Oregon data center tax breaks come in three stacking property tax programs plus a built-in sales tax advantage. A standard enterprise zone exemption wipes out property tax on new equipment and improvements for three to five years. A long-term rural enterprise zone extends that to seven or fifteen years. The Strategic Investment Program caps the taxable value of very large projects for fifteen years. And because Oregon has no general sales or use tax, every server, cooling unit, and generator avoids the sales tax that the same purchase would trigger in most other states.
No State Sales Tax on Equipment
Oregon is one of a handful of states with no general sales or use tax. For a data center spending tens of millions on servers, networking hardware, and cooling infrastructure, the savings land on every purchase automatically. There is no application, no approval, and no annual filing tied to this benefit.
Standard Enterprise Zone Exemption (Three to Five Years)
Local governments across Oregon designate enterprise zones to attract industrial investment. A data center located inside a zone, and properly authorized before work begins, pays zero local property tax on qualifying new property for three consecutive years. Qualifying property includes machinery, equipment, and site improvements. For additions or modifications to an existing structure, the exemption covers only the increase in assessed value attributable to the new work.1Oregon Public Law. Oregon Code 285C.175 – Enterprise Zone Exemption Requirements Duration
The exemption stretches to five years if the business and the local zone sponsor sign a written agreement before authorization. The extended deal requires compensating all new employees at an average of at least 150 percent of the county’s average annual wage during each year of the exemption. In qualified rural counties, that threshold drops to 130 percent. The zone sponsor can attach other conditions on top.2Oregon State Legislature. Oregon Revised Statutes Chapter 285C – Section 285C.160 During the two extra years, the business also owes a school support fee to help offset lost revenue to local districts.
Even the base three-year exemption carries conditions. The data center must increase its workforce in the zone by the greater of one new full-time job or 10 percent above its prior staffing level, and maintain that increase throughout the exemption.3Oregon Department of Revenue. Form OR-EZ-AUTH – Oregon Enterprise Zone Authorization Application It must also enter a first-source hiring agreement, which gives local job-training programs first access to open positions.1Oregon Public Law. Oregon Code 285C.175 – Enterprise Zone Exemption Requirements Duration
Long-Term Rural Enterprise Zone (Seven to Fifteen Years)
A rural enterprise zone unlocks a far longer exemption. Under ORS 285C.403 through 285C.420, the property tax exemption runs between seven and fifteen consecutive years, with the exact length set by written agreement between the zone sponsor and the business.4Oregon State Legislature. Oregon Revised Statutes Chapter 285C – Section 285C.403 This is the longest single-facility property tax exemption Oregon offers.
The requirements tighten accordingly. All new employees must be compensated at an average of at least 150 percent of the county’s average annual wage for each year the exemption is active. The company has to maintain the minimum staffing levels set in the agreement and pay a school support fee. Fulfillment centers are explicitly excluded, but data processing facilities are eligible.4Oregon State Legislature. Oregon Revised Statutes Chapter 285C – Section 285C.403
Strategic Investment Program (Fifteen-Year Cap)
The Strategic Investment Program is built for the largest projects. Rather than fully exempting property, SIP caps the taxable value of the project for fifteen years. Everything above the cap is exempt, and property tax is paid only on the capped portion.5Oregon State Legislature. Oregon Code 307.123 – Property of Strategic Investment Program Eligible Projects Rules For a billion-dollar campus, the savings are substantial.
The cap depends on location and project size:
- Urban projects: taxable portion is $100 million, adjusted annually for inflation since 2024 using the Consumer Price Index for the West Region.5Oregon State Legislature. Oregon Code 307.123 – Property of Strategic Investment Program Eligible Projects Rules
- Rural projects up to $500 million: taxable portion is $40 million.
- Rural projects between $500 million and $1 billion: taxable portion is $75 million.
- Rural projects over $1 billion: taxable portion is $150 million.
