San Jose Gun License: Requirements, Training, and How to Apply

To get a San Jose gun license for concealed carry, you apply to the San Jose Police Department through its online portal, meet California’s eligibility requirements, complete a 16-hour training course, pass fingerprinting and a background investigation, and sit for an in-person interview. The Chief of Police issues the license under California Penal Code Section 26155.1California Legislative Information. California Penal Code 26155 – License to Carry Concealed Firearm Issuance by Chief of Police Plan on several months from the day you file to the day you are notified of a decision.

Who Qualifies

California sets five baseline requirements. You must be at least 21 years old, live in the City of San Jose, complete the required training course, and be the recorded owner with the California Department of Justice of each firearm you want listed on the license. You must also not be a “disqualified person” under Penal Code Section 26202.1California Legislative Information. Residency is established through things like your voter registration address or a homeowner’s property tax exemption. SJPD also asks for utility bills dated within the last 60 days and a valid California driver’s license or state ID showing your San Jose address.3San Jose Police Department. If you recently bought a firearm you want on the license, wait until the DOJ registration clears before applying. Applying with a firearm that has not finished processing creates an avoidable snag.

What Will Disqualify You

Section 26202 lists specific, objective factors that make you ineligible. The main ones:

  • You are reasonably likely to be a danger to yourself, others, or the community based on the application, background check, or any psychological assessment.
  • You have a felony conviction, which bars firearm possession under Penal Code Section 29800.4California Legislative Information. California Penal Code 29800 – Prohibitions on Firearm Access
  • You have been subject to a domestic violence protective order, civil harassment restraining order, or similar order, unless it expired or was vacated more than five years before you apply.
  • You were convicted in the last 10 years of a hate crime, brandishing a weapon, or another offense listed in Penal Code Section 29805.
  • You have a history of unlawful or reckless use, display, or brandishing of a firearm.
  • You were convicted of a controlled-substance offense and incarcerated, on probation, or on parole within the last five years.

The full statute reaches further, including dismissed charges tied to plea deals, outstanding felony warrants, and certain mental health commitments.2California Legislative Information. Documents to Gather

The application form itself is the state form standardized by the California Attorney General under Penal Code Section 26175.5California Legislative Information. California Code PEN 26175 – License to Carry Firearm Application Forms You will list each firearm by make, model, caliber, and serial number, and each must already be registered to you with the DOJ.

Before you start, pull together:

  • A valid California driver’s license or state ID showing your current San Jose address.
  • Recent utility bills or similar documents dated within the last 60 days.
  • Accurate employment history and a full account of any past legal issues.

False or misleading information on the application is a crime and triggers automatic disqualification.3San Jose Police Department. San Jose Police Department – CCW Policy and Procedures

How to Submit the Application

As of April 28, 2025, SJPD requires all CCW applications to go through its online portal. Paper submissions are no longer accepted. You upload digital copies of your documents through the portal and track your application through each stage.3San Jose Police Department. San Jose Police Department – CCW Policy and Procedures

When you file, you pay two fees: a California Department of Justice processing fee (paid by check to the DOJ) and a nonrefundable local fee equal to 50 percent of the total San Jose application fee. The other 50 percent of the local fee is collected only if your license is approved.6San José Police Department. Carrying a Concealed Weapon Policy7California Legislative Information. California Penal Code 26190 – Fees for License Application SJPD does not publish current amounts on its website, so call the department for the exact figures. Fingerprinting, training, and any psychological testing are separate costs.

Training

First-time applicants must complete at least 16 hours of training from a DOJ-certified instructor. The curriculum covers firearm safety, handling, safe storage, legal transportation, where permit holders can and cannot carry, when lethal force in self-defense is lawful, and at least one hour on mental health awareness. Every course ends with a written exam and a live-fire exercise where you demonstrate safe handling and shooting proficiency with each firearm you want on the license.8California Legislative Information. California Penal Code 26165 – Course of Training for License Issuance

SJPD maintains a list of approved training providers. If you train with someone off the list, the department can reject your certificate and send you back to retake the course.

