Social Security Disability Benefits in South Dakota

If you live in South Dakota and a medical condition is keeping you from working, you can apply for Social Security disability benefits in South Dakota through the federal Social Security Administration, either online at ssa.gov, by phone at 1-800-772-1213, or in person at a local field office in Sioux Falls, Rapid City, Aberdeen, or another SD city. The SSA handles the non-medical side of your claim; South Dakota’s Disability Determination Services reviews your medical records. Initial decisions take roughly six to eight months.

SSDI or SSI: Which Program You’re Applying For

Social Security runs two separate disability programs, and most of the application confusion starts here.

Social Security Disability Insurance (SSDI) is an insurance program tied to your work history. You qualify by having earned enough work credits through jobs where you paid Social Security taxes. Your monthly payment reflects your lifetime earnings, and approval eventually brings Medicare coverage. SSDI has no asset limit.

Supplemental Security Income (SSI) is a needs-based program. Work history doesn’t matter, but your countable resources cannot exceed $2,000 as an individual or $3,000 as a couple, limits that have been unchanged for decades.1Social Security Administration. 2026 Cost-of-Living Adjustment (COLA) Fact Sheet South Dakota pays a small state supplement on top of the federal SSI amount.2Social Security Administration. Some people qualify for both at once. If your SSDI payment is low and your assets fall below the SSI limits, you can receive a combined benefit.

Who Qualifies

Work Credits for SSDI

You can earn up to four work credits a year. In 2026, each credit requires $1,890 in earnings.3Social Security Administration. Quarter of Coverage If your disability starts at age 31 or older, you generally need 40 credits total, with 20 of them earned in the ten years immediately before your disability began.4Social Security Administration. Disability Benefits – How Much Work Do You Need Younger workers need fewer. Someone disabled at 24 may need as few as six credits earned in the three years before onset.5Social Security Administration. The Disability Standard

Both programs use the same definition. You must have a medically determinable physical or mental impairment that prevents substantial gainful activity and is expected to last at least twelve continuous months or result in death.6Social Security Administration. 20 CFR 404.1505 – Basic Definition of Disability Substantial gainful activity has a dollar figure attached. In 2026, earning more than $1,690 a month (or $2,830 if you are statutorily blind) generally tells the SSA you are capable of substantial work.7Social Security Administration. What You’ll Receive in 2026

A 2.8 percent cost-of-living adjustment took effect for 2026, raising payments in both programs.8Social Security Administration. Cost-of-Living Adjustment (COLA) Information

SSDI payments are calculated from your earnings record, so amounts vary widely. The maximum possible benefit in 2026 is $4,152 per month; most recipients receive considerably less.

SSI pays $994 a month for an individual and $1,491 for an eligible couple in 2026.9Social Security Administration. How to Apply in South Dakota

You have three ways to file. The online application at ssa.gov walks you through each section and gives you a confirmation number when you finish. Phone applications go through the SSA national line at 1-800-772-1213, where a representative records your information. In-person applications happen at an SSA field office. South Dakota has offices in Sioux Falls, Rapid City, Aberdeen, and other cities; the SSA recommends scheduling an appointment before you go.10Social Security Administration. Field Office Locator

File as soon as you can. SSDI allows retroactive benefits for up to twelve months before your application date if your disability started early enough to cover that window.11Social Security Administration. Can I Get Social Security Disability Benefits for Any Months Before I Applied Waiting to apply can cost you months of payments you would otherwise have received. SSI does not pay retroactively; its payments begin from the application or eligibility date, whichever is later.

What to Gather Before You File

The main form is SSA-16, available online or at any field office.12Social Security Administration. Information You Need to Apply for Disability Benefits Don’t put off filing because you’re missing a document; the SSA will help you track things down. Having the following ready still speeds the review.

For identity and work history, pull together your Social Security number, birth certificate, and recent tax returns or W-2s. A description of what your recent jobs actually involved helps the agency decide whether your condition prevents you from doing that past work.

Medical evidence is the heart of the claim. List every doctor, hospital, clinic, and therapist who has treated your condition, with addresses and phone numbers. Include every medication, its dosage, and which doctor prescribed it. Lab results, imaging reports, and treatment notes all go into the file. Thorough records cut down on follow-up requests, and follow-up requests are what stretch the timeline.

