Who Can Apply

New York Penal Law 400.00 sets the baseline eligibility. You must be at least 21 years old, unless you received an honorable discharge from a U.S. military branch or the New York National Guard, in which case the age minimum does not apply. You file in the county where you live, where you are principally employed, or where you maintain your principal place of business as a merchant or storekeeper.2New York State Senate. Noncitizens may apply if they are lawfully present in the United States and were not admitted under a nonimmigrant visa, with narrow federal exceptions.2New York State Senate. New York Penal Law 400.00 – Licensing and Other Provisions Relating to Firearms

What Disqualifies You

The statute names specific conditions that bar a permit. Knowing them before you apply saves you the non-refundable fees. You will be denied if you have a felony or serious offense conviction anywhere, or an outstanding felony warrant; if you use or are addicted to a controlled substance as defined under federal law; if you received a dishonorable discharge from the Armed Forces; if you renounced U.S. citizenship; if you were involuntarily committed under New York’s Mental Hygiene Law, Criminal Procedure Law, or similar laws of another state, or were the subject of a report under Mental Hygiene Law section 9.46; if a prior license was revoked or you are under a suspension order tied to domestic violence proceedings; or if a court appointed a guardian for you based on a finding that you lack capacity to manage your affairs.2New York State Senate. New York Penal Law 400.00 – Licensing and Other Provisions Relating to Firearms

For a concealed carry license, one more layer applies: you are disqualified if you were convicted within the past five years of third-degree assault, misdemeanor DWI, or menacing.2New York State Senate. New York Penal Law 400.00 – Licensing and Other Provisions Relating to Firearms

Premises License or Concealed Carry

Two license types cover most individual applicants. A premises license lets you have and possess a handgun in your home or, for merchants, in your place of business, but does not authorize public carry. A concealed carry license lets you have and carry a concealed handgun regardless of employment or location, subject to state and federal restrictions on where you can carry.2New York State Senate. New York Penal Law 400.00 – Licensing and Other Provisions Relating to Firearms Other license categories exist for gunsmiths, dealers, bank messengers, and certain court officers, but those track employer-specific rules outside the ordinary individual application.

The completed file goes to a County or Supreme Court judge for the final decision.1Town of Halfmoon. New York Penal Law 400.00 – Licensing and Other Provisions Relating to Firearms You have 90 days from the postmark date of the denial notice to file a written appeal. After You’re Approved

Adding or Removing Handguns

Every handgun you own must be listed on your permit. When you acquire a new pistol or revolver, file an amendment using the PPB-5 form before taking possession. The amendment moves through the County Clerk’s Office and requires the judge’s approval. Saratoga County’s County Clerk charges $5.00 for the transfer process.7County of Saratoga, New York. Pistol Permits The same process applies when you sell or otherwise dispose of a handgun. Your permit must reflect what you actually possess.

Recertification

New York requires all pistol permit holders to recertify periodically. Licenses issued after January 15, 2013 must be recertified before the five-year anniversary of issuance. Licenses issued before that cutoff must also recertify. Failure results in automatic revocation and a duty to surrender your firearms. Recertification runs through the New York State Police firearms portal or by mail, and confirms your name, date of birth, current address, and each handgun on your permit with make, model, and serial number. No live-fire is required at recertification.

Where You Can and Cannot Carry

A concealed carry license does not authorize firearms everywhere. The Concealed Carry Improvement Act designated a long list of “sensitive locations” that are off-limits even to licensed carriers:

  • Federal, state, and local government buildings, including courthouses
  • Public and private schools, colleges, universities, nursery schools, preschools, and licensed childcare
  • Hospitals, behavioral health providers, addiction treatment centers, and developmental disability facilities
  • Parks, playgrounds, zoos, libraries, and public transit
  • Theaters, stadiums, museums, amusement parks, concert halls, conference centers, and gaming facilities
  • Places of worship, except for designated security personnel
  • Bars and restaurants that serve alcohol, and cannabis consumption lounges
  • Polling places and public protests or gatherings3New York State. Frequently Asked Questions: New Concealed Carry Law

Private property is treated as a “restricted location” by default under the CCIA. You cannot bring a firearm onto someone else’s property unless the owner has posted signage permitting it or given express verbal consent.3New York State. Frequently Asked Questions: New Concealed Carry Law At the time of writing, the New York State Police are not enforcing this provision as to private property held open to the public, following a court ruling that questioned its constitutionality. That area of the law remains unsettled.

Don’t Possess Before You’re Licensed

Possessing a handgun without a valid permit is criminal possession of a firearm, a Class E felony under New York Penal Law 265.01-b.9New York State Senate. New York Penal Law 265.20 – Exemptions Charges escalate with the circumstances: possessing three or more firearms is a Class D felony, a loaded firearm outside your home or business is a Class C felony, and ten or more firearms is a Class B felony. A felony conviction ends any chance of ever obtaining a permit.

Limited exemptions apply to active-duty military, law enforcement, peace officers, and people participating in supervised live-fire training as part of the permit application process.9New York State Senate. New York Penal Law 265.20 – Exemptions There is no informal grace period for possession while your application is pending.
