The San Mateo County Superior Court charges a non-refundable $82 administrative fee on top of your full bail, and once the court approves your request you have 60 days to finish an approved eight-hour course.1Superior Court of California, County of San Mateo. Traffic School You have to act by the appearance date on your citation, and not every ticket qualifies.
Who Qualifies
Traffic school is available only for infractions under the rules-of-the-road and vehicle-equipment sections of the California Vehicle Code, and you need a valid driver’s license. Misdemeanors, alcohol- or drug-related violations, and speeding tickets alleging more than 25 mph over the limit are excluded, as are violations that carry more than one point, such as reckless driving or hit-and-run.2California Courts. Rule 4.104 – Procedures and Eligibility Criteria for Attending Traffic Violator School
The timing rule trips up a lot of drivers. You cannot use traffic school if your current violation date falls within 18 months of a previous violation for which you already attended or elected traffic school. The court measures that window from violation date to violation date, not from the day you finished the course.3California Legislative Information. California Code VEH 1808.7 Any outstanding failure-to-appear on a traffic case also has to be resolved, with the associated fine paid, before the clerk will approve your request.2California Courts. Commercial License Holders
If you hold a Class A, Class B, or commercial Class C license and the ticket came while you were driving a commercial vehicle, traffic school is not available at all.2California Courts. Rule 4.104 – Procedures and Eligibility Criteria for Attending Traffic Violator School
Even for tickets in your personal car, there is a federal catch. Federal regulations prohibit states from masking, deferring judgment on, or diverting any traffic conviction for a CDL or commercial learner’s permit holder, regardless of what they were driving at the time.4eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions California law lets the court allow you to attend traffic school and skip the point for negligent-operator purposes, but the conviction itself stays visible on your CDLIS record for insurers and employers to see.5California Legislative Information. Finishing the Course
After the court approves your request, you have 60 days to complete an eight-hour traffic violator school course.1Superior Court of California, County of San Mateo. Traffic School You pick the school and pay tuition directly to the provider, separate from what you paid the court. DMV-licensed online schools typically run about $10 to $40.
To find an approved school, use the DMV’s online traffic school search tool.8California Department of Motor Vehicles. Traffic School List The San Mateo Court’s traffic school page also links to approved providers. Online and in-person formats both qualify.
When you pass, the school transmits your completion certificate electronically to the DMV and the court. The court then designates the conviction as confidential under Vehicle Code Section 1808.7, so no violation point lands on your public record and the conviction stays off the record insurers pull.3California Legislative Information. California Code VEH 1808.7 You can verify everything posted by checking your case status on the court’s online portal.
If You Miss the 60-Day Window
Miss the course deadline and the point goes on your driving history permanently. It then counts toward California’s negligent-operator threshold and is visible to insurance companies, where it typically affects premiums for three or more years.
Blowing the citation deadline itself is worse. Failing to appear or resolve a traffic case by the due date can trigger a civil assessment of up to $100 on top of the fine, and the DMV may place a hold or suspension on your license.6Superior Court of California, County of San Mateo. If You’d Rather Fight the Ticket
Traffic school hides the point but still costs you the full fine. If you think the ticket was wrong, you can contest it through a trial by written declaration without appearing in court. You submit your side in writing, the officer submits theirs, and a judge decides on the paperwork.9California Courts. Trial by Written Declaration You pay the full bail first as a deposit, fill out form TR-205, and submit everything before your due date. If the judge finds you not guilty, your bail comes back.
Lose, and you still have options. Within 20 calendar days of the court mailing its decision, you can file form TR-220 to request a brand-new in-person trial, called a trial de novo.9California Courts. Trial by Written Declaration If you lose that too, you can still ask the judge at the hearing for permission to attend traffic school, provided you meet the eligibility rules. Trying the written declaration route first costs nothing beyond the time to fill out the form.
