South Lake Tahoe allows Airbnb-style short-term rentals in both residential neighborhoods and tourist-commercial zones, but you need a city-issued Vacation Home Rental (VHR) permit, and residential permits are capped at 900 citywide under Ordinance 2026-1203, which took effect April 23, 2026.1City of South Lake Tahoe. City of South Lake Tahoe Council Adopts Ordinance Amending Vacation Home Rental Regulations A VHR is any dwelling rented for 30 consecutive days or less. The current South Lake Tahoe Airbnb rules replaced the 2018 Measure T ban after an El Dorado County Superior Court judge struck that measure down in March 2025 on constitutional grounds, and the city council chose not to appeal.2City of South Lake Tahoe. Where You Can Operate
Every parcel sits in one of two regulatory buckets: a residential zone, or a non-residential zone (Tourist Core, commercial, or recreational). The bucket controls almost everything else about your permit.
Residential Zones
VHRs are permitted in residential zones up to the citywide cap of 900. Once the cap is hit, applicants go on a waitlist and only move up when an existing permit is not renewed or is revoked.3City of South Lake Tahoe. Vacation Home Rentals Attached condominiums qualify unless the HOA prohibits short-term rentals. Other multifamily dwellings do not qualify. The old 150-foot buffer between residential VHRs was eliminated and replaced by the 900-unit cap.1City of South Lake Tahoe. Tourist Core and Commercial Zones
Properties in the Tourist Core Area Plan and other commercial or recreational zones have no permit cap.3City of South Lake Tahoe. Vacation Home Rentals Several of the strictest residential rules — tighter occupancy limits, indoor noise monitors, defensible-space inspections, and “family friendly” advertising language — do not apply here. Confirm a specific parcel’s zoning with the Planning Division before you buy or apply.
How Many Guests You Can Host
Occupancy is set by whichever is lower: the paved parking count or the bedroom count. Garage spaces do not count as paved parking; the inspector decides what qualifies during the on-site review.
The parking ceiling applies in every zone:3City of South Lake Tahoe. Vacation Home Rentals
- 1 space: 4 guests
- 2 spaces: 8 guests
- 3 spaces: 12 guests
- 4 spaces: 16 guests
- 5 spaces: 20 guests
Outside residential zones, the bedroom formula is more generous: 4 guests for a studio, 6 for one bedroom, 8 for two, 10 for three, 12 for four, and 14 for five.3City of South Lake Tahoe. Vacation Home Rentals
Residential zones use a tighter formula: 2 guests for a studio, 2 for one bedroom, 4 for two, 6 for three, 8 for four, and 10 for five. On properties with one or more bedrooms, up to five children aged 13 and under do not count toward the limit. On studios, up to two children aged 13 and under are excluded.3City of South Lake Tahoe. Minimum guest age is 25, and only one VHR is allowed per parcel.3City of South Lake Tahoe. Vacation Home Rentals
Operating Rules You Have to Follow
The conditions below apply whenever the permit is active, not just when guests are checked in. The permit number has to appear on every listing, ad, and rental contract.3City of South Lake Tahoe. Vacation Home Rentals
Parking
All guest vehicles must park in designated paved spaces on the property. Camping or sleeping in tents, RVs, travel trailers, or campers on the property is prohibited.3City of South Lake Tahoe. Vacation Home Rentals
Trash and Bears
Trash and recyclables cannot sit outside except in an animal-resistant cart or inside a bear box. Where a bear box is installed, all solid waste has to stay in it until collection day, and the box must be functional and maintained so wildlife cannot access the contents.3City of South Lake Tahoe. Vacation Home Rentals The city’s sorting and collection requirements under the solid waste ordinance also apply.
Quiet Hours
Quiet hours run from 10:00 p.m. to 8:00 a.m. During that window, outdoor amplified music, speakers, and other noise-generating equipment are banned, and hot tubs, pools, and spas have to be shut down.3City of South Lake Tahoe. Vacation Home Rentals When police respond to a complaint about noise, parking, occupancy, or trash, both owner and occupants can be cited.
No Events
Weddings, receptions, large parties, and other commercial events are not allowed at a VHR.3City of South Lake Tahoe. Vacation Home Rentals
Signage
An exterior sign has to be visible from the street, weather-resistant metal or plastic (no laminated signs), and no larger than 12 by 12 inches. It must list the maximum occupants, maximum vehicles, the police department VHR hotline, the owner’s name, the property manager’s name, and a 24-hour contact number. An interior sign posted near the front door repeats much of that information and adds seasonal snow-removal parking rules, trash pickup day, notice that occupants can be fined, and a reminder about parking and occupancy caps. Hot tubs need their own sign posting the 10:00 p.m. to 8:00 a.m. restriction.4City of South Lake Tahoe. Vacation Home Rental Inspector’s Checklist
Noise and Video Monitoring (Residential Zones Only)
Residential-zone VHRs must install indoor noise monitors and outdoor video monitoring devices that alert the property manager around the clock to potential violations such as noise spikes, parking problems, or trash issues.3City of South Lake Tahoe. Vacation Home Rentals Properties outside residential zones are not subject to this requirement.
