South Carolina residency requirements come down to two things working together: you have to physically live in the state, and you have to intend to stay. Once both are true, a short list of deadlines starts running. You have 45 days to trade in your out-of-state driver’s license, 45 days to register your vehicle, and income tax obligations that begin the day your permanent home is here. The rest is paperwork that should all point to the same address.
What Makes You a South Carolina Resident
No single document makes you a resident. State agencies and courts look at where you keep your permanent home, where you work, where your family lives, and where you handle everyday life like banking and doctor’s visits. Owning or renting a place in South Carolina is not enough on its own, and neither is spending time here.
South Carolina defines “legal residence” as a permanent dwelling you own and occupy and intend to keep indefinitely. A vacation home or seasonal rental does not count. The concrete ties that typically prove residency are a South Carolina driver’s license, utility bills in your name, employment records, voter registration, and enrollment of dependents in local schools.
Consistency matters more than most people realize when moving from another state. Keeping a larger home in your old state, staying on the voter rolls there, or leaving professional licenses at the old address can all undercut a residency claim. Tax auditors in particular watch for mismatches between the state you say you live in and the state your documents suggest you actually live in.
Driver’s License Within 45 Days
New residents must surrender any out-of-state license and get a South Carolina driver’s license within 45 days of establishing residency.1South Carolina Legislature. To apply at the SCDMV, bring proof of identity (birth certificate or passport), your Social Security card, and two documents proving your South Carolina address, such as a utility bill, lease, or bank statement. If your out-of-state license is still valid, the SCDMV will usually waive the driving test but will still run a vision screening. If your old license is expired, expect to take both the knowledge and road exams.
Vehicle Registration Within 45 Days
You also have 45 days from establishing residency to register your vehicle and get a South Carolina title.2South Carolina Legislature. There is a step most newcomers do not expect. Before the SCDMV will register the vehicle, you have to pay property tax on it at your county auditor’s office and bring the paid receipt to the DMV.3SCDMV. Registration South Carolina charges annual property tax on vehicles based on assessed value and a depreciation schedule, so this is a recurring expense, not a one-time fee.
You will also owe the infrastructure maintenance fee, which South Carolina uses instead of a traditional sales tax on vehicles. For a car brought in from out of state, the IMF is 5% of fair market value, capped at $500.
Insurance is the last piece. You must carry auto coverage from a company licensed in South Carolina, and the SCDMV requires proof of in-state insurance when you register. If your current carrier does not operate here, switch policies before you go to the DMV.
State Income Tax After You Move

Through mid-2026, the top marginal rate is 6% under a temporary budget reduction and is scheduled to return to 6.2% on July 1, 2026. Lower brackets are taxed at lower rates, and the first several thousand dollars of income are effectively tax-free.
If you move to South Carolina partway through the year, you are a part-year resident. You can either file as a full-year resident and claim a credit for taxes paid to other states, or file the SC1040 with Schedule NR and be taxed only on income earned while living in South Carolina.5South Carolina Department of Revenue. Nonresidents who earn South Carolina-source income (wages from a job here, rental income, business income) use the same SC1040 with Schedule NR. If you sell South Carolina real property as a nonresident, the closing attorney will withhold state income tax and report it on Form I-290.
Property Tax Benefits for Homeowners
Living in a home you own in South Carolina unlocks two property tax breaks. The first is the 4% assessment ratio: your primary residence is assessed at 4% of fair market value, compared with 6% for second homes, rentals, and commercial property. To qualify, you must own and occupy the home, certify it as your legal residence, and confirm that no one in your household claims residency in another state or claims the 4% ratio on a different property. Apply through your county assessor’s office by January 15 of the tax year.
The second is the homestead exemption, which removes property tax on the first $50,000 of fair market value. Registering to Vote
To register in South Carolina you must be a U.S. citizen, at least 18 by Election Day, and a resident of the county and precinct where you plan to vote.8South Carolina Legislature. You can register online, by mail, or in person at your county board of voter registration. Mail and online applicants provide a driver’s license number or the last four digits of a Social Security number. At the polls, South Carolina requires photo ID: a South Carolina driver’s license, a DMV-issued ID card, a voter registration card with photo, a U.S. passport, or a federal military ID.
If you have moved within South Carolina and have not updated your registration, you can still vote at your old precinct if you moved within 30 days of the election. College students may register at either their campus address or their family’s address, depending on which they treat as their primary residence.
In-State Tuition Requires 12 Months
Qualifying for in-state tuition at South Carolina’s public colleges and universities requires establishing domicile in the state for at least 12 consecutive months before the term begins. Typical proof includes a South Carolina driver’s license, state income tax returns filed as a South Carolina resident, and a lease or deed. The 12-month clock is the sticking point. Enrolling in school does not start it, and attending college in South Carolina by itself does not establish domicile.
Students who depend financially on their parents inherit their parents’ residency status. Under state law, a “dependent person” is someone whose predominant support comes from a parent, spouse, or guardian and who qualifies as a dependent on that person’s federal tax return.10South Carolina Legislature. South Carolina Code 59-112-10 – Definitions If the parents meet the 12-month requirement and can show intent to stay through employment, homeownership, or voter registration, the student qualifies for in-state rates even without personally meeting the year.
Students already paying out-of-state tuition can petition for reclassification by submitting a residency application with supporting documents to the school’s residency officer. Misrepresenting residency can trigger repayment of the tuition difference and disciplinary action.
Military Members and Spouses
Active-duty service members stationed in South Carolina get different treatment. Under the Servicemembers Civil Relief Act, if your legal residence is another state, South Carolina will not tax your military income; you owe state tax only in your state of domicile.11South Carolina Department of Revenue. Military spouses are covered by the Military Spouses Residency Relief Act, as amended by the Veterans Auto and Education Improvement Act of 2022. A spouse can choose tax residency from three options: the service member’s state of domicile, the spouse’s own state of domicile, or the duty station state.12Military OneSource. The 2022 law also lets a service member or spouse who holds a professional license use it in South Carolina after a move under military orders, so long as they were actively using it within the two years before the move, remain in good standing, and accept the licensing authority’s jurisdiction. For tuition, military personnel stationed in South Carolina generally qualify for in-state rates without waiting out the full 12-month residency period.
Keeping Your Records Consistent
The fastest way to create a residency problem is sending mixed signals. Agencies and schools look for consistency across every record. If you claim South Carolina residency but keep a driver’s license in another state, vote there, or leave your car registered there, expect questions. Common audit triggers include keeping a larger or more valuable home in the old state, spending more than 183 days a year there, and leaving family behind while claiming to have moved.
Auditors verify physical presence with cell phone location data, credit card transactions, toll records, airline boarding passes, and calendar entries. The clean approach is to make the switch all at once: update your license, register your vehicle, move your voter registration, change your bank and insurance addresses, and file South Carolina tax returns within the first few months of arriving. When every document points to the same state, there is nothing to dispute.
