Onondaga County does not issue a general business license. Operating here legally means assembling the right approvals from the IRS, New York State, the county, and the city, town, or village where you set up shop. Which ones you actually need depends on your entity type, what you sell, whether you hire, and where you locate.
State Registrations Nearly Every Business Deals With
Before any county or municipal step, most new businesses handle a short list of state and federal basics.
Form Your Entity With the Department of State
If you’re setting up an LLC, corporation, or limited partnership, file formation documents with the New York Department of State. Articles of Organization for an LLC cost $200.1Department of State. Forming a Limited Liability Company in New York Sole proprietors and general partnerships skip this step but still need a business certificate from the county.
Most businesses also need an Employer Identification Number from the IRS, free and issued online. You’ll need one to hire employees, operate as a partnership or corporation, or pay excise taxes.2Internal Revenue Service. Get an Employer Identification Number
The LLC Publication Requirement
New York LLCs have a trap that often gets overlooked. Within 120 days of forming your LLC, you have to publish a copy of the articles of organization or a notice of formation once a week for six consecutive weeks in two newspapers designated by the county clerk, one daily and one weekly.3New York State Senate. New York Limited Liability Company Law Section 206 After the run finishes, you file a Certificate of Publication with the Department of State.
Miss the window and your LLC’s authority to conduct business in New York is suspended.4Department of State. Certificate of Publication for Domestic Limited Liability Company You can lift the suspension by filing late, but anything you do during the suspension carries legal risk. The New York State Education Department’s Office of the Professions handles more than 50 fields, including architecture, engineering, public accountancy, pharmacy, medicine, nursing, psychology, social work, veterinary medicine, and massage therapy.9New York State Education Department. County Permits Tied to Specific Activities
Onondaga County issues no general operating license, but a few activities require permits from county departments.
Food Service
Restaurants, caterers, mobile food vendors, and other food-handling operations need a food service permit from the Onondaga County Health Department. Annual restaurant fees scale with seating capacity:
- 25 seats or fewer: $217
- 26โ50 seats: $236
- 51โ100 seats: $273
- 101โ150 seats: $329
- More than 150 seats: $360
Caterers pay $310 per establishment and mobile vendors $192 per unit. Late renewal of an annual permit adds a $60 penalty.10Onondaga County. Fee Schedule – Environmental Health The Health Department inspects for compliance with the New York State Sanitary Code.
Weights and Measures
If you use scales, gasoline pumps, or other measuring devices for retail sales, the county’s Weights and Measures program conducts mandatory annual inspection and testing of those devices and investigates complaints about inaccurate measurement.11Onondaga County. Weights and Measures There is generally no direct fee for the inspection itself, but running uninspected or inaccurate devices can bring fines.
City, Town, and Village Requirements
Your most immediate layer of regulation usually comes from the municipality where you physically operate. Confirm requirements with the local clerk or planning office before you sign a lease or start renovations.
City of Syracuse Certificate of Use
In Syracuse, bars, restaurants, drugstores, and food stores under 20,000 square feet must obtain a Certificate of Use from the Central Permit Office. The non-refundable application fee is $500, the certificate renews every two years, and the renewal application is due at least 60 days before expiration.12City of Syracuse. Certificate of Use License The process includes criminal background checks on the proprietor and property owner, a review of any outstanding debts to the city, and inspections by code enforcement, fire prevention, and zoning. Operating without the certificate, or letting it lapse, can lead to closure and civil or criminal penalties.
Towns and Villages
Outside Syracuse, towns generally regulate business through zoning and building codes rather than a business-specific license. You’ll usually need a Certificate of Occupancy or similar commercial permit from the local code enforcement or planning department before you open. In the Town of Clay, for example, the starting point is a Zoning Information Property Worksheet, which costs $75 for commercial parcels and confirms whether your intended use is allowed in that zone.13Town of Clay. Misc Zoning / Planning Information Manlius, DeWitt, Cicero, and other towns each run their own zoning review. Call the planning office before you commit to a location.
Home-Based Businesses
You can run a business from your home in Onondaga County, but New York’s Residential Code sets real limits. A home occupation cannot exceed 15 percent of the home’s floor area, you can employ no more than one non-resident, hazardous operations are prohibited, and inventory and supplies cannot occupy more than half the space allotted to the business. Towns and villages may add tighter rules on signage, customer traffic, and permitted business types. Check with your local zoning office first; a neighbor’s complaint about traffic or noise can shut down a non-compliant home business quickly.
If You’ll Hire Employees
Hiring triggers a separate set of registrations, and the penalties for skipping them are steep.
Virtually all New York employers must carry workers’ compensation insurance, through a private carrier, the State Insurance Fund, or self-insurance if they qualify.14New York State Workers’ Compensation Board. Workers’ Compensation Coverage Requirements Operating without coverage carries an assessment of $1,000 for every ten-day period uninsured, and the assessments become liens against business assets.15New York State Senate. Private employers must also provide disability benefits and Paid Family Leave coverage.16New York State Workers’ Compensation Board. Disability Benefits Coverage Requirements Paid Family Leave is funded through employee payroll deductions, so the burden on you is administrative, but securing the policy is still your responsibility.17New York State. You become liable for unemployment insurance on the first day of the calendar quarter in which you pay $300 or more in wages, and you must register with the New York Department of Labor at that point.18New York State Department of Labor. A Workable Order of Operations
For most new businesses in Onondaga County, the sequence runs like this: form your entity with the Department of State if applicable, get your EIN, file your business certificate with the county clerk, apply for your Certificate of Authority if you’ll collect sales tax, secure any professional licenses your field requires, and work through zoning and permitting with your municipality. If you’re forming an LLC, calendar the 120-day publication deadline the moment your articles are filed. If you’re hiring, add workers’ compensation, disability, Paid Family Leave, and unemployment insurance to the list before your first employee’s start date.
