An opposition to a demurrer in California is the brief you file to defend your complaint when the other side argues it fails to state a valid legal claim, and it must be filed and served at least nine court days before the hearing. The winning version does one thing well: it walks the judge through each element of your challenged causes of action and points to the specific paragraphs in your complaint that satisfy them. Everything else in the opposition supports that core.
Nine Court Days, and No Mail Extension
Your opposition must be filed with the court and served on every other party at least nine court days before the hearing. Court days exclude weekends and judicial holidays, so count backward carefully. A Monday hearing means the preceding Saturday and Sunday do not count against the nine.1California Legislative Information. California Code of Civil Procedure – Motions and Orders
One trap costs unwary plaintiffs their case. The extra calendar days that get added for mail service on the moving papers do not apply to your opposition. Code of Civil Procedure section 1005 explicitly excludes section 1013 extensions from opposition papers. You cannot tack on five extra days for in-state mail, or any other service-method extension, when calculating your deadline.1California Legislative Information. California Code of Civil Procedure – Motions and Orders
How you serve the opposition is also restricted. Standard mail is not fast enough. You must use personal delivery, fax, express mail, or another method reasonably calculated to reach the other side by the close of the next business day after filing. Electronic service is deemed complete at transmission, and when the other party receives a document electronically, two court days are added to any deadline they have to act on it.2California Legislative Information. Identify Exactly What the Demurrer Attacks
Code of Civil Procedure section 430.10 lists the grounds a defendant can raise. Read the demurrer closely and pin down which ones apply to which causes of action. The common ones you might face include:
- Failure to state a cause of action — the facts you alleged, even if true, do not add up to a recognized legal claim. This is by far the most frequently raised ground.
- Uncertainty — the complaint is so ambiguous or unintelligible that the defendant cannot reasonably respond.
- Lack of jurisdiction over the subject matter of the claim.
- Lack of legal capacity of the plaintiff to sue.
- Another action pending between the same parties on the same claim.
- Defect or misjoinder of parties.
- In a contract case, failure to clarify whether the contract was written, oral, or implied by conduct.
Your opposition responds to the grounds actually raised. If the demurrer attacks only for failure to state a cause of action, do not shadowbox against uncertainty arguments the defendant never made.3California Legislative Information. California Code CCP – 430.10
The Standard Is on Your Side
On a demurrer, the court must accept every fact you properly pleaded as true. The judge cannot weigh evidence, assess credibility, or decide whether you can actually prove your allegations at trial. The only question is whether those assumed-true facts state a recognized cause of action. The burden sits with the defendant to show the complaint is legally deficient. Your opposition should lean on that standard early and remind the court of it whenever the defendant’s brief drifts into disputing your facts.
Build the Argument Element by Element
The heart of the opposition is mechanical work: element, allegation, match. For each challenged cause of action, cite the case law establishing the elements, then walk through them one at a time and point to the paragraph numbers in your complaint that satisfy each. Quote your own pleading. Judges ruling on demurrers want this laid out plainly, not buried in rhetoric.3California Legislative Information. California Code CCP – 430.10
Responding to an Uncertainty Ground
Uncertainty demurrers are disfavored and rarely succeed. The defendant has to show the complaint is so ambiguous or unintelligible that they literally cannot frame a response. If your complaint gave reasonable notice of the claims, an uncertainty demurrer should be overruled. A few paragraphs are usually enough, often with the observation that the defendant clearly understood the claims well enough to demur to them in detail.3California Legislative Information. California Code CCP – 430.10
Procedural Objections Worth Noting
Before filing the demurrer, the defendant was required to meet and confer with you by phone, video conference, or in person under Code of Civil Procedure section 430.41, and to file a declaration confirming that happened. If no declaration was filed, or the defendant never actually contacted you, raise it. Also check whether the demurrer identifies which specific portions of the complaint it challenges, whether the memorandum stays within the page limit, and whether the demurrer was timely.4California Legislative Information. California Code CCP – 430.41
A boundary worth understanding: courts will not overrule or sustain a demurrer solely because the meet and confer process was inadequate. Procedural objections are worth flagging, but they will not carry the day on their own. Your substantive arguments do the real work.4California Legislative Information. California Code CCP – 430.41
Always Request Leave to Amend
Even if you believe your complaint is airtight, include a fallback request for leave to amend. California courts strongly favor resolving cases on their merits, and leave to amend is routinely granted unless the plaintiff cannot cure the defect. You do not need to attach a proposed amended complaint, but explain in general terms what additional facts you could plead to answer the defendant’s objections.
This request is your safety net. Without it, a judge who sustains the demurrer might deny leave to amend, which can end the case. Asking costs nothing.
Formatting the Document
The California Rules of Court set the layout for the first page: your name, office address, phone number, fax number, email address, and State Bar number in the upper-left portion, followed by the court title and the case caption with the parties on the left and the case number on the right.5Judicial Branch of California. California Rules of Court 2026 – Rule 2.111. Format of First Page
The body uses double spacing and a font no smaller than 12 points, with consecutively numbered pages. Your memorandum of points and authorities is capped at 15 pages, not counting exhibits, declarations, the table of contents, the table of authorities, or the proof of service. If you genuinely need more space, you can move for leave to exceed the limit, but judges view those requests skeptically.
You do not need a separate notice of hearing; the demurring party already set the date.6Judicial Branch of California. California Rules of Court Rule 3.1112 – Motions and Other Pleadings
Check the Tentative Ruling Before the Hearing
Once your opposition is on file, the next thing to watch for is the court’s tentative ruling. Under the California Rules of Court, courts must make tentative rulings available no later than 3:00 p.m. the court day before the hearing. Publication method varies by county; some post online, others release rulings by phone.7Judicial Branch of California. California Rules of Court 2026 – Rule 3.1308. Tentative Rulings
If the tentative overrules the demurrer in your favor and the court has not directed oral argument, you can often submit on the tentative without appearing. If the tentative sustains the demurrer, or you want to argue against any part of it, you have to notify the court and every other party of your intent to appear by 4:00 p.m. the court day before the hearing. Miss that deadline and you can lose your chance to argue.7Judicial Branch of California. California Rules of Court 2026 – Rule 3.1308. Tentative Rulings
At the hearing, keep the argument focused on the legal standard. The judge is not weighing the facts of your case, only whether the allegations state a valid claim. Oral argument on demurrers is usually brief. The tentative tells you where the judge’s thinking sits; your job is to reinforce it or identify a specific error in reasoning the judge should reconsider.
What the Ruling Means
The court’s decision takes one of three forms, and each triggers a different next step.
Overruled
The complaint survives. The defendant must answer. Unless the court orders otherwise, leave to answer is deemed granted within 10 days of the ruling.8Judicial Branch of California. California Rules of Court Rule 3.1320 – Demurrers
Sustained With Leave to Amend
The court found a defect but is giving you a chance to fix it. You have 10 days to file an amended complaint unless the court specifies a different timeframe. The clock runs from service of notice of the ruling, not from the hearing date.8Judicial Branch of California. California Rules of Court Rule 3.1320 – Demurrers9California Legislative Information. California Code CCP – 472b Treat the amendment seriously. Defendants can demur again, and courts grow less patient with each round.
Sustained Without Leave to Amend
The court has concluded that no amendment could cure the defect. If this outcome applies to the whole complaint, the defendant can obtain a dismissal with prejudice, permanently barring you from refiling the same claim. Your remedy at that point is to appeal.9California Legislative Information. California Code CCP – 472b
