Pompano Beach Zoning Code: Districts, Variances, and Fees

The Pompano Beach zoning code, adopted as Chapter 155 of the city’s Code of Ordinances, sorts every parcel in the city into a zoning district that controls what can be built there, how dense it can be, and what activities are allowed on the ground.1American Legal Publishing. If the base rules don’t allow what you have in mind, the code sets three paths forward: a variance, a special exception, or a rezoning.

The Zoning Districts

Districts fall into four families: residential, commercial, industrial, and special-purpose.2American Legal Publishing. Pompano Beach Zoning Code – Article 3 Zoning Districts Within each family, the numbers on the label tell you the intensity.

Residential

Single-family districts (RS-1 through RS-4 and RS-L) allow one dwelling per lot. RD-1 permits duplexes. The multi-family districts are numbered by roughly the maximum dwellings per acre they allow: RM-7 up to 7, RM-12 up to 12, RM-20 up to 20, RM-30 up to 30, and RM-45 up to 45.3American Legal Publishing. The spread between RM-7 and RM-45 is wide, so the exact suffix on the parcel next to you decides what a neighbor can propose.

Commercial and Industrial

Commercial districts step up in intensity: Limited Business (B-1) for small shops and services, Community Business (B-2) for mid-range activity, General Business (B-3) for larger retail, and Heavy Business (B-4) for the most intensive commercial uses. Industrial land splits into General Industrial (I-1), Special Industrial (I-1X), Office Industrial Park (OIP), and Marina Industrial (M-2). Industrial zoning carries different noise, traffic, and environmental standards than commercial, and picking the wrong classification can block a planned use outright.

Special-Purpose and Overlays

The Transit Oriented (TO) district promotes compact, walkable, mixed-use development near rail and major transit corridors and expressly bars new auto-oriented uses.4American Legal Publishing. Pompano Beach Zoning Code 155.3501 – Transit Oriented TO Density and dimensional standards inside a TO district can be modified by the overlay developed during the rezoning that created it, so two TO-zoned parcels in different parts of the city can have different height and density caps. Check the specific overlay, not just the base label.

The Atlantic Boulevard Overlay District (AOD) layers extra use and design requirements on top of whatever base zoning already applies along Atlantic Boulevard. The overlay opens up some uses the base district wouldn’t allow: hotels and motels become permitted in any underlying multi-family or commercial zone, mixed-use commercial-residential projects are allowed, and museums are permitted in any commercial base district.5American Legal Publishing. Pompano Beach Zoning Code 155.3703 – Atlantic Boulevard Overlay District AOD It also adds restrictions the base district doesn’t have, including limits on ground-floor medical treatment space, spacing requirements for massage therapy establishments, and floor-area rules for brewpubs. If your parcel is on Atlantic Boulevard, read both layers.

How to Find Your Property’s Zoning

The city’s Planning and Zoning Division publishes an interactive zoning map. Enter the address, click the pin, and you’ll see the district for that parcel.6City of Pompano Beach. Confirm with the Planning and Zoning Division before spending money on plans. Overlays like the AOD won’t be obvious from the base label, and staff records are the final word on district boundaries.

Home-Based Businesses

Working from home is allowed as an accessory use in virtually every zoning district in the city, including all residential zones. The code defines a home-based business broadly as an occupation conducted within a dwelling for the economic gain of a resident, so long as it stays secondary to the residential character of the property.8American Legal Publishing. Pompano Beach Zoning Code 155.4303 – Standards for Specific Accessory Uses Listed examples run from lawyers, architects, and consultants to artist studios, hairdressing, pet grooming, and electronic retail.

The limits are practical. No more than two on-site employees or contractors who don’t live in the home, though remote employees don’t count. No changes to the external appearance of the house. No outdoor display or storage. Retail transactions happen inside the residence. Business vehicles and trailers must comply with the residential-zone standards for commercial vehicles. If a neighbor can’t tell from the street that you’re running a business, you’re generally in bounds.

When the Base Rules Don’t Fit: Variance, Special Exception, or Rezoning

These three tools solve different problems. Choosing the right one is the difference between an approval and a wasted filing fee.

