Proof of Texas Residency for Driver’s License: Documents and Rules

To get a Texas driver’s license, you need two printed documents that show your name and your Texas residential address. The 30-Day Residency Rule and Who Skips It

Two documents both dated a week before your visit will not.

Three groups have the 30-day wait waived:

  • Applicants surrendering a valid, unexpired driver’s license or ID from another state can apply immediately after arriving in Texas.
  • Commercial driver’s license applicants are exempt regardless of whether they hold an out-of-state license.
  • Active-duty military members, their spouses, and their dependents are not subject to the 30-day rule and may use a residency address outside Texas.

What Counts as an Acceptable Document

Property and Housing

  • Current deed, mortgage, monthly mortgage statement, or mortgage payment booklet
  • Residential rental or lease agreement
  • Current homeowner’s or renter’s insurance policy, statement, or card

Vehicles and Licenses

  • Valid, unexpired Texas motor vehicle registration or title
  • Valid, unexpired Texas boat registration or title
  • Current automobile insurance policy, statement, or card
  • Current automobile payment booklet or statement
  • Valid, unexpired Texas concealed handgun license or license to carry
  • Valid, unexpired Texas fishing or hunting license

Financial and Employment

  • Preprinted W-2, 1099, or 1098 tax form from the most recent tax year
  • Statements from financial institutions (checking, savings, investment, or credit card accounts) dated within 180 days
  • Preprinted paycheck or payment stub dated within 180 days

Government and Institutional

  • Statements from any federal, state, county, or city government agency dated within 180 days
  • Valid, unexpired Texas voter registration card, or a printout from votetexas.gov verifying your residence
  • Selective Service card
  • Current U.S. military or Veterans Administration documents showing a residential address
  • Document from the Texas Department of Criminal Justice indicating recent release or parole
  • Letter from the Texas Juvenile Justice Department

Utility and Service Bills

  • Utility or residential service bill dated within 180 days, including electric, water, gas, internet, cable, streaming services, lawn services, and cellular phone

Medical and Education

  • Texas high school, college, or university report card or transcript for the current school year
  • Letter of medical Explanation of Benefits or medical bills dated within 180 days
  • Current Form DS2019 or a document from U.S. Citizenship and Immigration Services (non-commercial licenses and IDs only)

The last few categories catch people off guard. A dental bill with your Texas address counts. So does a statement from a streaming service. If the traditional deed-and-utility-bill combination is not available to you, look at the fuller list before assuming you cannot document your address.

Formatting Rules That Get Applications Rejected

Every document has to be printed on paper. The DPS will not accept an image on a phone or tablet screen. You can, however, print electronic statements at home. A bank statement you download as a PDF and print yourself is fine; the rule is that the document be physically printed, not mailed.2Texas Department of Public Safety. Your name on each document has to match the name on your application. If your name has changed through marriage, divorce, or a court order, bring the marriage certificate, divorce decree, or court order so the specialist can connect the two.1Legal Information Institute. 37 Texas Admin Code 15.49 – Proof of Domicile A lease in a maiden name paired with an application in a married name, without the supporting paperwork, will be denied.

Watch the date windows. Utility bills, financial statements, government mail, medical documents, and pay stubs all have to fall within 180 days of your application date.2Texas Department of Public Safety. Documents without a built-in date window, such as a deed, voter registration card, or vehicle title, only need to be current and unexpired.

If Nothing Is in Your Name

Living with a parent, spouse, partner, or roommate who holds all the bills and the lease is common, and Texas has a specific fix for it. Here is how it works. The person you live with fills out the DL-5 stating you reside at their address. That person also has to provide two acceptable residency documents from the list above proving their own address. Both of you sign the form. If the person signing on your behalf is not a family member, they must accompany you to the DPS office in person and hand in the affidavit there.3Texas Department of Public Safety. Notarization is not always required. The DL-5 includes a notary section marked “if required.” For family members signing on your behalf, notarization is typically unnecessary. For non-family signers, the in-person submission requirement effectively takes the place of the notary step. Representatives of an organization, such as a shelter or group home, do need to provide a notarized version of the form or a notarized letter.

You can download the DL-5 from the DPS website or pick one up at any driver’s license office. Falsifying it carries serious consequences, including potential perjury charges.

Homeless Youth

Texas waives the standard residency-document requirement for applicants who qualify as homeless youth under 42 U.S.C. § 11434a, the federal definition that covers individuals without a fixed, regular, and adequate nighttime residence.2Texas Department of Public Safety. Texas Residency Requirement for Driver Licenses and ID Cards A representative of a shelter, transitional service provider, or similar organization can complete a notarized DL-5 or a notarized letter certifying the address where the applicant lives or receives services. That letter replaces the two standard documents.3Texas Department of Public Safety. Texas Residency Affidavit This is one of the few situations where DPS requires actual notarization rather than an in-person visit.

An Extra Step for Non-Citizens

Non-citizens prove Texas residency the same way as anyone else: two printed documents from the accepted list. On top of that, the DPS has to verify lawful presence in the United States through the Department of Homeland Security before it will issue any license or ID.4Texas Department of Public Safety. Acceptable proof of lawful presence includes a valid Permanent Resident Card (Form I-551), a foreign passport with a valid I-94, or an unexpired Employment Authorization Document (I-766). If the electronic check cannot be completed at the counter, DPS will start an additional review and give you instructions on what happens next. The verification can add time to the appointment, so build in a buffer.

One item on the residency list is specifically for this group: a current Form DS2019 or a document from U.S. Citizenship and Immigration Services. It counts toward the two-document requirement, but only for non-commercial licenses and IDs.2Texas Department of Public Safety.
