If you or a family member developed mesothelioma, lung cancer, or another asbestos-related disease after exposure in Santa Ana, you can bring a Santa Ana asbestos lawsuit in California’s courts and, in most cases, also file a claim against the W.R. Grace bankruptcy trust. California gives you one year from the date you knew asbestos caused the illness to sue, and the two paths are usually pursued together.
Who Can File
Most Santa Ana claims trace back to the W.R. Grace & Company vermiculite plant at 2502 South Garnsey Street, which processed ore from the contaminated Libby, Montana mine from 1972 to 1993.1ATSDR. Health Consultation Final Santa Ana A federal official from the Agency for Toxic Substances and Disease Registry warned in 2003 that plant workers and nearby residents, including people near Washington Elementary (about 200 yards north) and Saddleback High School, may have been exposed to dangerous levels of asbestos. Family members of workers faced additional risk because fibers could travel home on clothing.2Los Angeles Times. Asbestos Exposure Fears Near Santa Ana Plant
Grace is not the only source. Litigation records tie exposure to several other Santa Ana and Orange County workplaces and products:
- Kaiser Gypsum in Santa Ana, which made asbestos-containing joint compound used in drywall work.3Goldberg Segalla. Court Vacates $15M Verdict Against Joint Compound Manufacturer
- Ameron in Brea, Hamilton Materials and Hill Brothers Chemical in Orange, the Lido Shipyard and South Coast Co. in Newport Beach, Southern California Edison plants in Alamitos and Huntington Beach, Los Alamitos Naval Air Station, and various construction and auto body shops around the region.4Kazan Law. - Public schools: a 2015–2016 Orange County Grand Jury report found that more than two-thirds of the county’s roughly 600 public schools contained encapsulated asbestos, with the highest exposure risk occurring during modernization and renovation projects that disturbed intact materials.5Orange County Grand Jury. The One-Year Filing Deadline
California’s statute of limitations for asbestos injury claims runs one year from the later of two dates: when the patient first became disabled by the disease, or when the patient knew or reasonably should have known asbestos caused the disability. For wrongful death, the same one-year clock starts at the date of death or the date survivors learned asbestos contributed to it.6FindLaw. California Code of Civil Procedure Section 340.2 Because mesothelioma typically develops 20 to 50 years after exposure, the deadline can be triggered decades after someone last set foot in a plant, shipyard, or school building. Diagnosis date matters more than exposure date.
Where the Case Is Heard
Asbestos personal injury and wrongful death cases filed in Orange County are automatically classified as complex litigation and transferred to the Los Angeles County Superior Court under a coordinated proceeding, JCCP No. 4674.7Los Angeles County Superior Court. If the patient is elderly or seriously ill, counsel can request a preferential trial setting to move the case to trial faster. That request is common in mesothelioma matters given the disease’s prognosis.8Los Angeles County Superior Court. Claiming Against the W.R. Grace Trust
W.R. Grace filed for bankruptcy in 2001 and emerged in February 2014. The company is shielded from direct lawsuits, so claims from the Garnsey Street plant go to the WRG Asbestos PI Trust, which was initially funded with $3 billion.10WRG Asbestos PI Trust. WRG Asbestos PI Trust Homepage
As of late 2024, the trust had paid about $2.5 billion on more than 269,000 claims and held over $1.84 billion in remaining assets. The scheduled value for a mesothelioma claim is $180,000, but the trust pays a fraction of that figure. As of April 2025 the payment percentage was 30.1%, putting the current expedited review payout for a mesothelioma claim at roughly $54,180. Claimants choose between expedited review for straightforward filings (about 40% of claims) and individual review for more complex ones (about 60%). The trust maintains an Approved Site List identifying locations where qualifying exposure occurred.11Mesothelioma.com. W.R. Grace Asbestos Trust Fund
Multiple Trusts, Multiple Defendants
The Grace trust is one of more than 60 active asbestos bankruptcy trusts, which collectively hold over $30 billion. Patients whose exposure involved products from several companies often file against multiple trusts at once, with combined payouts typically landing between $300,000 and $400,000.12Asbestos.com. Asbestos Trust Funds Trust claims run in parallel with court cases against solvent defendants such as Kaiser Gypsum and other product manufacturers, so trust money does not foreclose a lawsuit.
What You Can Recover
California asbestos cases can produce economic damages (medical bills, lost wages), non-economic damages for pain and suffering, and in some matters punitive damages where evidence shows especially reckless corporate conduct. A spouse may bring a separate loss of consortium claim. If the patient dies before resolution, the family can continue the case as a survival action or file for wrongful death.13Lanier Law Firm. For claims filed between January 1, 2022 and January 1, 2026, California law lets survivors recover non-economic damages for the decedent’s pain and suffering before death, which was not previously available in survival actions.13Lanier Law Firm. Veterans
Veterans exposed to asbestos during service have a separate path through the VA. The PACT Act added asbestos-related illnesses as presumptive conditions for VA disability benefits, and veterans can apply for disability compensation and free VA health care, including screening with chest X-rays, CT scans, and breathing tests.14Fullerton Observer.