Variance

A variance lets you deviate from a physical standard: a setback, a height limit, a lot coverage cap, a landscaping requirement. It does not change what uses are allowed, and it cannot raise the density cap on the property.9American Legal Publishing. Pompano Beach Zoning Code 155.2420 – Variance

The Zoning Board of Appeals must find that every one of these conditions exists:

  • The property has extraordinary physical conditions — irregular shape, narrow width, difficult topography — that don’t generally affect neighboring parcels.
  • Those conditions were not created by the owner’s own actions.
  • Strict application of the code would effectively prohibit or unreasonably restrict use of the property (undue hardship).
  • The variance would not give the owner a special privilege that similarly situated properties don’t enjoy.
  • The variance is the minimum deviation necessary to allow reasonable use.
  • The variance is consistent with the intent of the zoning code.
  • The variance would not harm the health, safety, or property of the neighborhood.
  • The variance is consistent with the city’s comprehensive plan.

All eight, not most. Applicants usually prove hardship but stumble on “not self-created” or on showing the deviation requested is truly the minimum. Map your argument to each criterion in writing before you file.

Special Exception

A special exception covers a use that’s generally compatible with the district but needs closer review to manage its impacts. The Zoning Board of Appeals reviews these against 13 standards in Section 155.2406.10American Legal Publishing. Pompano Beach Zoning Code 155.2406 – Special Exception The board looks at whether the use would overburden streets, schools, water, and sewer; at population density, traffic, and parking; at noise, odor, glare, and vibration; and at effects on water, air, and scenic resources.

Two criteria trip people up. First, the board weighs whether the neighborhood actually needs the proposed use given what’s already there — a fourth nail salon on a block with three faces an uphill argument. Second, “neighborhood” for impact analysis typically means a radius of 500 feet to a half-mile from the site, so properties well past your immediate neighbors count.

Rezoning

If neither a variance nor a special exception can get you where you want to go, rezoning is the remaining option. It changes the actual district classification of the parcel through either a general zoning map amendment or a site-specific amendment under Sections 155.2403 and 155.2404.11City of Pompano Beach. Request for Rezoning Rezoning is a legislative act, decided by the City Commission after public hearings and notification of surrounding owners, and it’s judged against the comprehensive plan. Because a rezoning permanently changes what the land can become, it draws more scrutiny than the other two paths.

Application Fees

  • Variance, single-family, no code violations: $432
  • Variance, single-family, with code violations: $1,563
  • Variance, multi-family or nonresidential, no violations: $1,144
  • Variance, multi-family or nonresidential, with violations: $2,281
  • Special exception: $1,423
  • Rezoning (general or site-specific map amendment): $3,358
  • Major site plan pre-application meeting: $1,051
  • Major site plan (residential/multi-family): $3,392 plus $67 per acre
  • Minor site plan (nonresidential): $2,367 plus $200 per acre
  • Zoning Use Certificate: $40

Outstanding code violations can nearly quadruple a variance fee. Clear them before you file. Rezonings and major site plans also carry per-acre and per-unit surcharges that push large projects well past the base amount.

A Zoning Use Certificate, required before you can get a Business Tax Receipt, runs $40 and takes about 10 business days to process.13City of Pompano Beach. Enforcement and Penalties

Zoning violations can be prosecuted before the city’s Special Magistrate for Code Enforcement or in County Court.15American Legal Publishing. Pompano Beach Zoning Code – Enforcement Procedure The city also uses an alternate system in which civil citations can be issued, and failing to pay or appear to contest a citation results in a default judgment for the maximum penalty.16American Legal Publishing. Under Florida law, code enforcement fines start at $250 per day for a first violation and $500 per day for a repeat. Municipalities with a population of 50,000 or more may adopt an ordinance authorizing higher fines: up to $1,000 per day for first violations, $5,000 per day for repeats, and $15,000 for violations deemed irreparable or irreversible.17Florida Legislature. Fines run daily, so an unresolved violation can build a lien that far exceeds the cost of simply fixing the problem.