Property Manager Rules
Every VHR has to have a designated property manager, and the owner can fill that role. The manager is responsible for carrying out all conditions of operation and handling complaints from the city and from neighbors.3City of South Lake Tahoe. Vacation Home Rentals
For residential-zone properties, the manager must check in every group of guests, in person or virtually, at the start of each rental. During check-in the manager verifies IDs and both sides sign a “good neighbor contract” confirming the rules have been reviewed. The manager also has to maintain a local contact number staffed 24/7 and be able to respond in person to a complaint within 60 minutes at any hour.3City of South Lake Tahoe. Vacation Home Rentals A Local Contact Authorization Form is part of the permit application.
Applying for the Permit
Applications go through the city’s online permit portal, and the city limits processing to 150 new permits per month. The application packet requires proof of ownership, the designated property manager with authorization paperwork, the property’s bedroom and paved-parking details, and a signed acknowledgment of the operating conditions.3City of South Lake Tahoe. Vacation Home Rentals
Properties outside the Tourist Core must pass an on-site safety inspection before the permit issues. The inspector’s checklist covers smoke detectors in every bedroom and hallway leading to one and at least one per floor, carbon monoxide detectors on each floor (plus any bedroom with a gas appliance), one 3-pound minimum ABC fire extinguisher per floor, an emergency exit map on the back of each bedroom door, emergency exit lighting in sleeping rooms, 4-inch contrasting street numbers visible from the street, and hot tub safety features including a lockable cover and emergency shut-off.4City of South Lake Tahoe. Vacation Home Rental Inspector’s Checklist Residential-zone properties also need a defensible-space inspection for wildfire safety. Tourist Core properties are exempt from on-site inspection.3City of South Lake Tahoe. Vacation Home Rentals
Appeals of permit denials go to an independent hearing officer rather than the Planning Commission.3City of South Lake Tahoe. Vacation Home Rentals
Transient Occupancy Tax
South Lake Tahoe charges a 14% Transient Occupancy Tax on all short-term lodging, including VHRs.5City of South Lake Tahoe. Transient Occupancy Tax and SLT Tourism Improvement District Fee The operator is responsible for collecting the tax from guests and remitting it to the city, along with room night reporting at each payment.3City of South Lake Tahoe. Vacation Home Rentals Some booking platforms collect and remit on your behalf; verify that in writing with both the platform and the city, because if the tax goes unpaid the permit holder is liable.
What Violations Cost
Enforcement runs through administrative citations. California SB 60 authorizes cities to impose escalating fines for short-term rental infractions that threaten health or safety:6LegiScan. California SB60 2021-2022 Regular Session Chaptered
- First violation: up to $1,500
- Second violation of the same ordinance within one year: up to $3,000
- Each additional violation within one year of the first: up to $5,000
Those maximums apply to infractions that pose a public health or safety threat. A first-time failure to register or get a business license does not trigger the elevated schedule. The city can also revoke a VHR permit for repeated or serious violations.3City of South Lake Tahoe. Vacation Home Rentals
Insurance and Mortgage Check Before You List
Standard homeowner’s policies typically exclude or sharply limit coverage for commercial rental activity. If a guest is hurt and the insurer determines you were running a business, the claim can be denied. Call your insurer about short-term rental coverage before you list; many owners end up adding a separate commercial or short-term rental policy with at least $1 million in liability.
If you have a mortgage, read the loan documents for a due-on-sale clause. Federal law under the Garn-St. Germain Act bars lenders from enforcing a due-on-sale clause when you grant a lease of three years or less with no purchase option, which covers short-term rentals.7Office of the Law Revision Counsel. 12 USC 1701j-3 – Preemption of Due-on-Sale Prohibitions Some loans, especially primary-residence mortgages, still carry occupancy requirements that can create issues if the home is rented most of the year, so have an attorney review the paperwork if you are unsure.
Federal Income Tax in Brief
If the property is your residence and you rent it fewer than 15 days in the year, the IRS says you do not report the rental income and cannot deduct rental expenses.8Internal Revenue Service. Renting Residential and Vacation Property Past 14 rental days, income goes on Schedule E and you can deduct a share of mortgage interest, property taxes, insurance, maintenance, cleaning, management fees, and depreciation, allocated between personal and rental use. IRS Publication 527 explains the allocation.9Internal Revenue Service. Publication 527, Residential Rental Property Including Rental of Vacation Homes
