Pregnancy disability leave in New York is paid through the state’s Disability Benefits Law, which replaces part of your wages while you cannot work because of pregnancy, childbirth recovery, or related complications. The standard coverage runs about four weeks before your due date and six weeks after a vaginal delivery or eight weeks after a cesarean, paying 50 percent of your average weekly wage up to a maximum of $170 per week.1Workers’ Compensation Board. What the Disability Benefit Pays and for How Long
Pregnancy-related disabilities are paid the same as any other qualifying medical condition under Article 9 of the Workers’ Compensation Law.2Workers’ Compensation Board. The weekly payment is 50 percent of your average weekly wage, capped at $170.4New York State Senate. New York Workers Compensation Code 204 – Disability and Family Leave During Employment That cap has not changed since 1989, so for most workers the benefit replaces only a small share of actual pay. Some employers offer supplemental short-term disability policies on top of the state coverage, so it is worth checking your enrollment materials or asking HR.

Who Qualifies
Full-time employees typically become eligible after four consecutive weeks of work for a covered employer. Part-time workers qualify after 25 regular working days. If you moved between two covered employers without a long gap, your eligibility carries over.5Workers’ Compensation Board. Employee Disability Benefits Virtually all private-sector employers in New York are required to carry disability coverage or be authorized to self-insure.6Workers’ Compensation Board. One boundary worth knowing: if you live outside New York and work entirely out of state for a New York-based employer, your employer is not required to provide disability coverage, though some do voluntarily. If you live in New York and work remotely for an out-of-state employer, you are covered.
How to File a Disability Claim
The claim form is the Notice and Proof of Claim for Disability Benefits, Form DB-450. You can get it from your employer, your employer’s insurance carrier, or the Workers’ Compensation Board website.7Workers’ Compensation Board. New York State Notice and Proof of Claim for Disability Benefits It has three parts:
- Part A, which you complete, covers your personal information, Social Security number, last day worked, and when the disability began.
- Part B is the medical certification. A doctor or certified nurse midwife documents the pregnancy-related condition, estimated delivery date, and your physical limitations.
- Part C is the employment and wage section your employer fills in so the carrier can calculate your benefit.
File the completed form within 30 calendar days of your first day of disability. Late filings can permanently forfeit benefits for the days before you actually submitted the form, so this deadline is one to take seriously. Send the form to your employer’s disability insurance carrier, or to your employer directly if it self-insures.7Workers’ Compensation Board. If Your Claim Is Denied
A denial comes as a written Notice of Denial (Form DB-DEN) or a Notice of Total or Partial Rejection (Form DB-451) that explains why.7Workers’ Compensation Board. New York State Notice and Proof of Claim for Disability Benefits Common reasons are incomplete medical documentation, a late filing, or a dispute over whether the condition prevents you from working.
You can challenge a denial by requesting a hearing before a Workers’ Compensation Law Judge. If the judge rules against you, you then have 30 calendar days from the filing date of the decision to submit an Application for Board Review (Form RB-89) to the Disability Benefits Bureau.8Workers’ Compensation Board. Instructions for Completing RB-89 Missing that 30-day window usually ends the administrative appeal. Most disputes trace back to vague medical certifications, so if your provider’s description of your limitations reads thin, ask for more specifics before you file.
Adding Paid Family Leave for Bonding
Disability benefits cover medical recovery, not time to bond with your baby. Paid Family Leave covers the bonding period. Once your disability leave ends, you can file for up to 12 weeks of PFL, which pays 67 percent of your average weekly wage up to $1,228.53 per week in 2026.9Paid Family Leave. Wage Benefit Calculator
Two rules shape how these fit together. You cannot collect disability and PFL at the same time, and together they share the same 26-week maximum in any 52 consecutive calendar weeks.3New York State Senate. New York Workers Compensation Code 205 – Disabilities, Family Leave and Periods for Which Benefits Are Not Payable A typical sequence is six to eight weeks of disability for recovery followed by up to 12 weeks of PFL for bonding, for 18 to 20 weeks of paid leave in total. If complications extended your disability period, your available PFL shrinks against that shared cap.
To open a PFL claim, you will need documentation such as the child’s birth certificate or a provider’s statement confirming the date of birth. PFL also comes with job protection: your employer must restore you to the same or a comparable position with equivalent pay, benefits, and terms, and must maintain your health insurance during leave on the same terms as before.10Paid Family Leave. Where Job Protection Actually Comes From
This is where people get caught out. The Disability Benefits Law pays cash; it does not guarantee your job. Job protection during the disability portion of your leave comes from other laws stacked on top.
The federal Family and Medical Leave Act provides up to 12 weeks of unpaid, job-protected leave for the birth of a child and recovery from a serious health condition. You qualify if you have worked for your employer for at least 12 months, logged at least 1,250 hours in those 12 months, and work at a location where the employer has 50 or more employees within 75 miles.11U.S. Department of Labor. Family and Medical Leave Act When you qualify, FMLA leave runs concurrently with your New York disability benefits, so the disability payments partially replace wages during what would otherwise be unpaid FMLA time.
The New York Human Rights Law adds another layer and has no minimum company size, which matters at small employers. It requires reasonable accommodations for pregnancy-related conditions, including modified schedules, more frequent breaks, lighter duties, and time off for medical appointments and childbirth recovery.12New York Division of Human Rights. Guidance on Pregnancy Discrimination At a larger employer, FMLA, the Human Rights Law, and PFL protections can all apply at once. At a small employer below the FMLA threshold, the Human Rights Law and PFL job protection still cover you.
Taxes on Disability Payments
Disability benefits funded by your employer are generally subject to federal income tax. If your employer pays the full premium, the entire benefit is taxable; if you and your employer split the cost and your share was paid with after-tax dollars, only the portion tied to the employer’s contribution counts as taxable income.13Internal Revenue Service. Life Insurance and Disability Insurance Proceeds At $170 per week the tax bill is small, but you can submit IRS Form W-4V to the payer if you want withholding rather than a surprise at filing time.
