Sherry Ballard, Bardstown KY: Crystal Rogers Act and Lawsuit

Sherry Ballard of Bardstown, Kentucky, is the mother of Crystal Rogers and the widow of Tommy Ballard, and over the past decade she has become one of the state’s most visible victims’ advocates. After her daughter disappeared in July 2015 and her husband was shot to death sixteen months later, Ballard pushed law enforcement, sat through every day of a murder trial, lobbied for a new state law, and pursued a civil case against her daughter’s killer. Her work has helped produce three criminal convictions, a life sentence, and a Kentucky statute now known as the Crystal Rogers Act.¹

The Disappearance That Started It

Crystal Rogers, 35, was last seen on the evening of July 3, 2015, at a Nelson County farm owned by the family of her boyfriend, Brooks Houck. Her phone went dark at roughly 9:27 p.m. and was never reactivated.²³⁴

Rogers has never been found. The FBI continues to seek information about the location of her remains.⁵³⁴

Tommy Ballard’s Killing

On November 19, 2016, roughly sixteen months after Crystal vanished, Sherry Ballard’s husband Tommy was shot and killed on family property near the Bluegrass Parkway. He was preparing for a hunting trip with his 12-year-old grandson when a single gunshot struck him in the chest. Local police initially called it a hunting accident. The Ballard family rejected that account, and the FBI later classified the death as a homicide.⁶⁷

Tommy Ballard had founded “Team Crystal,” a community group dedicated to keeping his daughter’s case in the public eye.⁶⁸⁹ As of mid-2026, no one has been charged. The family has offered a $50,000 private reward for information.⁷

The Convictions

A Nelson County grand jury indicted Brooks Houck for murder in September 2023. Two co-defendants, Joseph Lawson and his father Steve Lawson, were charged for their roles in the crime.

Steve Lawson was tried separately. He admitted helping his son move Crystal Rogers’ vehicle and was convicted of conspiracy to commit murder and tampering with physical evidence, receiving a 17-year sentence in August 2025.¹⁰

The joint trial of Brooks Houck and Joseph Lawson opened June 24, 2025, in Warren County after a change of venue, and ran for ten days. Prosecutors called more than 50 witnesses and built the case on cellphone data, surveillance footage, and recorded interrogations. On July 7, 2025, the jury convicted Houck of murder as a principal or accomplice and complicity to tamper with physical evidence. The next day, it convicted Joseph Lawson of conspiracy to commit murder and tampering with physical evidence.¹⁰¹¹¹²

On September 17, 2025, Nelson Circuit Judge Charles Simms III sentenced Houck to life in prison, with parole eligibility after 85 percent of the sentence. Joseph Lawson received 25 years. Both Houck and the Lawsons are appealing. Houck’s appeal, filed with the Kentucky Supreme Court in January 2026, argues that no body or murder weapon was ever produced, that the trial judge should have recused himself, and that errors in jury selection and evidence admission tainted the proceedings. Kentucky Attorney General Russell Coleman filed a response brief in May 2026 urging the court to uphold the conviction.¹¹¹³

How Ballard Has Advocated

After losing her daughter and then her husband, Sherry Ballard expanded the role Tommy Ballard had built with Team Crystal. She has described the decade since Crystal’s disappearance as a stretch of “hope, tears, anger and unanswered questions,” and she turned that into steady public pressure on investigators and the courts.¹

She attended every day of the murder trial, seated in the same courtroom as members of the Houck family, whom prosecutors repeatedly identified as unindicted co-conspirators. She later said: “I just hold my head up and I think I’m going to do this and I’m not going to let that family get to me and intimidate me.” When the guilty verdicts came down in July 2025, supporters wearing pink met her outside the Bardstown courthouse, a scene she said “still makes me cry today.”¹

At sentencing, Ballard addressed Brooks Houck directly: “Tell me where my daughter is. That’s your forgiveness.” She told the court she would attend every one of Houck’s parole hearings and pledged to “bring an army with me if that’s what it takes to keep you behind bars.”¹¹

Ballard raised Crystal Rogers’ four other children, but she was denied visitation with the son Crystal shared with Brooks Houck. The Kentucky Court of Appeals revoked previously granted visitation in 2018, and in 2021 a judge found “clear and convincing evidence” that hostility between the Ballard and Houck families posed a risk of emotional harm to the child. After Houck’s 2023 arrest, Ballard sought custody in Nelson County court. In September 2025, a judge granted full permanent custody to Houck’s sister, Rhonda McIlvoy, who had served as temporary custodian since 2023.¹⁴¹⁵

The Crystal Rogers Act

During the investigation, evidence surfaced that Rhonda McIlvoy had allegedly worn a hidden recording device during her grand jury testimony, acting on advice from Brooks and Nick Houck. Because the statute of limitations was only one year, no criminal charges could be filed for the recordings.¹⁶

Kentucky Representative Candy Massaroni of Bardstown responded with House Bill 305, the Crystal Rogers Act. The bill extended the statute of limitations for secretly recording grand jury proceedings from one year to ten years, and extended the limitations period for unlawfully sharing grand jury testimony from one year to five years. It passed the Kentucky House 93-0 in February 2026, cleared the Senate 38-0 in March, and was signed into law on April 13, 2026.¹⁷

The Wrongful Death Lawsuit

In late 2023, Ballard filed a wrongful death suit against Brooks Houck in Nelson Circuit Court on behalf of Crystal Rogers’ estate and her four children. The suit seeks damages including lost earnings, funeral and administrative costs, and compensation for Rogers’ pain and suffering before her death.¹⁸ After Houck’s murder conviction, the plaintiffs’ attorney argued that a trial is only necessary to set the amount of damages, because the criminal verdict has established liability.

In July 2025, Judge Simms issued a temporary injunction barring Houck from selling or transferring property or business assets after evidence surfaced that he was trying to liquidate holdings to avoid paying a judgment.¹⁹ In December 2025, the court granted State Farm’s motion to intervene, ruling that Houck’s renter’s insurance policy does not cover the claims because it applies only to accidental injury, not intentional acts.¹⁸ The civil case remains pending.

What Remains Open

On June 4, 2026, Kentucky State Police arrested Nick Houck and charged him with first-degree perjury, a Class D felony carrying one to five years in prison. The indictment alleges he made false statements under oath between July 2015 and August 2023, a window that begins shortly after Crystal Rogers’ disappearance and ends just before his brother’s murder indictment. The specific statements have not been publicly disclosed.²⁰

Nick Houck pleaded not guilty at his June 18, 2026 arraignment, appearing without a retained attorney and represented temporarily by a public defender. He is free on a $25,000 bond with a dusk-to-dawn curfew, with a pretrial hearing set for July 2, 2026.²¹²² Throughout the criminal trials, prosecutors labeled both Nick Houck and his mother, Rosemary Houck, as unindicted co-conspirators. Neither has been charged with crimes directly related to the murder.

Ballard called the arrest a step forward. “After all these years of lying to people and lying to law enforcement, he’s finally been held accountable for his lies,” she said. “Anything I can do to make that family pay for what they’ve done to my family, I’m 100% going to be right there.” She has said she has not given up advocating for justice in either her daughter’s case or her husband’s.²³
