An Oregon truck collision lawsuit is a civil case brought by someone injured, or by the estate of someone killed, in a crash involving a commercial truck. You generally have two years from the crash to file for personal injury under ORS 12.110(1), and three years from the date of death for wrongful death under ORS 30.020.1Oregon State Legislature. ORS Chapter 12 — Limitations of Actions2Kline Law PC. Oregon Wrongful Death Lawyer Liability rarely stops at the driver: the trucking company, cargo loaders, maintenance shops, and manufacturers can all share responsibility, and recoverable damages fall into economic, noneconomic, and (rarely) punitive categories.
How Long You Have to File
The standard deadline is two years from the date of injury. That clock usually starts the day of the crash, though Oregon courts recognize a discovery rule that can delay the start when an injury was not immediately apparent.3Corson Johnson Law. Statute of Limitations Miss it and you almost always lose the right to sue.
Several situations shift that window:
- If the injured person is under 18, the deadline is paused until they turn 18, capped at five years total or one year past their 18th birthday, whichever comes first.1Oregon State Legislature. ORS Chapter 12 — Limitations of Actions
- When a crash kills someone, the personal representative of the estate has three years from the date of death to bring a wrongful death claim under ORS 30.020.2Kline Law PC. Oregon Wrongful Death Lawyer
- If a government employee was operating the truck within the scope of their job, the Oregon Tort Claims Act requires a written notice of claim within 180 days of the injury, long before any lawsuit is filed. The notice must identify the claimant, state when and where the incident happened, and state that a damages claim is being asserted.3Corson Johnson Law. Statute of Limitations4Johnson Law. - A disabling mental condition that prevents someone from understanding their legal rights can pause the clock, subject to the same five-year outer limit.1Oregon State Legislature. ORS Chapter 12 — Limitations of Actions
Whatever tolling applies, ORS 12.115 sets an absolute ten-year outer boundary from the date of the negligent act.1Oregon State Legislature. Who You Can Sue
Most Oregon truck cases name more than one defendant, and the extra defendants often carry the deepest insurance. To win against any of them, you have to prove that their negligence caused the crash.
The Driver and the Motor Carrier
Trucking companies are commonly held liable for their drivers’ actions under respondeat superior, which makes an employer responsible for harm caused by an employee acting within the scope of the job.5CK Legal. Trucking Company Liability for Unrealistic Delivery Schedules A carrier can also face direct liability for its own failures: negligent hiring, inadequate training, poor vehicle maintenance, or pressuring drivers to break federal hours-of-service limits.6WKD Law. Who Is Liable When a company sets a delivery schedule that makes it impossible for a driver to comply with hours-of-service rules, that schedule itself can become the basis for direct liability.
Being labeled an “independent contractor” doesn’t automatically shield a company. Oregon courts look at who actually controlled the driver’s work, not what the contract says. Dispatch directives, mandatory check-in schedules, route assignments, and company safety handbooks can all establish the kind of real-world control that produces legal responsibility.7Johnson Law. Independent Contractor Truck Driver Company Responsibility Oregon For interstate trips, federal law separately holds the motor carrier vicariously liable for its drivers, including those the carrier calls independent contractors.8DaMore Law Group. Other Defendants
Beyond the driver and carrier, lawsuits often add:
- Cargo loading companies, when a load was unsecured or unbalanced.6WKD Law. Who Is Liable
- Maintenance and repair shops, when a mechanical failure caused or contributed to the crash.6WKD Law. Who Is Liable
- Truck or component manufacturers, when a defect in the vehicle or a safety system played a role.6WKD Law. Who Is Liable
How Your Own Fault Affects Recovery
Oregon follows a modified comparative negligence system under ORS 31.600. You can recover damages only if your share of fault is 50 percent or less. At 51 percent or more, you get nothing. When you do qualify, your award is reduced in direct proportion to your fault share, so a $500,000 verdict with a 20 percent fault finding pays out $400,000.9Sears Injury Law. Oregon Modified Comparative Negligence Law
This is where much of the defense energy in a truck case goes. Insurers and their attorneys work to shift fault onto you, arguing you cut off the truck, changed lanes unsafely, or otherwise contributed to the crash, hoping to push your share past that 51 percent cutoff.9Sears Injury Law. Oregon Modified Comparative Negligence Law
Federal Regulations Are Part of the Case
Commercial trucking is heavily regulated, and violations of those rules are frequently used as evidence of negligence in Oregon lawsuits. The Federal Motor Carrier Safety Administration’s rules sit primarily in 49 CFR Parts 300 through 399.10FMCSA. Regulations Search The ones that come up most:
- Hours of service (49 CFR Part 395): interstate drivers are limited to 11 hours of driving within a 14-hour on-duty window after 10 consecutive hours off, and cannot drive after 60 hours on duty in seven days or 70 in eight. Oregon’s intrastate rule allows up to 12 hours of driving and a 16-hour on-duty window.11DaMore Law. What Trucking Safety Regulations Affect My Case
- CDL requirements (49 CFR Part 383): a valid commercial license, health and fitness checks, background clearance, and demonstrated competence in tasks such as cargo securement.11DaMore Law. What Trucking Safety Regulations Affect My Case
- Vehicle maintenance (49 CFR Part 396): carriers must inspect, repair, and document upkeep of all mechanical systems.11DaMore Law. What Trucking Safety Regulations Affect My Case
- Drug and alcohol testing (49 CFR Parts 40 and 382): random testing is required, and for intrastate commercial drivers in Oregon, driving with a blood alcohol level above 0.02 percent is illegal.11DaMore Law. What Trucking Safety Regulations Affect My Case
- Anti-coercion rules (49 CFR § 390.6): motor carriers, shippers, and intermediaries may not pressure drivers to violate safety regulations.12eCFR. 49 CFR Part 390 — Federal Motor Carrier Safety Regulations; General
Evidence and Why Timing Matters
Truck cases live on records the trucking company controls. The evidence that matters most includes electronic logging device (ELD) data on driving time and duty status, event data recorder or “black box” data capturing speed and braking at impact, GPS and dispatch records, maintenance and inspection logs, and driver qualification files.6WKD Law. Who Is Liable13Jonathan M. Friedman Law. How Is Black Box Data Used in Oregon Truck Accident Cases
Federal rules only require carriers to keep ELD records and supporting documents for six months under 49 CFR 395.8(k).14FMCSA. How Long Must a Motor Carrier Retain ELD Record of Duty Status Data After that window closes, the carrier is free to destroy the records unless it receives a formal spoliation letter demanding preservation. That letter puts the carrier on notice; ignoring it can carry adverse consequences in court.13Jonathan M. Friedman Law. How Is Black Box Data Used in Oregon Truck Accident Cases Waiting to consult a lawyer often means waiting past that six-month cliff.
