SCAQMD Rule 1403: Asbestos Surveys, Notifications, and Penalties

The South Coast Air Quality Management District’s Rule 1403 governs how asbestos is handled during demolition and renovation across the South Coast Air Basin, which covers all of Orange County and the urban portions of Los Angeles, Riverside, and San Bernardino counties.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities2South Coast AQMD. Map of Jurisdiction If your project falls inside that footprint, you have to survey for asbestos before starting, notify the district at least 10 working days ahead, follow specific containment and wetting practices during removal, and track every waste shipment from the site to the landfill. Skipping any of those steps can stop the job and expose you to civil or criminal penalties.

Which Projects Trigger Rule 1403

The rule reaches two kinds of work. Demolition means removing any load-bearing structural member or intentionally burning a structure. Renovation covers any alteration to a building or its components, including stripping asbestos-containing materials, retrofitting fire protection, and installing or removing HVAC equipment.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

“Facility” is defined broadly and includes any institutional, commercial, public, industrial, or residential structure, any ship, and any active waste disposal site. Unlike the federal asbestos NESHAP, which exempts residential buildings with four or fewer dwelling units, Rule 1403 applies to residential property regardless of unit count.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities3eCFR. 40 CFR 61.141 – Definitions A duplex renovation in Riverside is treated the same as a high-rise remodel in Los Angeles.

Asbestos-containing material is anything with more than one percent asbestos by weight. The rule regulates friable material and Class I nonfriable material most heavily; Class II nonfriable material carries fewer requirements but still triggers the rule if it becomes friable or gets ground, cut, or abraded. In practice, treat any material you plan to disturb as regulated until lab analysis proves otherwise.

Narrow Exemptions

The rule carves out a few small exceptions:1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

  • An owner-occupant of a single-unit dwelling who personally performs the renovation. Hiring a contractor eliminates the exemption.
  • Non-scheduled renovations disturbing less than 100 square feet of ACM are exempt from notification and training. A survey is still required unless the site is a single-unit dwelling.
  • Planned renovation programs that remove less than 100 total square feet within a calendar year are also exempt from notification and training.
  • Removal of asbestos-containing packings, gaskets, resilient floor coverings, and asphalt roofing products that have not become friable and have not been sanded, ground, cut, or abraded is exempt from isolation, HEPA ventilation, and training requirements.

No exemption exists for demolition. Every demolition requires a full survey and notification regardless of size or building type.

The Pre-Work Asbestos Survey

Before anything is physically disturbed, the facility has to be surveyed. Age of the building and personal certainty that no asbestos is present are irrelevant. The survey must identify, inspect, and quantify all friable, Class I nonfriable, and Class II nonfriable ACM in the affected area.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

The surveyor must hold a Cal/OSHA Certified Asbestos Consultant credential and must have passed an EPA-approved Building Inspector course.4Division of Occupational Safety and Health. Asbestos Consultants and Site Surveillance Technicians A thorough survey samples all suspected materials, going down through every layer of flooring to the joist level and into wall and ceiling cavities. Samples are analyzed by Polarized Light Microscopy following EPA Method 600/R-93/116.5National Institute of Standards and Technology. Method for the Determination of Asbestos in Bulk Building Materials

The report has to document the surveyor’s qualifications, dates of the survey, all suspected materials and samples, a sketch of sample locations, lab credentials, test methods, and the facility’s general condition including any fire or structural damage. Everything that follows, from the district notification to the abatement plan to the final waste records, ties back to this document.

Notifying the District

Any planned demolition or renovation involving ACM must be reported to the district. Standard notifications must be submitted at least 10 working days before work begins, and the job cannot legally start until that window has passed.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

The notification must include the exact start and completion dates for both the asbestos removal phase and the overall project, facility details like age, size, and current use, the credentials of the asbestos consultant and abatement contractor, precise measurements of the material to be disturbed (linear feet for pipes, square feet for surfaces, cubic feet for off-component material), and the name and location of the landfill that will receive the waste.

A notification submitted less than 14 calendar days before the start date triggers a special handling fee and does not waive the 10-working-day requirement.6South Coast Air Quality Management District. Rule 1403 Asbestos Fees File late and the project timeline slips.

Filing and Fees

Notifications go through the district’s web-based application. Mail, fax, and email submissions from contractors are not accepted.7South Coast AQMD. Rule 1403 Notification Web Application Before your first filing, you have to register with the district: get a Facility ID by calling the Asbestos Hotline at (909) 396-2336, complete a Subscriber’s Agreement signed before a notary, and mail the registration package in for verification. Build time for this into your project planning.

