The smoking age in Indiana is 21. What Counts as a Tobacco Product

Indiana’s statute uses “tobacco product” broadly. It covers cigarettes, cigars, chewing tobacco, snuff, and pipe tobacco, and it also covers e-liquids and electronic cigarettes.1Indiana General Assembly. If it contains nicotine and is meant for human consumption, the age-21 rule applies.

Penalties for Buying or Possessing Tobacco Under 21

If you are under 21 and you buy, accept, or carry a tobacco product on your person, that is a Class C infraction.1Indiana General Assembly. Using a fake ID to try to buy tobacco is a separate offense under the same statute. Possessing fraudulent identification with the intent to purchase a tobacco product while under 21 is also a Class C infraction, with the same potential $500 fine.1Indiana General Assembly. There is a narrow work-related exception. If you are under 21 but handling tobacco products as part of your job in agriculture, processing, transporting, wholesaling, or retailing, that contact is not an infraction.1Indiana General Assembly. No Military Exemption

Active-duty service members who are 18, 19, or 20 are held to the same age requirement as everyone else. Neither Indiana law nor the federal Tobacco 21 law contains a military carve-out; the federal rule applies to all retail establishments and all persons with no exceptions.2Food and Drug Administration. What ID You Will Be Asked to Show

Indiana requires retailers to check identification for any tobacco buyer who appears to be under 40 in a carryout sale.4Indiana Alcohol & Tobacco Commission. The clerk is expected to confirm the photo matches you and that the document has not expired.

Federal rules set a lower age threshold: as of September 2024, FDA regulations require photo-ID verification for anyone under 30 buying cigarettes, smokeless tobacco, or covered tobacco products.2Food and Drug Administration. What Retailers Face for Selling to Someone Underage

Indiana does not use a fixed fine schedule for retailers. The Indiana Alcohol and Tobacco Commission has discretion to fine a business, suspend its tobacco sales certificate, or both when a store or employee sells to someone under 21. On a first violation, imposing anything harsher than a fine plus a three-day suspension requires the commission to issue written findings explaining why.5Indiana General Assembly. A second violation within twelve months can bring a longer suspension or full revocation of the permit. Anything beyond a fine plus a suspension longer than fifteen days again requires written justification.5Indiana General Assembly. Enforcement is not just complaint-driven. The commission runs compliance checks in which officers accompany participants aged 16 to 20 into licensed retailers to attempt a purchase.6Indiana Alcohol and Tobacco Commission. How to Report an Illegal Sale

If you see a retailer selling tobacco to someone who is clearly underage, you can report it to the FDA or to the Indiana Alcohol and Tobacco Commission. The FDA accepts reports through its online tobacco violation form, by email at CTPCompliance@FDA.hhs.gov, or by mail to its Center for Tobacco Products in Silver Spring, Maryland.7Food and Drug Administration.
