Filing a Civil Case in Kent County

A civil lawsuit in Superior Court starts with a complaint filed at the Prothonotary’s office. Every complaint has to come with a completed Case Information Statement, and the office will not accept the filing until the fee is paid.6Delaware Courts. Formatting Rules

A Justice of the Peace Court judgment doesn’t automatically become a lien on real estate. To create one, the creditor files a certified transcript of the docket entries with the Prothonotary in whichever Delaware county holds property they want to reach. When a judgment is paid, the creditor has to have satisfaction entered on the record. Failure carries a fine of up to $500 per occurrence and civil liability to the debtor for damages between $10 and $500, with more possible if the debtor proves special damages.11Delaware Code Online. When a sheriff collects the debt through execution, the sheriff endorses the receipt on the execution and the Prothonotary records the satisfaction.

If a judgment was satisfied in one county but a transcript had been recorded in another, the original county’s Prothonotary certifies the satisfaction to the other county’s Prothonotary within 30 days. Concealed Deadly Weapons License Applications

Kent County residents apply for a concealed-carry license at the Prothonotary in Dover. The written application must be filed at least 15 days before the next term of Superior Court and has to include a certificate signed by five “respectable citizens” of the county vouching for the applicant’s character and need, a verified oath, and, for first-time applicants, a notarized certificate showing completion of a firearms training course.12Justia. When a defendant fails to appear or violates a material condition of release and the court forfeits the bond, the proceeds go to the State Treasurer for deposit in the General Fund.
