Smoking in Hawaii: Laws, Penalties, and Where It’s Banned

Smoking laws in Hawaii are among the strictest in the country: the state bans smoking in every indoor public space and workplace, requires a 20-foot buffer around building entrances and windows, and every county extends the ban to its beaches, parks, and recreation areas. Break the rules as an individual and you face a fine of up to $50. Businesses that fail to enforce the ban can be fined up to $500 per violation and lose their operating permits. Electronic cigarettes are treated the same as tobacco, and you must be 21 to buy either.

Where Indoor Smoking Is Banned

Hawaii’s Clean Indoor Air Act (HRS Chapter 328J) prohibits smoking in all enclosed or partially enclosed areas open to the public. That covers restaurants, bars, shopping malls, theaters, and public transit vehicles.1Justia. Airports get their own broad treatment. Smoking is banned from curb to cabin, covering ticket counters, waiting areas, terminals, pick-up zones, and loading gates at every state airport.1Justia. The 20-Foot Rule Outside Buildings

Smoking is also prohibited within 20 feet of entrances, exits, operable windows, and ventilation intakes of any place where indoor smoking is banned. The statute calls this a “presumptively reasonable minimum distance,” which means a property owner can petition the Department of Health for a different distance, but must show by clear and convincing evidence that smoke won’t enter the building.3Justia. Beaches, Parks, and Other Outdoor Areas

Hawaii’s state law stops at indoor spaces, but the counties have added their own outdoor restrictions. Every county limits smoking in parks, beaches, or recreation areas to some degree.

  • On Oahu, smoking is banned in all public parks, recreation areas, and facilities maintained by the city.   • On Kauai, smoking is prohibited in recreation areas and facilities run by the county’s Division of Parks and Recreation. County parks themselves are carved out of that definition, but the county may designate smoking-permitted zones within recreational facilities by signage.6eCode360.   • Hawaii County also restricts smoking in county parks and outdoor recreation areas.

The safe assumption on any beach or in any park in Hawaii: don’t light up unless a sign specifically says you can.

Vaping and Electronic Cigarettes

Hawaii treats electronic smoking devices exactly like traditional cigarettes. The Clean Indoor Air Act’s definition of “smoking” includes them, so vaping is prohibited everywhere cigarettes are: indoor public spaces, workplaces, the 20-foot buffer, and county parks and beaches.7State of Hawaii, Department of Health. Only a limited set of e-cigarette products has received FDA marketing authorization for lawful sale in the United States. You Must Be 21 to Buy

Hawaii raised the tobacco purchase age to 21 in 2015 under Act 122, which amended HRS 709-908. The law makes it illegal to sell or furnish any tobacco product, including electronic smoking devices, to anyone under 21, and illegal for anyone under 21 to purchase them.9Justia. If You Get Caught Smoking

A person who smokes in a prohibited area commits a violation and faces a fine of up to $50. There is no escalation for repeat offenses; the $50 cap applies each time. Miss your court date after a citation, and the court will issue an arrest warrant. A police officer can also physically remove anyone who keeps smoking after being cited.11Justia. If You Run a Business

Owners, managers, and operators who fail to enforce the smoking ban on their premises face escalating fines:

  • First violation: up to $100
  • Second violation within one year: up to $200
  • Each additional violation within one year: up to $500

Each day the violation continues counts as a separate offense, and violating the Clean Indoor Air Act can result in suspension or revocation of any permit or license issued for the premises.11Justia. Selling Tobacco to Someone Under 21

HRS 709-908 fines a seller $500 for a first offense and between $500 and $2,000 for subsequent offenses. A minor who buys tobacco faces a $10 fine on a first offense and $50 or 48 to 72 hours of community service on later offenses.

Exceptions Worth Knowing

Private residences are exempt from the indoor smoking ban, with one important limit: the exemption disappears when the home is used as a licensed child care facility, adult day care, or health care facility. Certain commercial establishments can qualify for limited exemptions under HRS 328J-7, including hotel designated smoking rooms and retail tobacco shops. Each category has conditions tied to ventilation, revenue thresholds, or physical separation from non-smoking areas, so operators should review the full statute before assuming they qualify.

Federal Rules That Reach Into Hawaii

A few federal rules add layers on top of state and county law.

On the Plane

Federal aviation rules ban smoking on all scheduled and nonscheduled passenger flights, including while the aircraft is on the ground. In Public Housing

A HUD rule that took full effect in 2018 requires every public housing authority to maintain a smoke-free policy in all living units, indoor common areas, administrative offices, and outdoor areas within 25 feet of public housing buildings.15Federal Register. The federal Prevent All Cigarette Trafficking (PACT) Act generally bans mailing cigarettes, smokeless tobacco, and electronic nicotine delivery systems to consumers.
