Same Day Voter Registration in Virginia: Provisional Ballots and Rules

Same-day voter registration in Virginia lets you register in person and vote a provisional ballot on the same visit, anytime from the day after the regular registration deadline through Election Day itself.1Virginia Department of Elections. Same Day Voter Registration The regular registration books close 10 days before a primary, general, or most special elections.2Virginia Code Commission. Virginia Code 24.2-416 – Closing Registration Records Before Elections Miss that cutoff, and same-day registration is your path in.

The tradeoff is simple. Voters who register before the deadline cast a regular ballot that is counted on Election Night. Same-day registrants cast a provisional ballot, which the local electoral board verifies after the election before counting.3Virginia Code Commission. Virginia Code 24.2-420.1 – Extended Time for Persons to Register in Person Your vote still counts if your registration checks out. You just add a verification step.

Who Can Use Same-Day Registration

The eligibility rules are the same ones that apply to any Virginia voter. You must be a U.S. citizen, at least 18 years old, and a resident of Virginia and of the precinct where you intend to vote. A felony conviction disqualifies you unless the Governor or another appropriate authority has restored your civil rights, and a court finding of mental incompetency disqualifies you until a court reestablishes competency.4Virginia Code Commission. Residency means a real physical address inside the precinct, not just a mailing address. A P.O. box does not qualify.

What to Bring

You need one acceptable form of identification. Virginia’s list is broader than most voters expect, and any single item on it is enough on its own:

  • A valid Virginia driver’s license, U.S. passport, or any other photo ID issued by Virginia, a Virginia locality, or the federal government. Driver privilege cards and identification privilege cards do not qualify.
  • A valid student ID from any college or private school in Virginia, or a photo student ID from any college in another U.S. state or territory.
  • A valid employee photo ID issued by your employer in the ordinary course of business.
  • A voter confirmation document mailed to you after registration.
  • A current utility bill, bank statement, government check, paycheck, or other government document showing your name and address.

That last category stands on its own. A utility bill with your name and address is a valid form of identification by itself; you do not also need a photo ID.5Virginia Code Commission. Virginia Code 24.2-643 – Qualified Voter Permitted to Vote; Procedures at Polling Place; Voter Identification

If you have none of these, you can still cast a provisional ballot by signing a statement affirming your identity. The election officer notes on your envelope whether you showed ID or signed the statement.

You will also complete a Virginia Voter Registration Application. The form asks for your full legal name, date of birth, current residential address, any prior registration address, and your full Social Security number. The Social Security number is required by the state constitution; leaving it blank means the application is denied.6Virginia Department of Elections. Where to Go

Where you register and vote depends on the day.

During the early voting period, you can go to your local general registrar’s office or to any satellite voting location your locality has opened. On Election Day itself, you must go to the specific polling place assigned to the precinct where you live.1Virginia Department of Elections. Same Day Voter Registration If you show up at the wrong precinct on Election Day, you will not be able to vote there. Look up your assigned polling place on the Virginia Department of Elections website before you leave the house.

How the Provisional Ballot Works

Hand your completed registration application and ID to the election officer when you arrive. Because you are registering after the regular deadline, you get a paper provisional ballot instead of voting on a machine, along with a green envelope supplied by the Department of Elections.7Virginia Code Commission. Virginia Code 24.2-653 – Provisional Voting; Procedures in Polling Place

On the outside of the green envelope, you fill in your full name, date of birth, address, and the last four digits of your Social Security number, and you sign it. The registration application requires your full Social Security number; the provisional envelope only asks for the last four. Mark your ballot in private, seal it inside the green envelope, and the election officer places it in the ballot container. Provisional ballots are kept separate from regular ballots until the electoral board can review them.7Virginia Code Commission. What Happens After You Vote

The local electoral board meets the day after the election and begins reviewing every provisional ballot cast in its jurisdiction. Board members check whether each voter’s registration is valid and whether the person was eligible to vote in that precinct. The entire review must finish within 10 calendar days of the election, though the board can adjourn and reconvene within that window.8Virginia Code Commission. Virginia Code 24.2-653.01 – Provisional Ballots; Electoral Boards to Make Determination as to Validity

If the board confirms your registration, your green envelope is opened and your ballot is counted with the final results. If there is a question about your eligibility, you may attend the board’s meeting, bring a representative or legal counsel, and provide additional information. The board can also grant you an extension to produce what you need.8Virginia Code Commission. Virginia Code 24.2-653.01 – Provisional Ballots; Electoral Boards to Make Determination as to Validity
