Oregon PFML: Eligibility, Benefits, and How to Apply

Paid Leave Oregon is a state insurance program that pays part or all of your wages when you take time off for a serious health condition, a new child, caregiving for a family member, or recovery from domestic violence or sexual assault. Most workers qualify if they earned at least $1,000 in Oregon during the year before applying, and weekly benefits currently top out at $1,636.56.1Oregon Employment Department. Who Qualifies

Eligibility depends on your earnings, not on how long you’ve worked for a particular employer. You need at least $1,000 in wages earned in Oregon during your base year or alternate base year before applying.3Paid Leave Oregon. Employees Overview The base year is the first four of the last five completed calendar quarters before your benefit year begins. If your earnings in that window fall short, the alternate base year looks at the last four completed calendar quarters instead.4Oregon Public Law. ORS 657B.010 Definitions

Employer size does not change your right to benefits. Every covered worker who meets the $1,000 threshold qualifies regardless of how many people the employer has on payroll.5Paid Leave Oregon. Common Questions

Self-employed workers and independent contractors are not automatically covered, but they can opt in. Your work must be based in Oregon, you must have earned at least $1,000 in net self-employment income in the previous tax year, and once you enroll you commit to paying contributions for a minimum of three years.6Paid Leave Oregon. Reasons You Can Take Leave

The program covers three categories of leave.2Oregon State Legislature. Oregon Revised Statute Chapter 657B

  • Family leave to bond with a child during the first year after birth, adoption, or foster placement, or to care for a family member with a serious health condition.
  • Medical leave for your own serious health condition, such as an illness or injury that requires hospitalization or ongoing treatment.
  • Safe leave to deal with the aftermath of domestic violence, harassment, sexual assault, or stalking, including seeking legal protection, relocating, or getting medical care.

The definition of family member is broader than most people assume. It covers your spouse or domestic partner, your children (biological, adopted, foster, or stepchildren), your parents, and the spouses or domestic partners of your children and parents. It also reaches people who stood in a parental role to you or to whom you stood in a parental role.4Oregon Public Law. ORS 657B.010 Definitions

How Much Time You Get

You can take up to 12 weeks of paid leave in a 52-week benefit year. Complications related to pregnancy or childbirth add up to two more weeks, for a maximum of 14.7Paid Leave Oregon. Home

Leave does not have to be taken in one block. You can use a full week or a single day at a time, which matters when a health condition requires recurring appointments rather than one long absence.3Paid Leave Oregon. What You’ll Be Paid

Your weekly check depends on how your average weekly wage compares to the statewide average. If you earn 65% or less of the state average, you get 100% of your normal wages. Lower-wage workers generally keep their full paycheck.8Oregon Public Law. ORS 657B.050 Amount of Benefits

If you earn more, the formula has two parts. You receive 65% of the state average weekly wage, plus 50% of the portion of your earnings that exceeds that threshold. The combined amount is capped at 120% of the state average and is adjusted every year.8Oregon Public Law. ORS 657B.050 Amount of Benefits

For benefit years beginning on or after July 6, 2025, the maximum weekly benefit is $1,636.56 and the minimum is $68.19. These numbers update annually.1Oregon Employment Department. Minimum and Maximum Weekly Benefit Amounts to Increase for New Unemployment Insurance and Paid Leave Oregon Claims

Telling Your Employer

Before you apply to the state, you have to notify your employer. For planned leave, give at least 30 days’ notice. For unexpected situations, notify them verbally within 24 hours and follow up with written notice within three days.9Paid Leave Oregon. Applying for Medical Leave

Skipping the written notice has a real cost. If you don’t provide it, your first weekly benefit payment can be reduced by 25%.9Paid Leave Oregon. Applying for Medical Leave Even in a medical emergency, send something in writing.

How to Apply

Applications go through Frances Online, the Oregon Employment Department’s claims portal.10State of Oregon. Frances Online Instructions for All Claimants You’ll create an account using your Social Security Number or Individual Taxpayer Identification Number, your legal name, and your contact information. You’ll also need your employer’s business name and a contact who can verify your employment.

