Oregon Victim Impact Panel: Registration, Fees, and Court Credit

If you entered DUII diversion or were convicted of DUII in Oregon, the court requires you to attend an Oregon victim impact panel: a session where survivors and family members affected by impaired driving describe what happened to them. You sign up through the approved provider for the county where your case was filed, pay a fee of up to $50, sit through the full session, and deliver the completion certificate to the court or your diversion counselor before your deadline.

Who Has to Attend

Attendance is mandatory in two situations. Under ORS 813.235, the court must require a victim impact treatment session as a condition of any DUII diversion agreement. Under ORS 813.020, the court must require it when you are convicted of DUII rather than diverted.1Oregon State Legislature. Oregon Revised Statutes Chapter 813 – Section 813.020 The court can waive the requirement only if no victim impact program operates in your county or you qualify for an exemption under Department of Transportation rules.

There is one narrow exception written into the statute. If your DUII involved riding a non-electric bicycle rather than a motor vehicle, the court cannot require panel attendance upon conviction.1Oregon State Legislature. Oregon Revised Statutes Chapter 813 – Section 813.020 Everyone else charged with a standard motor vehicle DUII should expect the panel to be non-negotiable.

Finding and Registering for a Panel in Your County

Panels are run at the county level, so your provider depends on where your case was filed. Common organizers include county district attorney offices, sheriff’s departments, and community organizations such as Oregon Impact. Benton County runs its panels through the Willamette Criminal Justice Council.2Benton County District Attorney, Oregon. Some counties offer online panels. Oregon Impact, which serves Clackamas County, has moved its program online with the same speakers who present at live events.5Oregon Impact. DUII Victim Impact Panel Dates Before signing up for a virtual option, confirm with your court or diversion counselor that an online completion will be accepted for your case.

When you register, have your case number, the county where you were charged, and your arrest date ready. Providers use that information to generate a certificate the court can match to your file. Many sessions fill weeks ahead, and some counties hold panels only every other month, so register early rather than letting your diversion clock run short.

If you live outside Oregon but were charged here, do not assume a panel in your home state will satisfy Oregon’s requirement. The statute does not spell this out, and Interstate Compact rules may restrict your ability to leave the state during diversion without permission.7Oregon Judicial Department. The Fee and Payment Methods

Oregon law caps the panel fee at $50.8Oregon State Legislature. Oregon Revised Statutes Chapter 813 – Section 813.235 Each county’s coordinator sets the actual amount within that cap. Umatilla County, for example, charges $40 and takes cash only.9Umatilla County. DUII Victim Impact Panel Check your provider’s accepted payment methods before you arrive. Showing up with a card at a cash-only door can mean rescheduling.

What the Session Is Like

The core of every panel is the speakers. Survivors of impaired-driving crashes, family members who lost someone, and first responders who worked those scenes each describe what happened and how it changed their lives.3lcvip. Linn County Victim Impact Panel Presentations typically run 15 to 20 minutes each. The tone is personal and direct. These are not lectures about statistics; they are people telling you what it felt like to get the phone call or explain a death to a child.

Session length varies. Benton County panels run about an hour and a half.2Benton County District Attorney, Oregon. WCJC – DUII Victim Impact Panel Linn County sessions run two hours.3lcvip. Late entry is not allowed at most locations, and leaving early means you do not get credit.

Conduct Rules

Providers expect respectful, attentive behavior for the entire session. Electronic devices must be off, both to prevent distractions and to protect the privacy of the speakers. Falling asleep, talking during presentations, or other disruptive conduct results in a failed session. You lose your fee and have to register again.

Some providers screen for sobriety at the door. Arriving impaired is a fast way to have your diversion or probation officer notified, and it counts as a failure to comply with your court-ordered conditions. The speakers are sharing some of the worst moments of their lives, and showing up under the influence is the kind of thing that prompts a judge to revoke an agreement.

Getting Credit With the Court

At the end of an in-person session, staff hand out a paper certificate of completion as you leave. For online panels, a certificate is emailed after you finish the course and pass any associated assessment.6Benton County District Attorney, Oregon. DUII Victim Impact Panel Dates You are responsible for making sure that document reaches the court. If you are on diversion, give a copy to your diversion counselor. If you were sentenced on a conviction, file it with the court clerk directly.

Do not lose the certificate. Many providers do not issue duplicates, and the standard remedy for a lost one is attending another panel and paying the fee again. Photocopy or scan it the day you receive it.

What Happens If You Skip It

For diversion participants, failing to complete the panel within your diversion period is a violation of the agreement. If the court finds you did not comply, it enters the guilty plea you signed as part of the diversion petition, enters a judgment of conviction, and sentences you.10Oregon Public Law. Oregon Code 813.225 – Petition for Extension of Diversion Period At that point the diversion path that would have dismissed your charge is gone, and you face the full range of DUII penalties, including jail, fines, and a longer license suspension.

If you are already convicted and on probation, skipping the panel is a probation violation. The court can add jail time or extend your probation conditions. The panel is one of the simpler requirements in a DUII case, so missing it reads to a judge as a larger compliance problem.

If you are running out of time, Oregon allows one extension of your diversion period of up to 180 days. You can only file for it during the last 30 days of your diversion period, and the court must find you have been making a good-faith effort to complete the program.7Oregon Judicial Department. Where the Panel Fits in the Larger Diversion Program

The panel is one piece of DUII diversion, not the whole thing. A diversion agreement also requires you to abstain from alcohol, drugs, and marijuana for the full year, with narrow exceptions for prescribed medications and sacramental wine; complete a substance abuse screening and any recommended treatment at your own cost; install an ignition interlock device for at least one year; and pay any court-appointed attorney fees and restitution the court orders.11Oregon State Legislature. Oregon Revised Statutes Chapter 813 – Section 813.200 You must file the diversion petition and agreement with the court within 30 days of your first court appearance, and the diversion period then runs for one year.7Oregon Judicial Department.
