The South Carolina 529 tax deduction lets you subtract 100% of what you contribute to the state’s Future Scholar plan or Tuition Prepayment Program from your South Carolina taxable income, with no annual dollar limit.1South Carolina Legislature. South Carolina Code Title 59 – Section 59-2-80 It’s one of the most generous state 529 benefits in the country, but it comes with rules that catch people off guard: it only applies to South Carolina’s own plans, contributions after year-end can still count for the prior year, and pulling money out for the wrong reason claws the deduction back.
Which Plans Qualify
Only two programs qualify: the South Carolina College Investment Program (marketed as Future Scholar) and the South Carolina Tuition Prepayment Program.2South Carolina Legislature. If you already have money in another state’s plan, there is a workaround. You can roll those funds into a Future Scholar account, and the transferred amount becomes deductible on your SC return. The statute treats “funds transferred to an investment trust account from another qualified plan” as eligible, provided you didn’t already take a state tax deduction on those contributions elsewhere.1South Carolina Legislature. Who Can Claim It
Any South Carolina resident or nonresident who files an SC income tax return can deduct contributions they personally make to a Future Scholar account.1South Carolina Legislature. South Carolina Code Title 59 – Section 59-2-80 You do not have to own the account. A single beneficiary can have several people contributing, and each contributor takes their own deduction, so long as the combined balance for that beneficiary stays under the plan’s $575,000 maximum.
Contribution Deadline
The statute is more forgiving than most people assume. You don’t have to fund the account by December 31. Contributions made up to April 15 of the following year, or your state return’s due date if later, count for the prior tax year’s deduction.1South Carolina Legislature. South Carolina Code Title 59 – Section 59-2-80 A contribution made on March 1, 2027, can be applied to your 2026 return. That extra window is useful when a year-end bonus lands late or you realize in February that your taxable income was higher than expected.
No Dollar Cap, With Carryforward
There is no annual cap on the deduction. Every dollar you contribute is deductible, whether the check is $500 or $50,000.4SC Office of the State Treasurer. 529 Updates in One Big Beautiful Bill Give South Carolina Families Even More Flexibility for Educational Savings The practical ceilings are the $575,000 account balance limit per beneficiary and your own taxable income.
If a contribution exceeds your SC taxable income for the year, the deduction cannot push your tax below zero. The unused portion carries forward indefinitely until it’s fully used. Contribute $80,000 to front-load a grandchild’s account with $45,000 of taxable income, and the remaining $35,000 rolls into the next year, and the year after that if needed.
South Carolina does not issue a statement tracking your carryforward. You keep the records. Hold on to your Future Scholar contribution confirmations with your filed returns so you know how much unused deduction remains.
What the Deduction Is Worth
The dollar value depends on your marginal SC income tax rate. The legislature has been cutting rates and passed a restructured bracket system for tax year 2026 with a top rate below the 6.5% rate that applied in 2024.5South Carolina Legislature. 2025-2026 Bill 4216 – Income Tax Check the South Carolina Department of Revenue for the current rate before you plan a large contribution. As a rough gauge, a 5% marginal rate turns a $10,000 contribution into $500 of state tax savings; a 6% rate turns it into $600.
Claiming It on Your Return
The 529 deduction is a state adjustment only. It does not affect your federal return. You report it on Schedule I (Adjustments to Income), which accompanies the SC 1040.3South Carolina Department of Revenue. Enter the lesser of your total eligible contributions for the year (including any carryforward from prior years) or your available SC taxable income. You do not submit contribution statements with the return, but keep them. Future Scholar account statements showing the date and amount of each contribution are what the Department of Revenue would ask for in an audit.
Recapture: When the Deduction Gets Clawed Back
If you withdraw money from a Future Scholar account for something other than a qualified education expense, South Carolina claws back the tax benefit. The principal portion of that non-qualified withdrawal is added back to your SC taxable income in the year of the distribution, to the extent it was previously deducted.6South Carolina Department of Revenue. Qualified expenses at the federal level include college tuition, fees, books, supplies, equipment, and room and board for at least half-time students; up to $20,000 per beneficiary per year of K-12 tuition (raised from $10,000 under the One Big Beautiful Bill Act, effective January 1, 2026); registered apprenticeship program costs; and up to $10,000 lifetime toward the beneficiary’s student loans.7Office of the Law Revision Counsel. 26 USC 529 – Qualified Tuition Programs4SC Office of the State Treasurer. 529 Updates in One Big Beautiful Bill Give South Carolina Families Even More Flexibility for Educational Savings8Internal Revenue Service. Out-of-State Rollovers Trigger Recapture
Rolling money from a Future Scholar account to another state’s 529 plan is not a qualified withdrawal under South Carolina law.1South Carolina Legislature. South Carolina Code Title 59 – Section 59-2-80 The transfer triggers recapture on any previously deducted principal, just as if you had taken cash out for a non-education purpose. This is an easy trap if you move out of state and want to consolidate accounts. The reverse works in your favor: rolling from another state’s plan into Future Scholar creates a fresh deductible contribution.
When Recapture Doesn’t Apply
Recapture only reaches deductions you actually claimed. If you contributed money that you haven’t yet deducted because your income was too low and the carryforward hasn’t been used, a non-qualified withdrawal of that amount does not generate recapture income. Qualified withdrawals for education expenses, Roth IRA rollovers that meet the rules below, and beneficiary changes to another family member do not trigger recapture either.
Rolling Unused 529 Funds Into a Roth IRA
Starting in 2024, the SECURE 2.0 Act opened a path to move unused 529 money into a Roth IRA for the beneficiary without federal taxes or penalties. South Carolina treats qualifying rollovers to a Roth IRA as qualified withdrawals, so they do not trigger deduction recapture.6South Carolina Department of Revenue. The federal conditions are strict:
- The 529 account must have been open for the beneficiary for at least 15 years.
- Only contributions (and their earnings) made at least 5 years before the rollover are eligible.
- No more than $35,000 total can be rolled over per beneficiary in their lifetime.
- Each year’s rollover counts toward the beneficiary’s Roth IRA annual contribution limit, which is $7,500 for 2026.
Rollovers beyond those limits are treated as non-qualified withdrawals and trigger both federal taxes and South Carolina recapture on the excess.6South Carolina Department of Revenue. Superfunding and the SC Deduction
Contributions to a 529 count as gifts for federal gift tax purposes. In 2026 the annual gift tax exclusion is $19,000 per recipient.9Internal Revenue Service. Whats New – Estate and Gift Tax A married couple can each give $19,000 to the same beneficiary ($38,000 total) without any gift tax filing.
Families who want to front-load an account can use a special election to contribute up to five years’ worth of the annual exclusion at once and spread the gift over five years for tax purposes. For 2026, an individual can contribute up to $95,000 in one year (or $190,000 for a married couple) to one beneficiary without using any lifetime gift tax exemption.10Internal Revenue Service. Because South Carolina’s deduction has no annual cap, a $95,000 superfunding contribution is fully deductible on your SC return in the year you make it, with any excess over your taxable income carrying forward. The five-year gift tax spreading is a federal calculation only; it does not slow down the state deduction. If the contributor dies during the five-year election period, the portion allocated to years after death is added back to their estate, and you cannot make additional 529 gifts to that same beneficiary until the five-year window closes.
