Rhode Island Nicotine Pouch Tax: 80% Rate and October 2025 Start

The Rhode Island nicotine pouch tax is 80% of the product’s wholesale cost. Licensed distributors owe the tax and file a monthly return with the Division of Taxation by the 10th of each month for the prior month’s activity. The rate took effect October 1, 2025, when the state added nicotine pouches to its “other tobacco products” category under P.L. 2025, ch. 278.1Justia Law. Rhode Island Code 44-20-13.2 – Tax Imposed on Other Tobacco Products, Smokeless Tobacco, Cigars, Pipe Tobacco Products, and Electronic Nicotine-Delivery Products

What the 80% Rate Applies To

The tax base is the wholesale cost, meaning what the distributor pays to acquire the product, not the retail shelf price. A can of pouches bought at wholesale for $4.00 carries $3.20 in state excise tax, bringing the distributor’s cost to $7.20 before any retail markup.

Because the rate is percentage-based rather than per unit, premium brands generate more tax per can than budget brands. The 80% rate is identical to what Rhode Island applies to pipe tobacco and most smokeless tobacco other than snuff.1Justia Law. Rhode Island Code 44-20-13.2 – Tax Imposed on Other Tobacco Products, Smokeless Tobacco, Cigars, Pipe Tobacco Products, and Electronic Nicotine-Delivery Products

The classification applies regardless of whether a pouch contains tobacco leaf. Rhode Island groups pouches with “other tobacco products” based on what they deliver, not their ingredients, so synthetic-nicotine pouches are taxed the same as tobacco-derived ones.

The October 2025 Start Date and Floor Tax

Before October 1, 2025, nicotine pouches were not subject to this excise. The amending law also imposed a one-time floor tax: retailers and distributors had to pay the 80% rate on any nicotine pouch inventory they already held on the effective date, with returns due by October 16, 2025.1Justia Law. Rhode Island Code 44-20-13.2 – Tax Imposed on Other Tobacco Products, Smokeless Tobacco, Cigars, Pipe Tobacco Products, and Electronic Nicotine-Delivery Products Any business that failed to file the floor return still owes that liability.

Distributor Licensing and Monthly Filing

Any business distributing nicotine pouches at wholesale in Rhode Island must hold a tobacco products distributor’s license. The application is Form TOB-APP, filed with the Division of Taxation.2Rhode Island Division of Taxation. Licensed distributors file Form OTP-1, the Tobacco Products Tax Return, each month. The return and payment are due by the 10th of the month for the prior month’s liabilities.2Rhode Island Division of Taxation. Other Tobacco Products Tax (OTP Tax) March activity is reported and paid by April 10.

Preparing the return requires tracking the wholesale cost of each taxable product received during the period, along with purchase dates, suppliers, and quantities. The Division of Taxation can examine distributor and dealer records to verify the figures reported.

The Five-Day Rule for Dealers Buying from Unlicensed Distributors

Dealers who purchase other tobacco products from an unlicensed distributor face a tighter deadline. They must file a return and pay the tax within five days of taking possession of the product in Rhode Island, using Form OTP-4 rather than OTP-1.3Cornell Law Institute. 280 RICR 20-15-2.6 – Mandatory Filing of Tax for Other Tobacco Products If your supplier is not Rhode Island–licensed, the obligation shifts to you and the clock is short.

Interest on Late Payments

Rhode Island charges interest on any state tax not paid by its due date. The rate is reset each January 1 using the prior October 1 prime rate plus two percentage points, with a floor of 12% per year and a ceiling of 21% per year.4Rhode Island General Assembly. Rhode Island Code 44-1-7 – Interest on Delinquent Payments Interest starts accruing the day after the deadline, with no notice required from the Division.

How Other Nicotine Products Are Taxed

If you sell more than one category, the rates differ:

Paying the state excise does not satisfy every obligation that comes with selling nicotine pouches in Rhode Island.

Finally, Rhode Island prohibits sale of any tobacco or nicotine product to anyone under 21, which includes nicotine pouches regardless of ingredients.9Rhode Island Department of Behavioral Healthcare, Developmental Disabilities, and Hospitals. Tobacco: Report Sales Violations, Information, and Signs
