. The platform cannot negotiate for you.

Washington is also a community property state, which shapes what you are dividing. Property acquired during the marriage by either spouse is community property regardless of whose name is on it; anything owned before the marriage or received by gift or inheritance is generally separate.2Washington State Legislature. RCW 26.16.030 – Community Property Defined – Management and Control When a judge reviews your agreement, the standard is “just and equitable,” which weighs the nature of the property, the length of the marriage, and each spouse’s economic circumstances.3Washington State Legislature. RCW 26.09.080 – Disposition of Property and Liabilities An online platform records whatever split you agree to; it will not tell you whether the split is defensible.

One boundary worth naming: if either spouse is on active-duty military service, the Servicemembers Civil Relief Act lets the servicemember request a stay of at least 90 days if duties prevent them from participating.4Office of the Law Revision Counsel. 50 USC 3932 – Stay of Proceedings When Servicemember Has Notice Those protections do not run automatically, and online services are not set up to handle them. If deployment is in the picture, talk to a lawyer.

What the Platform Will Ask You For

The main document is the Petition for Dissolution of Marriage. Washington law requires it to state the date and place of the marriage, both spouses’ names and addresses, the date of separation, the names and ages of any children, and a statement that the marriage is irretrievably broken.5Washington State Legislature. RCW 26.09.020 – Petition – Dissolution of Marriage or Domestic Partnership The petitioner signs it under oath.

You will also need to compile every piece of your financial life: bank accounts, real estate, vehicles, retirement accounts, mortgages, car loans, credit cards. Each item has to be classified as community or separate and assigned to a spouse in your agreement. The platform’s questionnaire walks you through this, but the output is only as accurate as what you disclose. Forgotten accounts and joint cards surface months or years later, and they are expensive to clean up.

Children, Parenting Plans, and Child Support

If you have minor children, you need a parenting plan covering the residential schedule, decision-making for education and healthcare, and a process for resolving future disputes.6Washington State Legislature. RCW 26.09.187 – Parenting Plan – Criteria for Establishing Permanent Plan The plan has to encourage each parent to maintain a stable relationship with the child and account for any history of domestic violence or substance abuse.

You also need Child Support Worksheets. Washington calculates support from both parents’ combined monthly net income and the number of children, using a state economic table.7Washington State Legislature. RCW 26.19.020 – Child Support Economic Table The worksheets must follow the format from the Administrative Office of the Courts; judges reject modified or incomplete versions.8Washington Courts. Washington State Child Support Schedule Online services pull from these official templates, which is one area where they genuinely save work.

The One Thing Most Platforms Won’t Do: QDROs

If either spouse has a 401(k), pension, or similar employer-sponsored retirement plan, splitting that account requires a separate document called a Qualified Domestic Relations Order. Federal law generally bars retirement plans from paying anyone other than the participant; a QDRO is the exception that lets the plan administrator divide the account.9U.S. Department of Labor. QDROs – The Division of Retirement Benefits Through Qualified Domestic Relations Orders Without one, the plan will refuse to distribute funds to the non-participant spouse even if the decree awards half.

Most online divorce platforms do not prepare QDROs because every plan has its own formatting rules and plan administrators reject orders with the wrong language. A specialized attorney or QDRO preparation service typically runs a few hundred dollars. Skipping it during the divorce and coming back later means filing additional motions and possibly re-opening the case.

Filing, Fees, and the 90-Day Wait

You file the completed packet with the Superior Court Clerk in the county where you or your spouse lives. The statutory filing fee to initiate a civil action is $200,10Washington State Legislature. RCW 36.18.020 – Fees for Superior Court Clerk Services but county surcharges push the real cost to somewhere between $250 and $370. If you cannot afford it, you can request a waiver under General Rule 34 by filing a Motion and Declaration for Waiver of Civil Fees and Surcharges, which lets the court waive fees based on your income.11Washington Courts. GR 34 Motion and Declaration for Waiver of Civil Fees and Surcharges

Many counties accept electronic filing, though availability varies.12Washington Courts. Electronic Filing of Court Documents In an uncontested case, the responding spouse usually signs an Agreement to Join Petition confirming they agree to the filing, which eliminates the need for formal service of a summons.13Washington Courts. FL All Family 119 – Agreement to Join Petition (Joinder)

Then you wait. Washington imposes a mandatory 90-day cooling-off period that starts when the petition is filed and the other spouse is served or signs the joinder. No judge can sign final orders before those 90 days pass, and the Washington Supreme Court has invalidated a decree signed only eight days early.14Washington Supreme Court. In re Marriage of Buecking, No. 87680-1 The rule is in the statute.15Washington State Legislature. RCW 26.09.030 – Petition for Dissolution – Court Proceedings, Findings

After the 90 days, some counties let you submit final orders for the judge’s signature without appearing in person as long as the paperwork is complete and signed by both parties. Others require a short hearing where you confirm the agreement on the record. The judge signs the Findings and Conclusions and the Final Decree of Dissolution, and once the clerk files the signed decree, the marriage is officially over.16Washington Courts. Findings and Conclusions About a Marriage Order certified copies; you will need them to update banks, employers, and government agencies.

If you want to restore a former name, request it in the dissolution. Washington courts order name restoration on request as part of the decree, with no separate petition required.

Loose Ends to Handle After the Decree

Health insurance has the tightest deadline. If you are covered under your spouse’s employer-sponsored plan, divorce is a qualifying event that triggers your right to COBRA continuation coverage for up to 36 months at your own expense.17Office of the Law Revision Counsel. 29 USC 1163 – Qualifying Event You or a qualified beneficiary have to notify the plan within 60 days of the divorce.18U.S. Department of Labor. FAQs on COBRA Continuation Health Coverage for Workers Miss that window and the right is gone.

Taxes come next. Your filing status for the year of the divorce depends on your marital status on December 31. If the decree is final by that date, you file as single or head of household for the whole year.19Internal Revenue Service. Filing Status If the signature slips into January, you were still married for the prior tax year, so timing your filing around year-end can matter. Spousal maintenance paid under agreements executed after 2018 is not deductible by the payer and not taxable to the recipient,20Internal Revenue Service. Topic No. 452, Alimony and Separate Maintenance which changes how you negotiate the amount. Child support has always been tax-neutral.

Online divorce in Washington is legitimate when the case is simple and both spouses are genuinely aligned. When there are retirement accounts to divide, significant separate property, contested parenting questions, or an active-duty servicemember involved, the savings on form preparation can disappear fast behind the mistakes a questionnaire cannot catch.
