Partial Unemployment in Michigan: Calculation, WorkShare, and Reporting

Partial unemployment in Michigan lets you collect a reduced weekly benefit when your employer cuts your hours or wages through no fault of your own, so you keep some income coming in while you’re still working part-time. The Unemployment Insurance Agency (UIA) runs the program under the Michigan Employment Security Act. Who Qualifies When Your Hours Get Cut

The reduction has to be involuntary. If you asked to work fewer hours, or you were fired for misconduct, you’re disqualified. Michigan law presumes that a worker who moves to a less-than-full-time schedule left work voluntarily, and it’s on you to prove otherwise.2Michigan Legislature. You also need enough recent earnings. The UIA looks at your base period, which is the first four of the last five completed calendar quarters before you file. Every week you claim, you also have to be:

  • Available for work and willing to accept a suitable full-time position.
  • Able to work, physically and mentally, in the kind of job you did before or trained for.
  • Actively searching. Through June 2026, you record at least one work-search activity per week. Starting July 2026, that goes up to three per week.
  • Registered at MiTalent.org, with an in-person visit to a Michigan Works! Association service center to begin reemployment services.

How to File and Keep Certifying

File through the Michigan Web Account Manager (MiWAM) at Michigan.gov/UIA, or call 1-866-500-0017 (TTY: 1-866-366-0004). Have your Social Security card, a state-issued ID, the names and addresses of your employers from the past 18 months, your quarterly gross earnings, and your most recent employer’s Federal Employer ID Number. After you file, the UIA reviews your earnings, checks the reason for the hours cut, and may contact your employer. What you report and what your employer reports need to match, or the claim can stall in fact-finding.

Then, every two weeks, you certify through MiWAM. You confirm you were available for work, report your gross earnings for each week in the period, and log your work searches. How the Partial Benefit Is Calculated

Your Weekly Benefit Rate

The UIA takes your highest-earning quarter in the base period and multiplies those wages by 4.1%. That’s your weekly benefit rate, or WBR. If you have dependents, add $19.33 each, up to five. Say your highest quarter came to $10,000. Your base WBR is $410. Add two dependents at $19.33 each and you’re at roughly $449 before any earnings offset.

The 50-Cent Offset

When you earn wages during a benefit week, the UIA reduces your WBR by 50 cents for every dollar you earn. If your WBR is $400 and you earn $300 that week, the benefit drops by $150, leaving a $250 payment on top of the $300 in wages.3Michigan Legislature. Because the reduction is only half a dollar per dollar earned, picking up an extra shift always leaves you better off than turning it down. You never lose benefits dollar-for-dollar against wages.

How Long the Benefits Last

The maximum duration is 26 weeks per benefit year; the minimum is 14, depending on your earnings history. The UIA calculates your total entitlement by taking 43% of your base-period wages, dividing by your WBR, and rounding down to whole weeks.3Michigan Legislature. If Your Hours Drop to Zero

You don’t need a new claim. The UIA reassesses the one you already have. Your WBR stays the same because it’s tied to the base period, not your current paycheck. Without weekly earnings, the offset disappears and you receive the full WBR.

The reason for the separation still matters. A firing for misconduct or a voluntary quit triggers a fresh determination that can disqualify you even if the partial claim was in good standing.2Michigan Legislature. Michigan Code 421.29 – Disqualification From Benefits

WorkShare: Ask Your Employer

WorkShare is a separate route that the employer, not you, has to set up. Instead of laying off part of the staff, the employer files a plan to cut hours across a work unit. Employees keep their reduced paycheck and receive a proportional share of their WBR on top of it.

The math is friendlier than a straight layoff. If your employer cuts your hours by 30%, you get 70% of your normal wages plus 30% of your WBR. On a $1,000 weekly salary with a $530 WBR, that comes to $700 in wages plus $159 in WorkShare benefits, or $859 for the week. Employers can reduce hours between 15% and 45%, and the program isn’t available for seasonal, temporary, or intermittent workers.7Department of Labor and Economic Opportunity. If cuts are being floated at your workplace, it’s worth raising with your employer.

Taxes on What You Collect

Unemployment benefits are taxable at both the federal and Michigan levels. Michigan doesn’t exempt them, and the state’s flat income tax rate of 4.25% applies.

You can have taxes withheld from each payment. For federal withholding, file IRS Form W-4V to request voluntary withholding at 10%.8Internal Revenue Service. By mid-January the UIA sends a Form 1099-G showing your total benefits and any tax withheld, and that income goes on your return.1Labor and Economic Opportunity. Report Every Dollar of Part-Time Wages

The single most common problem in a partial claim is underreporting earnings during biweekly certification. Report your gross pay for every week, whether or not you think it will change the benefit. The UIA cross-references what you report against employer records, and a “forgotten” shift is exactly what gets flagged.

If the UIA pays you money you weren’t entitled to, you owe it back whether the mistake was intentional or not. The agency can intercept your federal and state tax refunds, withhold lottery winnings, garnish wages without a court order, or sue.9LEO Labor and Economic Opportunity. Fact Sheet 174 – Recoupment

Intentional fraud is worse. Knowingly making a false statement to obtain or increase benefits triggers repayment plus damages equal to the same amount. A second offense raises damages to 1.5 times. Identity theft cases run four times the fraudulent amount. Even a false statement that doesn’t produce an actual overpayment can carry penalties up to three times what you would have received, with a $1,000 minimum.10Michigan Legislature. If You’re Denied or the Amount Looks Wrong

Every UIA decision comes with a mail date on the notice, and every deadline runs from that date, not the day you actually opened the envelope. Late filings are generally rejected.

Start with a protest. Within 30 days of the Determination’s mail date, submit a written protest. Protest each Determination separately. The UIA reviews internally and issues a Redetermination.11State of Michigan. Protests and Appeals Process

If the Redetermination still goes against you, appeal within 30 days. The UIA forwards the appeal to the Michigan Office of Administrative Hearings and Rules, which sets a telephone hearing before an Administrative Law Judge. You aren’t required to have a lawyer, but the ALJ hearing runs on procedural rules and evidence standards that trip up unrepresented claimants. If a meaningful amount of money is at stake, this is the stage where consulting an attorney tends to pay off.