A “rural area” here means entirely outside the urban growth boundary of any city with a population of 40,000 or more.6Oregon Public Law. Oregon Code 285C.600 – Definitions for ORS 285C.600 to 285C.635
Community Service Fee
SIP participants pay a community service fee each year equal to 25 percent of that year’s property tax savings. The fee is capped at a base of $3 million per year, adjusted for inflation. For the 2026–2027 property tax year, the cap is $3.167 million.7Business Oregon. Strategic Investment Program The county collects the fee and distributes it to local taxing districts under terms negotiated in the project agreement.8Oregon Public Law. How to Apply and Keep the Exemption
Timing controls everything. The authorization application must reach the local zone manager before the business breaks ground, begins construction, installs equipment, or hires the employees it plans to count toward the employment requirement.9Oregon Public Law. Oregon Code 285C.140 – Application for Authorization Contents Filing Fee Starting work before authorization is the single most common way companies lose eligibility. Late filing is allowed only if the Department of Revenue grants a waiver or an administrative rule specifically permits it.
Form OR-EZ-AUTH asks for a description of current and proposed operations in the zone, a description and estimated value of every piece of qualifying property planned, average employee count over the previous twelve months with estimated new hires, and written commitments to meet qualification requirements, first-source hiring, and any extra conditions the zone sponsor has set.9Oregon Public Law. Oregon Code 285C.140 – Application for Authorization Contents Filing Fee
If no exemption claim is filed within two calendar years of authorization, the business must renew the authorization by April 1 to keep it alive.3Oregon Department of Revenue. Form OR-EZ-AUTH – Oregon Enterprise Zone Authorization Application Once the qualifying property is in place, an annual exemption claim goes to the county assessor by April 1, with the same deadline every year of the exemption.10Oregon Business Development Department. Oregon Tax Incentives Standard Enterprise Zone Annual Processes The assessor verifies that equipment is still in use, employment levels have held, and wage and hiring commitments remain satisfied.
Clawbacks and the 20 Percent Penalty
Oregon does not quietly phase out benefits when a company falls short. If a disqualifying event occurs, the business must notify the county assessor and the zone sponsor in writing by July 1 following the assessment year in which the exemption was claimed.11Oregon Public Law. Oregon Code 285C.240 – Disqualification Notice and Procedures In Lieu Payments and Additional Taxes Penalty Use of Moneys Disqualifying events include selling or moving exempt property out of the zone, a substantial curtailment of operations, failure to maintain employment or wage levels, and using exempt property for ineligible activities.
After disqualification, the assessor calculates the full property tax that would have been owed for every exempt year and adds it to the current tax roll. If the business failed to self-report on time, the assessor adds a penalty of 20 percent of the total clawback amount.11Oregon Public Law. Oregon Code 285C.240 – Disqualification Notice and Procedures In Lieu Payments and Additional Taxes Penalty Use of Moneys For a large facility, that penalty alone can run into the millions. Self-reporting immediately is cheaper than being caught.
Under the long-term rural program, the clawback runs the full taxes that would have been due for each exempt year, capped at ten years of back taxes even if the exemption ran longer.12Oregon State Legislature. Oregon Revised Statutes Chapter 285C – Section 285C.420
Electricity Costs Under HB 3546
Tax breaks are not the only line on the ledger. In 2025, the Oregon legislature passed HB 3546, directing the Oregon Public Utility Commission to create a separate service classification for large energy use facilities.13Oregon State Legislature. HB3546 2025 Regular Session Any tariff for this class must allocate the cost of serving these large users to the facilities themselves and shield residential and small-business ratepayers from absorbing the infrastructure costs. Large energy users must sign contracts of at least ten years committing to pay for the energy and transmission capacity they consume.
The law covers data centers and other heavy users served by Oregon’s investor-owned utilities, including Portland General Electric, Pacific Power, and Idaho Power. It took effect immediately as an emergency measure and sunsets on January 2, 2035.13Oregon State Legislature. HB3546 2025 Regular Session This is not a tax, but it changes the economics: data centers can no longer spread transmission infrastructure costs across the broader ratepayer base, and the ten-year minimum commitment should be weighed alongside the exemption timelines when choosing a program.
