You don’t have to take the leave in one block. Safe leave can be used intermittently, in increments as small as a single workday, so you can alternate between work and leave as court dates, appointments, and moving tasks come up.4Oregon State Legislature. Oregon Code 657B.090 – Claim for Benefits
Who Qualifies as a Worker
Most W-2 employees in Oregon qualify automatically. If you’ve contributed to the Paid Family and Medical Leave Insurance Fund during your base year or alternate base year, you’re eligible, and because contributions are withheld from paychecks, most workers with recent earnings meet this.5Oregon State Legislature. Oregon Code 657B.015 – Benefit Eligibility Full-time, part-time, and seasonal workers are all covered.
Self-employed workers and employees of tribal governments have an extra threshold: at least $1,000 in earnings during the base year or alternate base year. Self-employed workers also have to elect coverage; they aren’t enrolled automatically.5Oregon State Legislature. Oregon Code 657B.015 – Benefit Eligibility
How Much Safe Leave Pays and for How Long
Your weekly benefit is tied to how your average weekly wage compares to the statewide average. If you earn at or below 65% of the state average weekly wage, you receive 100% of your own average weekly wage. If you earn more, your benefit is 65% of the state average plus 50% of the amount your wages exceed that threshold.6Oregon State Legislature. Oregon Revised Statutes Chapter 657B – Family and Medical Leave Insurance Lower-wage workers replace nearly all their income; higher earners replace a smaller share.
The weekly benefit is capped at 120% of the state average weekly wage with a floor of 5% of that same figure. The Employment Department updates the dollar amounts each July.7Paid Leave Oregon. Common Questions – Paid Leave Oregon
You can take up to 12 weeks of safe leave within a 52-week benefit year, which starts on the Sunday before your leave begins.1Paid Leave Oregon. Paid Leave Oregon Home Those 12 weeks are shared across all Paid Leave Oregon categories. If you’ve already used 4 weeks of family leave, you have 8 weeks of safe leave left in the same year.
Giving Your Employer Notice
When you can plan ahead, give your employer at least 30 days’ notice before leave starts.2Paid Leave Oregon. Employees and Paid Leave Oregon Situations involving domestic violence or stalking rarely allow that kind of planning, and Oregon builds in a shorter track for unexpected leave.
If leave is unexpected, tell your employer within 24 hours of starting leave. That initial notice can be verbal. You then have three days from the start of leave to follow up with written notice. Miss the written notice deadline and the Employment Department can reduce your first weekly benefit by 25%.2Paid Leave Oregon. Employees and Paid Leave Oregon A text or email to your supervisor counts as written notice, so don’t let the deadline slip.
Documents You’ll Need
Each safe leave claim needs at least one document confirming that you, your child, or your dependent adult is a survivor. Any of the following works:3Paid Leave Oregon. Applying for Safe Leave
- The Safe Leave Verification Form, available on the Paid Leave Oregon website and through Frances Online.
- A copy of a police report.
- A copy of a protective order, restraining order, or similar court-issued protection.
- A Title IX complaint filed with a school’s Title IX coordinator.
- A statement from an attorney, health care provider, mental health professional, law enforcement officer, Department of Justice victim services employee, religious community representative, or victim services provider.
If none of these are workable because services aren’t available in your area or gathering them would put your safety at risk, you can self-attest. Self-attestation is a brief written statement from you explaining why you need the leave. You don’t have to describe traumatic details.3Paid Leave Oregon. Applying for Safe Leave

Job Protection and Retaliation
Your job is protected while you’re on safe leave if you’ve worked for the same employer for at least 90 consecutive days. When you return, your employer generally has to put you back in the same position you held before you left.9Oregon Bureau of Labor and Industries. Paid Leave Oregon Protections – For Workers
If your old position no longer exists, the rules split by employer size. Employers with 25 or more employees must offer you an equivalent position within 50 miles of your former worksite at the same pay and benefits. Smaller employers must still try to restore your original role; if it’s gone, they can offer a job with similar duties and the same pay and benefits.9Oregon Bureau of Labor and Industries. Retaliation for using or even asking about safe leave is illegal, and this protection applies even if your claim is denied. If an employer fires you, demotes you, cuts hours, or takes other adverse action because you applied, you can file a complaint with the Oregon Bureau of Labor and Industries (BOLI).9Oregon Bureau of Labor and Industries. How Safe Leave Interacts With FMLA and PTO
If your situation qualifies for both Paid Leave Oregon and the federal Family and Medical Leave Act, the two run concurrently rather than stacking. FMLA has no separate safe leave category, but injuries that qualify as a serious health condition under federal law would overlap with your Paid Leave Oregon weeks, not add to them.10Paid Leave Oregon.
