Schenectady County Pistol Permit: Eligibility, Training, and Fees

To get a Schenectady County pistol permit, you apply under New York Penal Law Section 400.00 through the County Sheriff’s Office and the County Clerk, with final approval from a licensing judge. Expect to complete a firearms safety course (for concealed carry), gather four character references, be fingerprinted, sit for a background investigation, meet with the judge in person, and pay roughly $130 in county fees. Plan on several months from start to finish.

Who Can Apply

You must be at least 21 years old. The only exception is for people honorably discharged from a branch of the United States military or the New York National Guard, who face no age restriction.1New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms

Every applicant also has to show “good moral character,” which the statute defines as the temperament and judgment needed to handle a firearm without endangering yourself or others.1New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms The character references, background investigation, and judicial interview all feed into that finding, and the judge has real discretion.

You generally need to live in Schenectady County or have your principal place of business here to file locally. New York law does not make residency a hard eligibility bar for a license, and licensing officers have authority to accept applications from nonresidents.2New York State. What Will Disqualify You

A felony conviction or a “serious offense” under New York law makes you ineligible. Certain misdemeanors also disqualify you, including domestic violence offenses. Under the federal Lautenberg Amendment, anyone convicted of a misdemeanor crime of domestic violence is prohibited from possessing firearms or ammunition, regardless of when the conviction occurred.3U.S. Marshals Service. Lautenberg Amendment

Federal law also prohibits anyone who is an “unlawful user of or addicted to” a controlled substance from possessing firearms. Marijuana remains a controlled substance under federal law, so this applies even if you use marijuana legally under New York state law. Answering the drug-use question dishonestly on ATF Form 4473 is itself a federal crime. This catches people off guard given New York’s legalization of recreational marijuana.

Other federal bars include being subject to a domestic violence restraining order, having been involuntarily committed to a psychiatric facility, being under felony indictment, or having renounced U.S. citizenship. The FBI’s National Instant Criminal Background Check System screens for these categories when your application is processed.4Federal Bureau of Investigation. Firearms Checks

Decide Which Permit You’re Applying For

New York issues two main types of pistol license, and your choice shapes the training requirement and the recertification cycle. A “have and possess” license (often called a premises permit) lets you keep a handgun at a specific location, such as your home or business. A “have and carry concealed” license lets you carry a handgun on your person outside the home.2New York State. Frequently Asked Questions: New Concealed Carry Law

Complete Firearms Training First (Concealed Carry)

If you are applying for a concealed carry license, you must complete the state-mandated firearms safety training course before you submit your application. The course is 16 hours of in-person classroom instruction plus 2 hours of live-fire range training, both taught by a state-authorized instructor.2New York State. The State Police set the curriculum, which covers storage requirements, state and federal gun laws, disqualifying offenses, de-escalation, the legal standards for deadly force and the duty to retreat, encounters with law enforcement, suicide prevention, sensitive locations, and the rules for carrying on private property.5New York State Police. Include it in your packet and keep a copy for yourself, since you may need it at your interview or judicial review.

Four Character References

The application requires at least four character references who can speak to your moral character and confirm you have not made statements or taken actions suggesting you would harm yourself or others.1New York State Senate. You do not see the reference forms, and your references mail their responses directly to the Sheriff’s Office. Fingerprinting at the Sheriff’s Office

You submit your completed application, supporting documents, and fingerprints together at the Schenectady County Sheriff’s Office. Fingerprinting is walk-in: Tuesdays and Wednesdays from noon to 2:00 PM, and Thursdays from 6:00 PM to 8:00 PM. The fee is $116.50, payable only by money order made out to Schenectady County. The Sheriff’s Office does not accept cash, checks, or credit cards.7Schenectady County. What Happens After You Apply

The Sheriff’s Office conducts a background investigation that includes verifying your references and reviewing your history. When that is complete, the file goes to the licensing judge.

Every Schenectady County applicant must meet with the judge in person before a permit is issued. This is not a formality. The judge reviews the investigation findings and exercises discretion in deciding whether to issue the license.7Schenectady County. If the judge approves, the file returns to the County Clerk, which contacts you by mail to schedule a separate appointment for issuance. Your physical permit card is printed and handed to you at that appointment. A $15 fee is due then, payable by cash or personal check. If you are adding more than one handgun to your permit at issuance, there is an additional $3 per handgun.7Schenectady County. Schenectady County Pistol Permit Application Instructions

Timelines depend on application volume and the complexity of your background check. Plan on several months at minimum, and don’t be surprised if it takes longer.

What It Costs

The mandatory training course is a separate cost paid to your instructor and is not included in the county fees. Prices vary by provider.

Keeping Your Permit Current

Your permit does not stay valid indefinitely. Concealed carry permit holders must recertify every three years. Premises permit holders recertify every five years.9New York State. Pistol Permit Recertification

Recertification is online only through the State Police system; paper forms are no longer accepted. You will provide your name, address, date of birth, New York driver license or non-driver ID number, and a current inventory of all pistols and revolvers on your license. You must also affirm that you are not currently prohibited from possessing firearms. The process is complete when you receive a recertification number.9New York State. Pistol Permit Recertification

Separately, when you acquire a new handgun you must file an amendment with the County Clerk to add it to your permit. Bring documentation showing the make, model, caliber, and serial number. Private sales between individuals require a background check conducted through a licensed dealer, who can charge up to $10 for the service.6Schenectady County. Pistol Permits

If you move, you must give written notice of your new address within 10 days and record the change on the back of your license. Outside New York City, Nassau County, and Suffolk County, that notice goes to the New York State Police Division headquarters in Albany.1New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms Failing to update your address can lead to suspension or revocation.

If You Are Denied

A denial is not necessarily the end. New York provides an administrative appeal, and you generally have 90 days from the date of the denial notice to file a written appeal with the licensing authority. The reviewing officer can either overturn the denial or uphold it.

If the administrative appeal fails, you may file an Article 78 proceeding in State Supreme Court. The filing deadline is typically four months (120 days) from the date you receive the final administrative determination. An Article 78 proceeding is a real court case, and having an attorney at that stage makes a meaningful difference.

Where the Permit Does Not Let You Carry

A Schenectady County permit is not blanket permission to carry everywhere. New York’s Concealed Carry Improvement Act created an extensive list of “sensitive locations” where carrying is prohibited even with a valid concealed carry license, including government buildings, healthcare facilities, places of worship, libraries, parks, playgrounds, zoos, schools at every level, child and family service programs, shelters, and public transportation. Violating these restrictions is a criminal offense.10New York State Senate. On private property, the default rule flipped. You may only bring a firearm onto another person’s property if the owner or occupant has posted clear signage allowing it or has given express verbal consent.2New York State. Frequently Asked Questions: New Concealed Carry Law The State Police have noted that due to a court ruling, this provision is not currently being enforced with respect to private property held open to the public. The legal picture here is still shifting, so check for updates before you rely on it.

Your Schenectady County permit is valid throughout New York State, but no other state is required to honor it, and New York has no reciprocity agreements with any other state for concealed carry. If you plan to travel out of state with your handgun, research the destination’s rules before you go.