Timing matters. You can submit as early as 30 days before your leave starts and as late as 30 days after it begins. Filing outside that window can delay or jeopardize your claim.11Paid Leave Oregon. Applying for Family Leave

Documentation by Leave Type

What verifies your claim depends on the leave type. Medical leave requires a Verification of Serious Health Condition Form or equivalent certification from your healthcare provider. Family leave to care for a sick relative uses the same type of medical form for the family member’s condition. Bonding leave requires documentation of the birth, adoption, or foster placement. Safe leave generally requires documents such as police reports, court records, or a statement from a victim services provider.

You only need one qualifying document per claim. After you submit through Frances Online, you’ll get a confirmation number and a notice of receipt. Paper applications are available from the Oregon Employment Department if you don’t have internet access.10State of Oregon. Frances Online Instructions for All Claimants

Getting Your Job Back

Benefits and job protection are two separate things, and the rules differ. Anyone meeting the $1,000 earnings test can receive payments. Job protection only kicks in if you’ve worked for your employer for at least 90 days before your leave starts.12Oregon Public Law. ORS 657B.060 Job Protection

If you clear the 90-day threshold, your employer must put you back in the same position you held when leave began, as long as the job still exists. If it was eliminated while you were out, you’re entitled to an equivalent role at the same pay and benefits. When no equivalent position exists at your original worksite, the employer must offer you an equivalent opening within 50 miles.12Oregon Public Law. ORS 657B.060 Job Protection

Workers with fewer than 90 days on the job can still get paid leave benefits. They just don’t have a legal right to their specific job back.

How It Works with Federal FMLA

The federal Family and Medical Leave Act provides up to 12 weeks of unpaid, job-protected leave. It only applies if you’ve worked for your employer at least 12 months, logged 1,250 hours in those 12 months, and work at a location where the employer has 50 or more employees within 75 miles.13U.S. Department of Labor. Fact Sheet 28 The Family and Medical Leave Act Many Oregon workers who qualify for state paid leave don’t clear those federal thresholds.

When you qualify for both, they typically run at the same time. Paid Leave Oregon provides the paycheck; FMLA adds a layer of federal job protection. Your employer cannot force you to use separate employer-provided paid time off during the portion of FMLA leave that overlaps with state paid leave. If your state benefits run out before you’ve used all 12 weeks of FMLA, federal protection continues for the remainder even though the checks stop.13U.S. Department of Labor. Fact Sheet 28 The Family and Medical Leave Act

If Your Employer Has an Equivalent Plan

Some Oregon employers offer an approved private plan instead of using the state program. Equivalent plans must provide benefits that are the same or better, cover all employees, and charge workers no more than the state contribution rate.14Paid Leave Oregon. Equivalent Plans

If your employer has one, you file your leave claim through the employer’s plan rather than Frances Online. Benefits should be at least as generous, but the process and paperwork may differ. Ask HR if you’re not sure which system covers you.

A Note on Taxes

The Oregon Employment Department issues a Form 1099-G for family leave and safe leave benefits, and a Form 1099-MISC for medical leave benefits. The Oregon Department of Revenue treats the taxability of your benefits as a federal question and recommends consulting a tax professional about how to report them.15Oregon Department of Revenue. If Your Claim Is Denied

You have 60 calendar days from the date of a denial to file an appeal. You can do this through Frances Online or by mailing a Request a Hearing Form to the Paid Leave hearings unit in Salem.16Paid Leave Oregon. Appeals

Paid Leave Oregon staff review the appeal first to see if they can resolve it. If not, it goes to the Office of Administrative Hearings, which schedules a telephone hearing with an administrative law judge. You can submit additional documents at any point before the hearing. If something outside your control kept you from meeting the 60-day deadline, the office will consider a late appeal, but a judge decides whether the reason qualifies.16Paid Leave Oregon. Appeals
