R-3 Occupancy in California: Fire, Wildfire, and ADU Rules

R-3 occupancy in California is the California Building Code classification for smaller permanent residential buildings, most commonly single-family homes and duplexes. Under the 2025 California Building Standards Code (Title 24), which took effect January 1, 2026, R-3 sets the fire safety, structural, and egress rules that apply when you build or remodel these structures. The category also covers several building types owners don’t expect, including small residential care homes, dormitories, and certain day-care facilities.

What Falls Under R-3

Section 310.4 of the 2025 California Building Code defines Residential Group R-3 as any permanent residential occupancy not classified under another R group. Single-family homes and duplexes (buildings with no more than two dwelling units) are the familiar cases, but the classification reaches further:

  • Residential care facilities serving five or fewer people.
  • Nontransient congregate residences with 16 or fewer occupants, including dormitories, fraternities, sororities, convents, monasteries, and boarding houses.
  • Transient congregate residences (boarding houses and similar lodgings) with 10 or fewer short-term occupants.
  • Efficiency dwelling units, meaning studio-style apartments with combined living and sleeping areas.
  • Adult and child day-care operations serving six or fewer clients for less than 24 hours at a time.

The practical takeaway: converting a home into a small residential care facility for five clients, or running a six-child day-care out of your house, keeps you inside R-3 rather than pushing the project into a more restrictive institutional classification.1UpCodes. How R-3 Differs From R-1 and R-2

California splits residential buildings into groups by size and by whether occupants are permanent or transient. The distinction drives fire protection, construction type, and egress requirements.

  • Group R-1 covers transient lodging such as hotels and motels. Because guests are unfamiliar with the building, fire suppression and alarm requirements are more demanding.
  • Group R-2 covers buildings with more than two dwelling units where residents are primarily permanent, such as apartment complexes and condominiums. Higher density triggers stricter corridor, stairway, and fire separation rules.
  • Group R-3 covers the smaller permanent residential buildings listed above. Fewer occupants and familiarity with the layout allow simplified construction methods.

Which Rulebook Actually Governs Your Project

The California Building Code establishes the R-3 definition, but the day-to-day construction standards for most R-3 projects live in a separate document: the California Residential Code (CRC), Title 24, Part 2.5. The CRC covers detached one- and two-family dwellings and townhouses that are three stories or less.2ICC Digital Codes. California Residential Code – Title 24, Part 2.5

The CRC is prescriptive. It gives cookbook-style answers on framing, foundations, roofing, and wall construction, which keeps engineering costs down for standard wood-frame homes. If a project falls outside the CRC’s scope, the full CBC applies instead. A four-story townhouse exceeds the CRC’s three-story limit and must be designed under the more complex CBC provisions, as does any R-3 building with an unusual structural system that doesn’t fit the CRC’s prescriptive tables.

Emergency Escape From Sleeping Rooms

Every sleeping room in an R-3 dwelling needs at least one operable emergency escape and rescue opening, typically a window or exterior door, that leads directly outside. Inspectors catch problems here more than almost anywhere else.

The CRC sets minimum dimensions that all have to be met at the same time:

  • Net clear openable area of at least 5.7 square feet, or 5.0 square feet for ground-floor openings and basement window wells.
  • Minimum clear height of 24 inches.
  • Minimum clear width of 20 inches.

The common trap is combining the minimum height with the minimum width. A 24-inch by 20-inch opening yields only 3.3 square feet, well short of the 5.7-square-foot area rule. At least one dimension has to be substantially larger than the minimum. Sill height matters too. It cannot exceed 44 inches above the finished floor, so occupants can actually reach and climb through in an emergency.

Fire Safety: Alarms, Sprinklers, and Garage Separation

R-3 fire safety covers three layers: detection, suppression, and compartmentalization.

Smoke and Carbon Monoxide Alarms

Smoke alarms are required in every sleeping room, in the hallway outside each sleeping area, and on every story of the home including the basement. New construction requires hardwired alarms with battery backup. Battery-only units are permitted only in existing homes where hardwiring is impractical.