What Happens After You File

Once the SSA confirms your non-medical eligibility, your file moves to South Dakota’s Disability Determination Services, which sits under the South Dakota Department of Human Services.13Social Security Administration. 20 CFR 404.1601 – Purpose and Scope A disability examiner and a medical or psychological consultant review your records together.

They work through a five-step sequence used nationwide. Are you working above the substantial gainful activity level? Is your condition severe? Does it meet or equal a condition on the SSA’s listing of impairments? Can you still do any of your past work? Can you adjust to any other work that exists in the economy? A “no” at step five means approval. Strong medical documentation is what moves claims through these steps.

If the existing records don’t give the examiners enough to decide, DDS may schedule a consultative examination with an independent provider, paid for by the government.14Social Security Administration. Consultative Examination Guidelines These exams are brief, and records from your own treating doctors generally carry more weight.

Compassionate Allowances

About 300 conditions, including ALS, certain cancers, and early-onset Alzheimer’s, appear on the SSA’s Compassionate Allowances list and get fast-tracked.15Social Security Administration. Complete List of Conditions – Compassionate Allowances You file the normal SSDI or SSI application and note that your condition is on the list. Decisions can come in days rather than months.

If You’re Approved

SSDI benefits don’t start immediately. A five-month waiting period runs from the established onset date of your disability, and your first payment arrives in the sixth full month after onset. ALS is the one exception; there is no waiting period for an ALS diagnosis.16Social Security Administration. Approval Process – Disability Benefits

Because of the waiting period and processing time, most approved applicants receive a lump-sum back payment covering the months between the end of the five-month wait and the approval date, plus up to twelve months of retroactive benefits before the application date if the onset qualifies.11Social Security Administration. Can I Get Social Security Disability Benefits for Any Months Before I Applied

Medicare kicks in automatically after you have received SSDI for 24 months. No separate application is needed.17Medicare. I’m Getting Social Security Benefits Before 65 SSI recipients generally qualify for Medicaid instead, and usually right away.

If You’re Denied: The Appeals Ladder

Nationally, about 35 percent of initial claims are approved, and South Dakota’s rate is only moderately higher. If you’re denied, you have four levels of appeal. Each has a 60-day filing deadline that runs from the date you receive the denial notice; the SSA assumes you receive it five days after the date on the notice.18Social Security Administration. Understanding Supplemental Security Income Appeals Process

Reconsideration is first. A different examiner and medical consultant at South Dakota DDS review the entire file again. Submit any new medical evidence you have gathered since you first applied. Approval rates at this level are low.

If reconsideration fails, you can request a hearing before an Administrative Law Judge. You appear in person or by video, the judge reviews your file and asks questions, and medical or vocational experts may testify.19Social Security Administration. Request Hearing with a Judge Scheduling takes several months. Many claims that eventually win are won here, and this is the stage where a representative tends to matter most.

Beyond the hearing, you can ask the SSA’s Appeals Council to review the judge’s decision within 60 days.20Social Security Administration. Request Review of Hearing Decision If the Council declines or rules against you, the final step is filing a civil action in federal district court within 60 days. In court, no new evidence can be submitted, the government has its own attorney, and the judge reviews only the existing record.

Hiring a Representative

You can bring on an attorney or accredited representative at any stage, though most people do so for the hearing. Social Security representatives generally work on contingency and are paid only if you win. Under the standard fee agreement, the fee is 25 percent of your past-due benefits, capped at $9,200.21Social Security Administration. Fee Agreements The SSA withholds the fee from your back payment and pays the representative directly, so nothing comes out of pocket.

Taxes on Your Benefits

South Dakota has no individual income tax, so your disability payments owe nothing to the state. Federal tax depends on your combined income: adjusted gross income, plus nontaxable interest, plus half your Social Security benefits.

For single filers, combined income below $25,000 means none of your SSDI is taxed. Between $25,000 and $34,000, up to 50 percent may be taxable. Above $34,000, up to 85 percent can be taxed. For couples filing jointly, the thresholds are $32,000 and $44,000. SSI payments are never federally taxed.

A lump-sum back payment can push you into a higher bracket for the year you receive it. The IRS lets you make a special election to calculate the taxable portion using the income from the years the benefits actually apply to, rather than the year the check arrived.22Internal Revenue Service. Back Payments You make the election on Form 1040; IRS Publication 915 has the worksheets. For many people with large retroactive payments, this election saves a meaningful amount.
