To file for divorce in Oregon, you submit a Petition for Dissolution of Marriage to the circuit court in the county where you or your spouse lives, pay a $301 filing fee, and arrange for your spouse to be formally served. Oregon is a no-fault state, so the only ground you need to state is irreconcilable differences. From the date of service, a 90-day waiting period runs before a judge can finalize anything. The forms, the terminology, and the judgment all use the phrase “dissolution of marriage” rather than “divorce,” but it is the same process.
Who Can File in Oregon
Where you were married decides how long you must have lived here. If the marriage took place in Oregon, either spouse only needs to be living in the state at the time of filing, with no minimum length of residency. If you married anywhere else, at least one spouse must have lived in Oregon continuously for at least six months before filing.1Oregon State Legislature. Oregon Code 107.075 – Residence Requirements
Oregon does not accept fault-based grounds. You do not need to prove adultery, abandonment, or anything else. The petition simply states that irreconcilable differences have broken down the marriage permanently.2Oregon Public Law. Oregon Code ORS 107.025 – Irreconcilable Differences as Grounds for Dissolution or Separation Your spouse does not have to agree. One spouse can file and the court can grant the dissolution even over the other’s objection.
Filing the Petition
The case opens when you file a Petition for Dissolution of Marriage along with a Summons at the circuit court clerk’s office in the county where either spouse lives.3Oregon Judicial Department. Instructions – Dissolution With No Minor Children The petition asks for the basics: full legal names, the date and place of marriage, whether there are minor children, and what you are asking the court to decide about property, support, and custody. Before you start filling it out, pull together an inventory of everything you own and owe: real estate, bank accounts, retirement plans, vehicles, credit cards, loans, and current values and account numbers for each.
The filing fee is $301 statewide.4Oregon Judicial Department. You will also file a Confidential Information Form (CIF) at the same time as the petition. The CIF holds Social Security numbers, dates of birth, driver license numbers, and employer details so this information stays out of the public file.6Oregon Department of Justice. Serving Your Spouse and the 90-Day Wait
Once the petition is filed, your spouse has to be formally served with copies of the petition and summons. Under Oregon’s Rules of Civil Procedure, service can be done by personal delivery through any competent adult who is not a party to the case, by mail, or by another method the court approves. You cannot hand the papers to your spouse yourself. If you cannot locate your spouse, you can ask the court for permission to serve by publication or another alternative method.
After service, your spouse has 30 days to file a written response.8Oregon Judicial Department. Instructions – Responding to a Petition for Dissolution (Divorce) If no response comes in by then, you can ask the court for a default judgment.
Oregon also requires a 90-day waiting period from the date your spouse is served. No trial or final hearing can take place before those 90 days pass. A judge can shorten the wait in an emergency, and a signed stipulated agreement between both spouses can waive it.
Dividing Property and Debts
Oregon follows equitable distribution. That means the court divides property in a way that is fair under the circumstances rather than cutting everything exactly in half. The law starts with a rebuttable presumption that both spouses contributed equally to property acquired during the marriage, regardless of whose name is on the title. Homemaking counts as a contribution on equal footing with earning income.9Oregon State Legislature. Oregon Code 107.105 – Provisions of Judgment
Property you brought into the marriage, or received as a personal gift or inheritance, is generally separate and stays with the original owner. If separate property got mixed with marital funds or grew substantially in value during the marriage, the treatment gets more complicated, and a judge may still factor the value in when dividing everything else.
Debts work on the same logic. Obligations taken on during the marriage are presumed shared, and the court assigns them based on each spouse’s earning capacity and financial situation. One warning: being assigned a debt in the divorce judgment does not release the other spouse from liability to the creditor. If your name is still on a joint account, the lender can come after you if your ex stops paying.
Keeping the Family Home
If one spouse keeps the house, the Garn-St. Germain Act bars the lender from calling the loan due when property transfers to a spouse or former spouse through divorce.10Office of the Law Revision Counsel. 12 US Code 1701j-3 – Preemption of Due-on-Sale Prohibitions The mortgage stays in place. The transfer does not, however, remove the original borrower from the loan. Both spouses remain legally on the hook until the spouse keeping the home refinances into their own name alone.
Splitting Retirement Accounts
Pensions and 401(k) plans are property that can be divided.9Oregon State Legislature. Oregon Code 107.105 – Provisions of Judgment Splitting a private employer plan requires a Qualified Domestic Relations Order (QDRO), a separate court order directed at the plan administrator that specifies how the benefits will be divided.11U.S. Department of Labor. QDROs Chapter 1 – Qualified Domestic Relations Orders: An Overview The QDRO must name each plan, identify both parties with addresses, and set out the dollar amount, percentage, or formula for the split.
A QDRO is the only way around the federal rule that normally bars assigning retirement benefits to anyone other than the participant.11U.S. Department of Labor. QDROs Chapter 1 – Qualified Domestic Relations Orders: An Overview A signed settlement agreement is not enough; the plan administrator needs a formally issued court order. Get the QDRO drafted and approved by the plan before the divorce is finalized.
