Oregon unemployment benefits pay eligible workers between $204 and $872 per week for up to 26 weeks after a job loss that wasn’t their fault. The Oregon Employment Department runs the program under ORS Chapter 657, and your weekly amount is set at 1.25% of what you earned during a recent 12-month “base year.” You apply through Frances Online, serve a one-week unpaid waiting period, and then file a claim each week to keep payments coming.
Who Qualifies
Two things have to be true at the same time: you earned enough recently, and you lost the job through no fault of your own.
On the earnings side, you need to meet one of two thresholds during your base year: at least 500 hours of work for a covered employer, or at least $1,000 in total wages.1Oregon Employment Department. Unemployment Insurance Eligibility The standard base year is the first four of the last five completed calendar quarters before you file. If you don’t qualify under that window, Oregon can use an alternative base year made up of the last four completed quarters, which helps workers whose recent earnings would otherwise be ignored.2Oregon State Legislature. Oregon Revised Statutes Chapter 657 – Unemployment Insurance
On the separation side, workers who quit without good cause or are fired for work-related misconduct are disqualified. The disqualification isn’t forever. You can requalify after earning at least four times your weekly benefit amount in new covered work.3Oregon State Legislature. Oregon Code Chapter 657 – Section 657-176
Eligibility isn’t a one-time test. Every week you claim benefits, you must be physically able to work, available for full-time work, and actively looking by contacting employers or attending professional development activities. The department can verify your contacts, and turning down a suitable job offer without a valid reason suspends your payments immediately.
What “Suitable Work” Means
You aren’t required to accept any job offered. The department weighs the health and safety risks, your training and experience, your prior earnings, how long you’ve been unemployed, the prospects for finding work in your usual occupation, and the commute from your home.2Oregon State Legislature. Oregon Revised Statutes Chapter 657 – Unemployment Insurance Early in your claim you have more room to hold out for work like what you had. The longer the claim runs, the broader “suitable” becomes.
How Much You’ll Receive
Your weekly benefit amount is 1.25% of your total base-year gross earnings, rounded down to the nearest dollar.4Oregon Employment Department. Glossary Earn $40,000 across your base year and your weekly check comes to $500.
That number is capped on both ends. As of July 1, 2025, the minimum weekly benefit is $204 and the maximum is $872.4Oregon Employment Department. Glossary The floor and ceiling are tied to the state average weekly wage and reset every July, set at 15% and 64% of the prior year’s state average weekly covered wage.2Oregon State Legislature. Regular benefits last up to 26 weeks per claim. During severe downturns, a federal Extended Benefits program can add up to 13 more weeks, or 20 in states that opted into the expanded version, but only when statewide unemployment hits certain trigger thresholds.5U.S. Department of Labor. Pension and retirement income can reduce your weekly benefit, so expect to report it.
What to Gather Before You File
Have these in front of you when you start the application:
- Your Social Security number and a valid government-issued ID such as a driver’s license. Oregon uses Login.gov for identity verification, which may ask you to take a selfie and upload a photo of your ID. A non-digital option is available if you can’t complete it online.6U.S. Department of Labor. Unemployment Insurance Program Letter No. 10-26
- Names, addresses, phone numbers, and start and end dates for every employer you worked for in the past 18 months. Missing one from your base year can delay processing.7Oregon Employment Department. How to Apply for Unemployment Insurance Benefits
- Pay stubs or W-2s to verify wages, plus gross earnings from your last week of work and any expected vacation or severance pay.
- The specific reason you left each job. The department classifies layoffs, firings, and resignations differently, and that classification drives your initial decision.
- Any pension or retirement income you receive.
- Bank routing and account numbers for direct deposit. Without a bank account, benefits load onto a prepaid debit card.
How to File and What Happens Next
Claims go through Frances Online, the department’s web portal for initial claims, weekly reports, and messages.8Oregon Employment Department. Frances Online Create an account first, then start the application. Paper applications are accepted by mail to the Employment Department’s central office in Salem, but online filing is faster.
When you submit, the system generates a confirmation number showing your filing date. Oregon law then requires a one-week unpaid waiting period. That’s the first week you meet all eligibility rules, and you must file a weekly claim for it to get credit, even though no money comes.9Oregon Employment Department. Weekly Claims
Keep filing weekly claims every Sunday while the department reviews your application. An administrative decision usually arrives within a few weeks and spells out your weekly benefit amount and maximum total benefits. Most communication happens through the Frances Online message center, so check it often and keep a working email address on file for automated alerts.
If Your Claim Is Denied
The administrative decision will explain the legal grounds for denial and your appeal rights. Deadlines are short. Administrative decisions, like eligibility denials, become final 20 calendar days after they’re mailed. Monetary decisions, which cover disputes over your weekly amount or base-year wages, become final in just 10 calendar days.10Oregon Employment Department. Appeals Process File late and you may not get a hearing. Don’t sit on a denial.
At a hearing, bring original documents when you can and arrange for any witnesses who can back up your account to testify.
Taxes on Your Benefits
Unemployment benefits are taxable income on your federal return. Early the following year you’ll get a Form 1099-G showing the total paid to you.11Internal Revenue Service. Unemployment Compensation A full year of benefits with no withholding can produce a surprise tax bill.
You can ask the Employment Department to withhold a flat 10% for federal income tax by submitting Form W-4V. That won’t cover everyone’s full liability, especially if you have other income or a higher marginal rate, but it takes the edge off. If you skip withholding, quarterly estimated payments to the IRS are the alternative.
Overpayments and Fraud Penalties
If the department later decides you got benefits you weren’t entitled to, you have to repay the full amount whether the mistake was intentional or not. The department can hold back future weekly benefits to recover the debt, or sue to collect.2Oregon State Legislature. Oregon Revised Statutes Chapter 657 – Unemployment Insurance
When misrepresentation is involved, Oregon adds a penalty of 15% to 30% of the overpaid amount on top of what you owe. Unpaid overpayments accrue interest at 1% per month starting 60 days after the administrative decision becomes final. Federal law also requires Oregon to refer fraud-related debts and unreported-earnings overpayments to the Treasury Offset Program after a year of unsuccessful collection, which lets the government intercept your federal tax refund.12U.S. Department of Labor. Recovery of Certain Unemployment Compensation Debts Under the Treasury Offset Program
Most overpayments start with underreported earnings or an unreported return to part-time work. Report every dollar you earn on your weekly claim, even amounts that seem too small to matter. Intentional fraud can also lead to criminal prosecution.