Carbon monoxide detectors are required in any dwelling with a fossil-fuel-burning appliance, a fireplace, or an attached garage. They go outside each sleeping area and on every level.3California Legislative Information. California Health and Safety Code 17926

Automatic Fire Sprinklers

California requires automatic fire sprinkler systems throughout all new one- and two-family dwellings. This catches many first-time builders off guard because sprinklers add several thousand dollars to a standard-sized home. The mandate applies to new construction; additions and alterations to existing unsprinklered homes are generally exempt unless the scope of work triggers a local threshold. Budget for sprinklers from the start on any ground-up R-3 build.

Garage Fire Separation

When a garage is attached to or sits beneath living space, fire-resistant separation is required. The standard approach is gypsum board on the garage side of shared assemblies:

  • Walls between garage and residence or attic: minimum half-inch gypsum board on the garage side.
  • Ceiling below habitable rooms above a garage: minimum five-eighths-inch Type X gypsum board.
  • Detached garages within three feet of a dwelling: minimum half-inch gypsum board on the interior side of the exterior walls within that zone.

Doors between the garage and living space must be solid wood or steel, at least 1⅜ inches thick, or rated at 20 minutes minimum. No door may open directly into a sleeping room from a garage.

Building in a Wildfire Zone

If your R-3 project sits in a state-designated Fire Hazard Severity Zone or a local Wildland-Urban Interface area, Chapter 7A of the California Building Code adds a substantial layer of ignition-resistant construction requirements. These rules apply to all new residential construction permitted since July 2008 in affected areas, including single-family homes, duplexes, and ADUs.4UpCodes. The goal is keeping flames and embers out of the building envelope. Key requirements:

  • Class A fire-rated roof assemblies are mandatory. Where the roofing profile creates airspace over a combustible deck, a cap sheet or noncombustible barrier must be installed underneath.
  • Exterior windows and glazed doors must use multipane construction with at least one tempered pane, or meet equivalent fire-performance testing.
  • Attic and roof vents must be wildfire flame and ember resistant, listed by the State Fire Marshal, with noncombustible corrosion-resistant mesh screening no larger than one-eighth inch.
  • Eaves and soffits must be enclosed to block ember entry into roof and attic spaces.

Energy, Solar, and Green Building Overlays

California layers several environmental mandates on top of the structural R-3 requirements, and every new residential project has to meet them.

Energy Code (Title 24, Part 6)

The Building Energy Efficiency Standards require high-performance building envelopes, efficient heating and cooling systems, and specific insulation levels that exceed national codes. California is divided into 16 climate zones, and performance targets vary by zone, so a home in San Francisco has different requirements than one in Palm Springs. Rooftop Solar

Since 2020, most new residential construction must include a rooftop solar photovoltaic system. Required system size depends on floor area, roof orientation, climate zone, and the energy efficiency measures in the design. Battery storage is not itself required, but single-family homes that do not install a battery system must include battery-ready infrastructure so one can be added later. CALGreen (Title 24, Part 11)

California’s green building standards code is mandatory for all new construction and covers water conservation, construction waste diversion, and indoor air quality. CALGreen also has voluntary “reach code” tiers that some local jurisdictions have adopted as mandatory. ADUs and JADUs Under R-3

Accessory Dwelling Units, the backyard cottages and garage conversions that have reshaped California housing policy, are typically classified as R-3. State law requires local agencies to approve qualifying ADU permits ministerially (without a public hearing or discretionary review) within 60 days of a complete application.8Association of Bay Area Governments. Size limits depend on whether the local government has adopted a compliant ADU ordinance. Jurisdictions with their own ordinances must allow at least 850 square feet for a one-bedroom unit, or 1,000 square feet for units with two or more bedrooms. In jurisdictions without a compliant ordinance, state default rules allow a detached ADU of up to 1,200 square feet. Attached ADUs can reach 50 percent of the existing home’s floor area, with a minimum of 800 square feet allowed regardless. Junior ADUs

A Junior ADU is a smaller, simpler option built entirely within the walls of an existing or proposed single-family home, including space like an attached garage. JADUs are capped at 500 square feet and must have their own exterior entrance separate from the main home’s front door. A JADU needs an efficiency kitchen with cooking appliances, a food preparation counter, and storage cabinets, but it can share a bathroom with the main house as long as there is an interior connection. Because both ADUs and JADUs are R-3, they meet the same fire safety, egress, energy, and sprinkler requirements as any other new dwelling on the property. The streamlined approval process does not waive building code compliance.