Oregon also requires any driver in a reportable collision to submit a traffic collision and insurance report to the DMV within 72 hours.4Johnson Law. Government Vehicle Rear Ends You — Evidence to Request Before It Disappears
What You Can Recover
Economic Damages
Economic damages cover quantifiable losses: past and future medical bills, lost wages, diminished earning capacity, property damage, and out-of-pocket costs such as transportation to medical appointments or home modifications.15Rizk Law. What Damages Can I Collect for a Truck Accident Injury
Noneconomic Damages
Noneconomic damages compensate for pain and suffering, emotional distress, loss of enjoyment of life, and loss of consortium.16Johnston Law Firm. Common Types of Compensation Available in an Oregon Personal Injury Claim Oregon used to cap these at $500,000 under ORS 31.710. In 2020, the Oregon Supreme Court struck the cap down as applied to personal injury claims against private parties in Busch v. McInnis Waste Systems, Inc., holding it violated the Remedy Clause of the Oregon Constitution.17Lether Law. Oregon Supreme Court Strikes Down $500,000 Non-Economic Damages Cap for Personal Injury Claims as Unconstitutional The cap still applies to wrongful death cases, where it was upheld in Hughes v. PeaceHealth.18Johnson Law. Fatal Truck Crash Case Value Drivers — What Evidence Decides the Ceiling
Punitive Damages
Punitive damages exist but are rare. Under ORS 31.730, you have to prove by clear and convincing evidence that the defendant acted with malice or showed “reckless and outrageous indifference to a highly unreasonable risk of harm” and “conscious indifference to the health, safety and welfare of others.”19Oregon Public Law. ORS 31.730 — Punitive Damages You cannot include a punitive claim in the initial complaint; you file the suit, then move for the court’s permission to amend and add the claim.20Rizk Law. Punitive Damages in Truck Accident Cases
Even if you win them, you don’t keep the whole amount. ORS 31.735 sends 60 percent to the state’s Criminal Injuries Compensation Account, 10 percent to a state court facilities fund, and 30 percent to the prevailing party, with attorney fees capped at 20 percent of the total award. Oregon courts have repeatedly upheld this split against constitutional challenges.21Oregon Public Law. ORS 31.735 — Distribution of Punitive Damages
If the Defendant Is a Government Entity
Separate caps apply when a government entity is the defendant. For claims arising between July 1, 2025 and June 30, 2026, the Oregon Tort Claims Act sets state liability at $2,637,500 per claimant and $5,275,100 for all claimants from the same incident, adjusted annually for inflation.22Oregon Judicial Department. Tort Claims
Wrongful Death Claims
When a crash kills someone, the claim changes shape. Only the personal representative of the estate can file, though the damages benefit surviving family such as a spouse, children, and parents.23DaMore Law. Truck Accident Wrongful Death Settlements The deadline is three years from the date of death under ORS 30.020, with shorter timelines when a government entity is involved.2Kline Law PC. Oregon Wrongful Death Lawyer
Recoverable damages include medical costs incurred before death, funeral and burial expenses, the deceased person’s lost wages and future earnings, pain and suffering experienced between the injury and death, and the family’s loss of companionship and financial support.18Johnson Law. Fatal Truck Crash Case Value Drivers — What Evidence Decides the Ceiling The personal representative can pair the wrongful death claim with a survival action for losses the deceased suffered while still alive. Punitive damages remain available under ORS 31.730 if the conduct meets the clear-and-convincing standard.2Kline Law PC. Oregon Wrongful Death Lawyer
How the Case Moves
Most Oregon truck lawsuits follow a familiar sequence, and the timeline turns on complexity and whether the case settles.
It starts with investigation: securing trucking records, medical documentation, and accident reconstruction. Once damages are documented, the attorney sends a demand package to the insurer and negotiates.24Aldrich Brunot. Semi Truck Accident Claims Process Oregon If that fails, a complaint is filed. After service, the defendant typically has 30 days to respond. The case then moves into discovery, where both sides exchange documents, take depositions, and retain experts; discovery in a truck case often runs six months to a year. Oregon circuit courts generally aim to schedule trial 10 to 18 months after filing.25WKD Law. Understanding the Timeline for Personal Injury Lawsuits in Oregon Settlement stays possible up until the jury returns a verdict.26Rizk Law. Timeline of a Car Accident Lawsuit
One overlap worth flagging: if you were on the job when the crash happened, you can pursue a workers’ compensation claim for medical treatment and wage-loss benefits while separately suing the at-fault driver or carrier in civil court.24Aldrich Brunot. Semi Truck Accident Claims Process Oregon
