SC Real Estate License Reciprocity: States, Rules, and Exemptions

South Carolina real estate license reciprocity is narrow: the state has formal agreements with only two others, Georgia and North Carolina. If you hold an active license in either, you can skip most of South Carolina’s pre-licensing education and, in Georgia’s case, the exam itself. Everyone else has to complete the full 90-hour pre-licensing course before applying, though many out-of-state licensees can still skip the national portion of the exam. The South Carolina Real Estate Commission, housed within the Department of Labor, Licensing and Regulation, runs all of these pathways.1South Carolina Department of Labor, Licensing and Regulation. Which States Have Reciprocity With South Carolina

Only Georgia and North Carolina.2South Carolina Real Estate Commission. South Carolina Real Estate Commission – Applications and Requirements The authority for these agreements is SC Code Section 40-57-120, which lets the Commission recognize applicants from jurisdictions that also recognize active South Carolina licenses and whose regulators have signed a reciprocal agreement.3South Carolina Legislature. South Carolina Code 40-57-120 – Nonresident Licensees; Change in Residency; Referral Fees by Resident Licensees The statute allows the Commission to waive education, experience, or examination when it considers another state’s standards substantially equivalent.

No other states qualify. Older lists that include West Virginia or any other state are out of date; the Commission publishes the current agreements, with the signed documents, on its own site.

Georgia vs. North Carolina: What Each Agreement Actually Waives

The two agreements are not identical, and the difference decides how much preparation you need.

Georgia gets the broader deal. A Georgia licensee is not required to take any portion of the South Carolina exam. It is the only license that transfers in without an examination at all.

North Carolina licensees get pre-licensing education waived and the national portion of the exam waived, but they still have to sit for and pass the South Carolina state portion. The state portion covers South Carolina-specific material: agency relationships, trust accounts, and Commission regulations.

What Still Applies Even With Reciprocity

Reciprocity removes education and, for Georgia, the exam. It does not remove the administrative and screening steps. Whichever pathway you use, you will:

Fingerprinting is handled through IdentoGO. Get it done early: background check results have a limited validity window, and delays can force you to redo them. Providing false information or failing to disclose relevant criminal history can result in denial.

Once the Commission approves your application, PSI (the exam vendor) is notified within about 48 hours, and you schedule and pay for any required exam directly with PSI.2South Carolina Real Estate Commission. South Carolina Real Estate Commission – Applications and Requirements After your application is approved, you have one year to complete the remaining requirements.

One more constraint worth flagging: the reciprocity statute is a nonresident pathway. If you move to South Carolina before applying, you lose it and become subject to the full resident requirements, including the 90-hour course and both exam portions.3South Carolina Legislature. If You Are Licensed In Any Other State

Every other state falls outside reciprocity. You will need to complete South Carolina’s 90-hour pre-licensing education, split into two units. You have to finish at least the first 60-hour unit before submitting your application.

There is still one useful benefit. If you currently hold an active license in another jurisdiction, or your license there expired within the previous six months, you can generally sit for only the state portion of the South Carolina exam rather than both portions. The national portion covers material you have already been tested on, so this shortens your prep. The pre-licensing coursework, however, is not waived.

To summarize what portion of the exam applies to whom:

  • Georgia reciprocity: no exam.
  • North Carolina reciprocity: state portion only.
  • Any other state, active license or expired within the last six months: state portion only.
  • Everyone else: national and state portions.

Military Spouse Fast Track

South Carolina runs an expedited licensing pathway for military spouses under SC Code Section 25-1-170. If you are married to and living with an active-duty service member stationed in South Carolina under official orders, and you hold a valid real estate license in good standing from another state, the Commission must issue your license within 15 business days of receiving a complete application. To qualify, your home-state license must be free of disciplinary actions, pending investigations, or grounds for suspension; your home state’s requirements must be equal to or greater than South Carolina’s; and you must complete any required background check. A license issued this way follows the regular biennial renewal cycle.

What Changes Once You Are Licensed as a Nonresident

You are not required to maintain a physical office in South Carolina, as long as you keep an active place of business in your home state.3South Carolina Legislature. South Carolina Code 40-57-120 – Nonresident Licensees; Change in Residency; Referral Fees by Resident Licensees You do have to file an irrevocable consent allowing lawsuits against you in South Carolina courts for causes of action arising in the state.

If your residency later changes, tell the Commission in writing within 30 days. That deadline runs both ways: a resident licensee who moves out of state must notify the Commission and either switch to nonresident status or place the license on inactive status. Failure to report a residency change is a violation under Section 40-57-710.

Continuing Education for Nonresident Licensees

South Carolina licenses renew every two years, and the standard renewal requires 10 hours of continuing education per cycle, with at least four hours in mandated topics; the renewal fee is $130.5South Carolina Legislature. South Carolina Code 40-57-340 – Conditions for License Renewal; Background Checks; Continuing Education; Exemptions

Nonresident licensees can request an exemption. Under Section 40-57-340, a nonresident broker or associate who has met the continuing education requirements of their home state may be exempted with the Commission’s approval.5South Carolina Legislature. South Carolina Code 40-57-340 – Conditions for License Renewal; Background Checks; Continuing Education; Exemptions Georgia residents licensed in South Carolina can self-report the exemption through CE Broker, the Commission’s tracking provider.6South Carolina Real Estate Commission. South Carolina Real Estate Commission – Continuing Education The exemption is not automatic for every state; the Commission has discretion, and your home state’s requirements should be comparable. Keep proof of your home-state CE completion in reach when you renew.

Every third renewal also requires a new criminal background check using the same SLED, FBI, and Social Security number-based process as the initial application, so budget for that cost roughly every six years.5South Carolina Legislature.