Notification fees scale with project size. Under the Fiscal Year 2023–2024 schedule, they range from $81.61 for jobs up to 1,000 square feet to $2,212.92 for jobs over 100,000 square feet.6South Coast Air Quality Management District. Rule 1403 Asbestos Fees For demolition the fee is based on the building footprint; for renovation it is based on the amount of asbestos removed. Revising start or end dates costs $30.22, late-filed notifications carry an $81.61 special handling fee, and Procedure 4 or 5 alternative work plan evaluations cost $916.15. Confirm the current schedule with the district before filing.

Emergency Renovations

Rule 1403 recognizes emergency renovations, but the definition is narrow. The event must be sudden and unexpected and it must create a genuine safety hazard or threaten equipment damage. Economic pressure alone does not qualify.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

The 10-working-day advance period is waived, but the district still has to be notified before any work begins. The emergency notification must include the name and phone number of the person in charge, the date and time of the emergency, a description of the event, an explanation of the unsafe condition it created, and a signed letter from the owner or manager attesting to the circumstances. Every other work practice, containment procedure, and waste handling requirement still applies in full.

Work Practices on the Job Site

Once the notification period has elapsed, the removal itself is governed by detailed containment and handling standards.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

Wetting and Containment

All ACM must be kept adequately wet during removal, meaning saturated enough to prevent any visible emissions. Wetting is done with a fine, low-pressure spray, and the material stays wet until it is sealed in a container. For nonfriable material, adequate wetting must be maintained while it is cut, dismantled, and removed from building components.

Friable ACM removal inside a building requires an isolated work area with negative air pressure vented through a HEPA filtration system that runs continuously from the start of removal through final cleanup. The HEPA filter must be intact and seated tightly in its frame.

Waste Packaging and Visible Emissions

All asbestos waste must be collected in transparent, leak-tight containers or wrapping. When containers are not in active use, they must be stored inside an enclosed area. Federal OSHA rules require every container to carry a warning label identifying the hazardous contents.8Occupational Safety and Health Administration. Labeling and Waste Disposal Requirements for Glovebags in OSHA Asbestos Standard for Construction

A no-visible-emissions standard applies to the site at all times. If dust or debris from the work area can be seen escaping, the operation is in violation. Visible emissions are the single most common trigger for enforcement action.

Tracking Waste to Disposal

Every shipment of asbestos waste requires a Waste Shipment Record listing the generator’s name and contact information, quantity of waste in cubic meters or cubic yards, the transporter’s information, the disposal site’s name and location, the transport date, and a signed certification that the waste is properly classified and packaged for highway transport.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

A copy travels with the waste to the disposal site, where the operator signs to confirm receipt. If the signed copy does not come back within 35 days, you have to contact the transporter and disposal site. If it still has not arrived after 45 days, you must submit a written report to the district describing your efforts to track down the shipment. Losing sight of a load creates a documentation gap the district takes seriously.

Records to Keep

Owners and operators must keep project records for at least three years after completion and produce them for the district on request. That set includes the full survey report with lab results and sample maps, all submitted notifications and amendments (with the most recent version kept on-site during the project), signed Waste Shipment Records, any district-approved Procedure 4 or 5 alternative work plans, and training certificates and annual reaccreditation records for supervisors and workers.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

For renovations involving less than 100 square feet of ACM, a streamlined record set applies: the survey, an estimate of the amount removed, a description of the removal controls used, and Waste Shipment Records. Storage facilities and active disposal sites have parallel three-year retention obligations of their own.

Who Can Perform the Work

Everyone who removes asbestos on a Rule 1403 project must be properly trained. Workers handling friable ACM and Class I nonfriable material must complete an EPA-approved initial course of 32 to 40 hours depending on the accredited provider, followed by annual refresher training.9US EPA. Asbestos Training Certificates and reaccreditation records stay on-site during the project and are retained for three years afterward.1South Coast Air Quality Management District. Rule 1403 – Asbestos Emissions From Demolition/Renovation Activities

The training exemption for certain nonfriable products is narrower than most people assume. It applies only to the removal of asbestos-containing gaskets, packings, resilient floor coverings, and asphalt roofing products that have stayed intact and have never been sanded, ground, cut, or abraded. The moment those materials are damaged or mechanically altered, the full training requirements come back into play.

Penalties

District inspectors visit active sites and respond to complaints. Common violations include starting work without a notification, failing to keep material wet, visible emissions from the work area, and missing or incomplete records.

Because Rule 1403 implements the federal asbestos NESHAP, violations can also be prosecuted under the Clean Air Act. Federal criminal penalties apply when an owner or operator knowingly fails to follow work practice or waste disposal standards on projects involving at least 260 linear feet of pipe, 160 square feet of other building components, or 35 cubic feet of off-component material. A conviction carries up to five years in prison and fines, with penalties doubled for a second offense.10US EPA. Criminal Provisions of the Clean Air Act Even below the criminal threshold, civil penalties and stop-work orders can add tens of thousands of dollars to a project and months of delay.
