RCW 12.40.010 – Small Claims Department Authorized Jurisdictional Amount2Spokane County, WA. How Do I File a Small Claims The process is built for people without lawyers, cases move quickly from filing to hearing, and most of the risk sits in a few technical steps: naming the defendant correctly, serving them on time, and knowing how you’ll collect if you win.

Dollar Limits and What the Court Can Do

An individual filing on their own behalf can claim up to $10,000. Corporations, LLCs, partnerships, and other business entities are capped at $5,000.1Washington State Legislature. RCW 12.40.010 – Small Claims Department Authorized Jurisdictional Amount The caps are firm. If you’re owed more, you can still file in small claims, but you give up the difference; for a full recovery you’d need to file a regular civil action in district court or superior court.

Small claims is also limited to cases “for the recovery of money only.”1Washington State Legislature. RCW 12.40.010 – Small Claims Department Authorized Jurisdictional Amount The judge can order someone to pay you. The judge cannot order them to return property, perform a service, or stop doing something. If that’s what you need, small claims is the wrong courtroom.

Filing Deadlines

Washington sets a hard window for each type of claim. Miss it and the case gets dismissed no matter how strong the facts are.

If a deadline is close, file first and polish your evidence afterward. Filing stops the clock.

Where and How to File in Spokane

You can file in Spokane County District Court if the defendant lives in Spokane County when you file.5Spokane County, Washington. Small Claims Filing Instructions If they live elsewhere, the case may still belong here when the underlying transaction or incident happened in Spokane. Filing in the wrong county gives the defendant grounds to have the case thrown out, so confirm the address first.

The form is called a Notice of Small Claim. You can pick up the filing packet at the clerk’s office in the Broadway Center Building, 721 N. Jefferson Street, Floor 2, or download it from the county website.6Spokane County, WA District Court. District Court Civil and Small Claims Department You can also email the completed form to the court; a clerk will contact you within 24 to 48 hours to arrange payment.7Spokane County, WA. Small Claims Pre-Filing Form

Before you complete the form, pin down three things. The defendant’s full legal name and current address. The exact dollar amount you’re claiming, kept within the applicable cap. And a short, factual, chronological description of what happened and what it cost you.

Getting the defendant’s name wrong is one of the most common mistakes, and it can block you from collecting even on a winning judgment. Businesses often operate under a trade name that doesn’t match the legal entity. For a business defendant, search the Washington Secretary of State’s Corporations and Charities Filing System to find the registered entity name and the registered agent authorized to accept legal documents.8Washington Corporations and Charities Filing System. The filing fee is $35, regardless of how much you’re claiming.2Spokane County, WA. How Do I File a Small Claims A defendant filing a counterclaim pays the same $35. You can recover your filing fee as part of a judgment if you win.

Serving the Defendant

Once you file, the clerk assigns a case number and a hearing date. From there, getting the Notice into the defendant’s hands is on you; the court does not do it. Service must be completed at least ten calendar days before the first hearing date.9Washington State Legislature. Chapter 12.40 RCW – Small Claims

Washington allows two methods.

  • Personal delivery. Someone other than you physically hands the papers to the defendant. The Spokane County Sheriff’s Office charges $70 to serve one person, or $90 for two people at the same address. Private process servers typically charge between $50 and $150.10Spokane County, WA. • Certified or registered mail. You mail the Notice to the defendant, the defendant signs a return receipt, and you file that signed receipt with the court before the hearing.11Washington State Courts. Small Claims Court – Serving the Notice

Certified mail is cheaper but depends on the defendant actually signing. If they dodge the carrier or refuse to sign, you have to switch to personal service, and the ten-day clock won’t wait. Build a buffer.

Preparing for the Hearing

No attorney or legal paraprofessional can appear for either side in a Washington small claims case without the judge’s permission.9Washington State Legislature. Chapter 12.40 RCW – Small Claims You can talk to a lawyer beforehand to shape your argument. In the courtroom, though, you’re on your own with the judge.

Judges decide these cases on whatever the parties put in front of them, so evidence is where cases are won. Bring contracts, receipts, invoices, text messages, emails, photographs, and repair estimates. Organize everything in order, and make copies for the judge and the other side.

If a witness supports your account and will come willingly, bring them. If a witness won’t come, you can ask the clerk to issue a subpoena. The subpoena has to be personally delivered along with a check for attendance fees, and you file proof of service before the hearing.

Keep your presentation short and chronological. What was promised, what happened instead, and what it cost you. Judges hear dozens of these in a day; a clean timeline beats a long complaint about how the dispute felt.

Mediation, the Judge’s Decision, and Counterclaims

On hearing day, the court may offer mediation before sending the case to the judge.6Spokane County, WA District Court. District Court Civil and Small Claims Department A mediated agreement is enforceable, and a payment plan the other side actually honors can beat a judgment you have to chase.

If mediation doesn’t settle it, both sides present their story, show evidence, and answer questions. The judge rules based on the “plain justice of the case” and can award the full amount, part of it, or nothing. The judge can also allow the losing party to pay in installments.12Washington State Legislature. RCW 12.40.100 – Judgment

Expect that the defendant may file a counterclaim against you for the same $35 fee. You could leave court owing money instead of collecting it, so prepare for that possibility the same way you prepare your own claim.9Washington State Legislature. Chapter 12.40 RCW – Small Claims

Collecting Your Judgment

A judgment is a court order to pay. It is not a check. The clerk records the judgment and gives the winning party a certified copy at no extra charge, and after that, collection is on you.13Washington State Courts. Small Claims Court – How Do I Collect My Money

If the losing party won’t pay voluntarily, Washington gives you several tools. Wage garnishment lets you redirect part of their paycheck before they receive it, under RCW Chapter 6.27. Bank account garnishment uses the same process to pull funds directly from an account you can identify. A superior court judgment can act as a lien on real estate the debtor owns, paying out when the property sells. And if you don’t know where the debtor works or banks, you can ask the court to order supplemental proceedings, requiring the debtor to appear and answer questions about income and assets under threat of a bench warrant for not showing up.

Judgments in Washington are good for ten years and can be renewed for another ten. Interest accrues automatically, at 9% per year on consumer debt or at the rate stated in a written contract if the claim was based on one.14Washington State Legislature. RCW 4.56.110 – Interest on Judgments That accrual gives debtors a reason to pay sooner.

When You Can Appeal

Not every small claims decision can be appealed. If the amount claimed was under $250, there’s no appeal at all. If you’re the party who chose to bring the case in small claims, you also lose the right to appeal when your claim was under $1,000.9Washington State Legislature. Chapter 12.40 RCW – Small Claims Above those thresholds, appeals go to superior court.

If you lost because you didn’t show up, the better move is usually not an appeal but a motion in the district court to set aside the default judgment under the standard civil rules.9Washington State Legislature. Chapter 12.40 RCW – Small Claims Either way, act quickly; the appeal packet is available on the Spokane County District Court website.15Spokane County, WA. Civil and Small Claims Forms