Spousal Support
Oregon recognizes three types of spousal support, and a judge must identify which type any award belongs to.9Oregon State Legislature. Oregon Code 107.105 – Provisions of Judgment
- Transitional support helps a spouse get the education or training needed to re-enter the workforce or advance a career. The court weighs the length of the marriage, current job skills, work experience, and each party’s financial needs.
- Compensatory support goes to a spouse who made a significant financial or personal contribution to the other’s education, training, or earning capacity. The classic example is working to put a spouse through professional school.
- Spousal maintenance is an ongoing contribution to the other spouse’s living expenses, aimed at maintaining a standard of living reasonably comparable to the marriage. Courts generally reserve it for longer marriages with a sizable income gap.
Support ends automatically when either party dies, unless the judgment says otherwise. Orders can be modified later for a substantial change in economic circumstances, though compensatory support is the hardest category to change.
Taxes have shifted. For divorces finalized after 2018, spousal support is not deductible for the payer and not taxable to the recipient.12Internal Revenue Service. Alimony and Separate Maintenance A $2,000 monthly payment costs the payer the full $2,000. Factor that in when negotiating an amount.
Bankruptcy will not erase support. Federal law classifies domestic support obligations as non-dischargeable, and past-due payments survive bankruptcy as well.13Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge Only the family court that issued a support order can modify it.
Children: Custody, Parenting Plan, and Support
If you have minor children, custody is usually the most consequential part of the case. Oregon decides custody based on the best interests of the child, looking at specific factors:14Oregon State Legislature. Oregon Code 107.137 – Factors Considered in Determining Custody of Child
- The strength of the child’s emotional ties with each parent and other family members.
- Each parent’s interest in and attitude toward the child.
- The value of keeping the child’s current living situation stable.
- Whether one parent has abused the other. If abuse is found, there is a rebuttable presumption against awarding custody to the abusive parent.
- A preference for the parent who has been the primary caregiver, if that parent is fit.
- Each parent’s willingness to support the child’s relationship with the other parent.
Gender alone cannot tip the scales, and a parent’s ADA-recognized disability cannot be used against them unless specific behaviors tied to it endanger the child.
Every custody case must include a parenting plan filed with the court. It can be general, giving a basic framework for time and responsibilities, or detailed, specifying residential schedules, holidays, transportation, decision-making authority, and dispute resolution.15Oregon Public Law. Oregon Code ORS 107.102 – Parenting Plan; Content Even a general plan must state a minimum amount of parenting time for the noncustodial parent.
If parents cannot agree on custody or parenting time, Oregon law requires every judicial district to offer a mediation orientation session, and most courts require attendance before a judge will hold a contested hearing. In domestic violence cases, screening protocols apply and either party can opt out at any time.16Oregon Public Law. Oregon Code ORS 107.755 – Court-Ordered Mediation; Rules
Child support uses an income-shares model. Both parents’ combined income sets the total obligation, and each parent’s share is proportional to what they earn. The formula also considers income from all sources, each parent’s financial needs, existing support orders for other children, and the child’s educational, physical, and emotional needs.17Oregon Public Law. Oregon Code ORS 25.275 – Formula for Determining Child Support Awards Support can be ordered for minor children and for children over 18 still attending school. Like spousal support, child support is non-dischargeable in bankruptcy.13Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge
Health Insurance, Social Security, and Taxes
If you are covered under your spouse’s employer-sponsored plan, that coverage ends when the divorce is finalized. Federal COBRA rules let you continue the coverage for up to 36 months, but you or your former spouse must notify the plan administrator within 60 days of the divorce.18U.S. Department of Labor. FAQs on COBRA Continuation Health Coverage for Workers COBRA is expensive: you pay the full premium, including the share the employer used to cover, plus a 2% administrative fee. It applies to private employers with 20 or more employees and to state and local government plans. Miss the 60-day window and the right disappears.
If your marriage lasted at least 10 years, you may be able to collect Social Security retirement benefits on your former spouse’s earnings record once you are 62, currently unmarried, and your own benefit would be smaller than what you would get on their record.19Social Security Administration. Can Someone Get Social Security Benefits on Their Former Spouses Record Claiming on an ex’s record does not reduce what your ex or their current spouse receives.
Your marital status on December 31 sets your filing status for the whole tax year. Finalize the divorce by then and you file as single or, if you qualify, head of household. Still pending on December 31 means you file as married filing jointly or separately.20Internal Revenue Service. About Publication 504, Divorced or Separated Individuals Property transfers between spouses in a divorce are generally not taxable at the time of transfer, but the receiving spouse takes the original cost basis, which can mean a larger capital gains bill when the asset is later sold.
Finalizing the Divorce
Once the 90-day wait has run and the parties have either agreed on terms or had the contested issues decided, you submit a General Judgment of Dissolution of Marriage. This document sets out every term: property division, debt allocation, spousal support, custody, parenting time, and child support. In an uncontested case, both spouses typically sign. A judge reviews the paperwork and, if everything checks out, signs it. That signature ends the marriage.
Processing times after submission vary by county, from a couple of weeks to considerably longer in busier courts. If you have children, the judgment must incorporate the parenting plan and child support order. Once the judge signs, request certified copies of the judgment, because you will need them to update financial accounts, insurance, and identification.
