Psilocybin in Los Angeles: Penalties, Diversion, and Enforcement

Psilocybin in Los Angeles is illegal under both California and federal law, and no city ordinance has softened that. Possessing psilocybin mushrooms is a misdemeanor punishable by up to a year in county jail, though most first-time cases can be routed into a diversion program that ends in dismissal. Selling or growing carries much heavier consequences, and noncitizens face immigration risks that outlast the criminal case entirely.

What Possession Actually Costs

California lists psilocybin and psilocyn as Schedule I hallucinogens under Health and Safety Code Section 11054(d).1California Legislative Information. California Health and Safety Code 11054 Simple possession is charged under Health and Safety Code Section 11377, not Section 11350 (which many online guides get wrong; that section covers narcotics and a specific list that does not include psilocybin).2California Legislative Information. California Health and Safety Code 11377

Since Proposition 47 passed in 2014, possession under Section 11377 is strictly a misdemeanor, with a maximum of one year in county jail.3California Courts. Proposition 47 FAQs One exception: a prior conviction for a serious or violent felony, or for a sex offense requiring registration, allows prosecutors to charge the possession as a felony.2California Legislative Information. Beyond the sentence itself, a conviction brings a $50 criminal laboratory analysis fee along with other court assessments that quickly inflate the real cost.4California Legislative Information. California Health and Safety Code HSC 11372.5 And a misdemeanor drug conviction leaves a record that surfaces on background checks for housing, professional licensing, and certain jobs.

Diversion Under Penal Code 1000

This is how most first-time psilocybin possession cases in LA actually end. California Penal Code Section 1000 lets eligible defendants charged with simple possession under Section 11377 complete a drug education or treatment program; when they finish, the charges are dismissed and no conviction appears on the record.5California Legislative Information. California Penal Code 1000

You qualify only if all four conditions apply:

  • No controlled substance conviction in the past five years.
  • The charged offense did not involve violence or threats of violence.
  • No evidence of a simultaneous drug violation beyond the qualifying possession.
  • No felony conviction in the past five years.

The prosecuting attorney reviews eligibility, usually at arraignment. If you enter the program and complete it, the case is dismissed. If you fail, the criminal case picks back up. Diversion is not available for sale, distribution, or cultivation charges.5California Legislative Information. California Penal Code 1000

Sale, Cultivation, and Spores

Everything changes when the conduct moves past personal possession. Possessing psilocybin with intent to sell, transporting it, or actually selling it triggers felony charges that carry state prison time measured in years. Quantity, packaging, scales, and whether minors were involved all shape how aggressively prosecutors charge.

Growing is its own offense. Health and Safety Code Section 11390 makes it illegal to plant, cultivate, harvest, dry, or process any mushrooms, spores, or mycelium capable of producing psilocybin or psilocyn. It’s a wobbler, meaning prosecutors can file it as a misdemeanor (up to one year in county jail) or a felony (state prison). Growing at home for personal use is a separate crime from possessing the finished mushrooms, so a cultivation case can stack both charges.

Spores are the most misunderstood piece. Federal law does not classify spores as a controlled substance until they germinate and produce psilocybin, which is why vendors sell spore syringes online “for microscopy.” California is harder. Section 11390 criminalizes cultivating spores or mycelium capable of producing psilocybin mushrooms, so buying spores with intent to grow is not a loophole here.1California Legislative Information. California Health and Safety Code 11054 If evidence points to cultivation intent, you can be charged under Section 11390 whether or not any mushrooms have grown yet.

What Enforcement Looks Like in LA

Oakland, San Francisco, and Santa Cruz have passed resolutions deprioritizing enforcement against psilocybin and other psychedelics. Los Angeles has not.6Los Angeles Times. L.A. Dispensaries Openly Sell Magic Mushrooms as State Weighs Decriminalizing Psychedelics LAPD retains full authority to enforce state drug laws, and no city council directive instructs officers to treat psilocybin offenses as low priority.

Patrol officers tend to focus on violent crime, and a small quantity of mushrooms found during an unrelated stop may not always result in a formal arrest. That’s discretion, not policy. Any encounter where psilocybin is found can legally end in arrest and prosecution.

The storefront question comes up constantly in LA because psilocybin products have been sold openly at some locations. Those operations exist in a legal gray zone that gives buyers no protection whatsoever. Purchasing from a visible storefront is still purchasing a Schedule I controlled substance under state law, and both the buyer and the seller remain exposed to criminal liability. Visibility is not legality.

Federal Property Changes the Equation

LA County contains federal courthouses, VA medical centers, military installations, national forest land, and post offices. Psilocybin possession on any federal property falls under federal jurisdiction, where the Controlled Substances Act classifies it as Schedule I regardless of California’s enforcement posture.7Drug Enforcement Administration. Under 21 U.S.C. Section 844, a first-time federal conviction for simple possession of a Schedule I substance carries up to one year of imprisonment and a mandatory minimum fine of $1,000 that cannot be suspended or deferred.8Office of the Law Revision Counsel. 21 USC 844 Penalties for Simple Possession The court can tack on the reasonable costs of investigation and prosecution. Federal charges for simple possession are uncommon, but the risk is real anywhere federal officers patrol.

Immigration Consequences for Noncitizens

Roughly a third of LA residents are foreign-born, and for noncitizens a psilocybin case is often more serious than the criminal statute suggests. Federal immigration law makes any person convicted of an offense “relating to” a federally defined controlled substance inadmissible to the United States.9Office of the Law Revision Counsel. 8 USC 1182 Inadmissible Aliens Inadmissibility blocks green card applications, visa renewals, and re-entry after travel abroad. For current green card holders, certain drug convictions can trigger removal proceedings.

The only discretionary waiver of drug-related inadmissibility covers a first conviction for simple possession of 30 grams or less of marijuana. No equivalent waiver exists for psilocybin. A single misdemeanor possession conviction can permanently bar immigration relief, and a formal conviction isn’t always required: admitting drug use on an immigration application or during a visa interview can trigger inadmissibility on its own. Any noncitizen facing a psilocybin charge should consult an immigration attorney before accepting even a diversion offer, since the terms of program entry can themselves carry immigration consequences.

Is There Any Legal Way to Use Psilocybin in LA?

For practical purposes, no. The only lawful route is enrollment in a federally authorized clinical trial. Institutions like UCLA conduct psilocybin research under layered DEA, FDA, state, and institutional review approvals, and the number of participants at any given time is small.10Drug Enforcement Administration. Schedule I Controlled Substances Research Information11State of California – Department of Justice – Office of the Attorney General. Research Advisory Panel

Religious exemptions sound like a door and are not. The DEA has a petition process under the Religious Freedom Restoration Act, but a Government Accountability Office review found that between 2016 and January 2024, six organizations petitioned specifically for psilocybin exemptions; three withdrew, three remained pending, and none were granted. Across all controlled substances, the DEA has never voluntarily approved a religious exemption, and the ones that exist came only from court orders.12U.S. Government Accountability Office. Drug Control – DEA Should Improve Its Religious Exemptions Petition Process for Psilocybin and Other Controlled Substances Attending a psilocybin ceremony under a religious banner in LA does not create legal protection unless the specific organization holds a court-ordered exemption, and none currently do for psilocybin.

Decriminalization has come close but not landed. Senate Bill 58 would have decriminalized personal possession of psilocybin, psilocyn, DMT, and mescaline for adults 21 and older, but Governor Newsom vetoed it in October 2023, saying decriminalization should wait on therapeutic use guidelines.13Office of the Governor of California.