One timing detail worth knowing: you are not required to pay for training before the department makes an initial determination about whether you are a disqualified person.9California Legislative Information. California Code PEN 26165 – Course of Training for License Issuance In practice, SJPD should run a preliminary review first, so an obvious disqualifier surfaces before you spend money on a 16-hour course.

Background Investigation and Interview

Once you file, SJPD assigns a background investigator to your case and schedules an in-person interview. The investigator reviews your application, clarifies details, and assesses your suitability. Inconsistent or vague answers draw questions.

You will also complete a Livescan fingerprinting appointment. Your prints go electronically to the California DOJ, which forwards them to the FBI for a national criminal history search.10California Department of Justice – Office of the Attorney General. Fingerprint Background Checks

If the initial screening warrants it, SJPD can require a psychological evaluation by a licensed psychologist of its choice, and the law allows the department to charge you for the actual cost.7California Legislative Information. California Penal Code 26190 – Fees for License Application Not every applicant will be sent, but budget for the possibility.

How Long It Takes

Processing typically takes several months. The depth of the background check, SJPD staffing, and whether anything surfaces during the investigation all affect the timeline. The department notifies you of the final decision in writing at the address on file.

If You Are Denied

A denial based on a disqualified-person finding must come with a written explanation stating the specific reason, along with a copy of the state form you need to request a hearing.11California Legislative Information. California Penal Code 26206 – Hearing to Challenge Disqualified Person Determination

You have 30 days from receiving the denial to request a hearing in the superior court of your county of residence. If SJPD runs an internal appeal process and requires you to exhaust it first, the department must resolve that appeal within 60 days; if the internal appeal fails, you then have another 30 days to request the court hearing. Miss either 30-day window and you lose your right to a hearing on that application.11California Legislative Information. California Penal Code 26206 – Hearing to Challenge Disqualified Person Determination After you file the request, the court must schedule a hearing within 60 days.

Renewal

A California CCW license is valid for two years from the date of issuance. Renewal runs through the same portal: new application, fees, and background check. The renewal training course is at least eight hours and covers the same subjects as the initial 16-hour course, including the written exam and live-fire demonstration.8California Legislative Information. California Penal Code 26165 – Course of Training for License Issuance

Start renewal well before expiration. Because background investigations can run months, a late start risks a gap where your old license has expired and the new one has not yet issued. SJPD can also require a new psychological evaluation at renewal.7California Legislative Information. California Penal Code 26190 – Fees for License Application

Where the License Does Not Let You Carry

A valid license is not a pass to carry anywhere. Penal Code Section 26230 bars licensed CCW holders from a long list of locations, and violating those restrictions can trigger revocation and criminal charges.12California Legislative Information. California Penal Code 26230 – Prohibited Locations for Concealed Carry Prohibited places include school zones, preschools and childcare facilities, court buildings, state and local government buildings, jails, colleges and universities, airports and passenger vessel terminals, nuclear facilities, police stations, and polling places.

Since January 2025, enforcement also extends to bars and restaurants that serve alcohol, playgrounds and youth centers, parks and athletic facilities, most state parks and wildlife areas, casinos, stadiums and arenas, public libraries, amusement parks, zoos, and museums, along with the parking areas connected to those places.13California Department of Justice. Additional Restrictions on CCW License Holders Carrying Concealed Firearms in Certain Sensitive Places Are Now in Effect Several other categories remain under court injunction and are not currently enforced; that status can change, so check the California Attorney General’s website periodically.

A Separate San Jose Rule for All Gun Owners

San Jose requires every gun owner in the city, not just CCW holders, to carry liability insurance covering losses from accidental firearm use, including death, injury, and property damage. The rule took effect January 1, 2023, and survived a federal court challenge. A standard homeowner’s or renter’s policy that includes firearm liability satisfies the requirement.14City of San José. The ordinance also includes an annual fee payable to a designated nonprofit for gun violence reduction programs. As of this writing, the city has not set a final fee amount, selected the nonprofit, or announced a start date for that part of the ordinance.15San Jose Police Department, CA.
