Who Qualifies
Revenue and Taxation Code Section 214 limits the welfare exemption to property owned and operated by organizations formed for religious, hospital, scientific, or charitable purposes.3California Legislative Information. Beyond purpose, Section 214 imposes structural rules the BOE will verify from your articles, bylaws, and financials:
- No part of the net earnings can benefit any private shareholder or individual, and the property cannot give officers, directors, members, or employees a financial advantage.
- The entity cannot be organized or run for profit. Hospitals get limited flexibility; operating revenues can exceed expenses by up to 10 percent.
- The founding documents must permanently dedicate the property to exempt purposes, with assets passing to another qualifying nonprofit on dissolution.
- The property claimed cannot exceed what is reasonably necessary for the exempt activity.
Some categories of nonprofit are excluded outright even with valid state and federal exempt status. Documents to Gather Before You File

- Articles of incorporation certified by the California Secretary of State, with every amendment. Trusts and unincorporated associations submit their equivalent founding document.
- The IRS determination letter under Section 501(c)(3) or the Franchise Tax Board letter under Section 23701d. If the IRS letter had an advance ruling period that has expired, include the updated letter. If it came through a group ruling, include documentation showing your organization falls under it.
- A balance sheet, income-and-expense statement, and notes to financial statements for the fiscal year immediately before the claim year and each year since, with explanations for any line item that isn’t clear from its account name.
- Brochures, pamphlets, web pages, or similar materials showing what your organization actually does.
Filling Out Form BOE-277
Enter the organization’s legal name exactly as it appears on the articles of incorporation. Any mismatch with the Secretary of State’s records will cause problems. The Corporate Identification Number goes in its designated field so the BOE can link the application to the correct entity.
The form asks you to check the box that best describes the organization’s purpose and then to describe every activity the organization engages in. If the property serves more than one function, explain each and how it connects to the exempt purpose. Keep the description aligned with the mission stated in your founding documents.
Two disclosures catch applicants off guard. You must report whether any individual earns more than $1,500 per week or $78,000 per year and, if so, list the top five positions with their salaries. Submitting the Application
The BOE accepts Form BOE-277 electronically through its website, where you can complete, sign, and submit the form online.7California State Board of Equalization. Timing still matters. The OCC is a prerequisite for the county-level exemption claim, which does have a firm annual deadline. Submitting Form BOE-277 late in the year risks missing that window for the current tax year, so plan to file well in advance.
After the Certificate Is Issued
The OCC by itself does not exempt any property from tax. It confirms that the organization qualifies. For a first-time filing or a new property location, use Form BOE-267. After the exemption is granted, file Form BOE-267-A each year to maintain it. The county assessor also evaluates whether the specific property is being used for exempt purposes. Keeping the Certificate Valid
The OCC does not require an annual renewal filing with the BOE. The BOE can, however, request Form BOE-278-OCC (“Verification for Continued Eligibility of Organizational Clearance Certificate”) at any time to confirm the organization still qualifies. Notify the BOE promptly about significant changes: amendments to articles of incorporation, mergers, or name changes. Send in updated IRS determination letters reflecting a name change or revised exempt status so your file stays current.
