Schoharie County Sales Tax: 8% Rate, Exemptions, and Use Tax

The sales tax rate in Schoharie County is 8%, made up of New York’s 4% state sales tax and a 4% local tax imposed by the county. That combined rate applies at the register for most retail purchases in the county, from a hardware store lawnmower to a car repair bill.

How the 8% Breaks Down

New York charges a baseline 4% state sales tax on retail sales of tangible personal property and certain services.1New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax Tax Law Section 1210 lets counties add their own local rate on top.2New York State Senate. New York Code TAX – Taxes of Cities and Counties Administered by State Tax Commission Schoharie County levies the full 4% local portion, which sits above the standard maximum allowed under Section 1210 alone and depends on separate state legislative authorization that gets renewed periodically. Every vendor in the county charges the full 8% on taxable sales.

What the 8% Applies To

The tax reaches most tangible personal property sold at retail: furniture, electronics, motor vehicles, building materials, and similar goods. It also covers paid services performed on your property, including installation, maintenance, repair, fabrication, and processing work.1New York State Senate. What’s Exempt

Several categories are exempt from both the state and local portions of the tax:

  • Unprepared groceries. Food and beverages sold for human consumption are exempt. Candy, soft drinks, fruit drinks with less than 70% natural juice, and alcoholic beverages are not.
  • Drugs and medicine. Prescription and over-the-counter medications are exempt, including pain relievers, antacids, and cough remedies.3New York State Department of Taxation and Finance. Drugstores and Pharmacies
  • Medical equipment and supplies required to treat illness or correct a physical incapacity, along with products consumed to preserve health. Cosmetics don’t qualify.4New York State Senate. New York Tax Law 1115 – Exemptions From Sales and Use Taxes

Clothing Under $110: Only Partly Exempt

This one trips people up. New York State exempts clothing and footwear priced under $110 per item from the 4% state sales tax, but Schoharie County has not extended that exemption locally.6New York State Department of Taxation and Finance. Clothing and Footwear Exemption So a $50 pair of shoes still gets charged the 4% county tax at a Schoharie register, even though the state portion drops off. Clothing priced at $110 or more gets the full 8%.7New York State Department of Taxation and Finance. Publication 718-C Sales and Use Tax Rates on Clothing and Footwear

Garage Sales

Selling personal belongings from home doesn’t trigger sales tax as long as all three conditions are met:

  • You hold sales at your residence no more than three days in a calendar year. The limit doesn’t apply to anyone under 16.
  • Neither you nor anyone in your household sells similar items as a trade or business.
  • Your total receipts can reasonably be expected to stay under $600 for the year.

Cross any of those lines and you have to collect the full 8% and remit it within 20 days using a report of casual sale. Boats, snowmobiles, and motor vehicles are never covered by this exemption, regardless of price or frequency.8New York Codes, Rules and Regulations. Sales at Private Residences

When You Owe Use Tax

If you buy something from an out-of-state seller who doesn’t collect New York tax and then use the item in Schoharie County, you owe compensating use tax at the same 8% rate. This comes up most often with online purchases from smaller retailers, items bought while traveling, and goods shipped from sellers without a New York presence. Most large online retailers already collect the full 8% at checkout, so the gap tends to involve smaller sellers.

Residents report use tax on their New York personal income tax return (Form IT-201, line 59). The state publishes a simplified chart based on adjusted gross income for purchases under $1,000 each, so you don’t need to keep every receipt. For any single item of $1,000 or more, you calculate the exact amount on Form ST-141.9New York State Department of Taxation and Finance.
