Speed Limit in California School Zones: Fines, Points, and Defenses

The speed limit in a California school zone is 25 mph when children are present, under Vehicle Code section 22352. Some cities post a lower 15 mph limit on residential streets near schools, and a few now enforce these zones with automated speed cameras. A ticket for exceeding the limit generally costs several hundred dollars once penalty assessments are added, puts a point on your driving record for three years, and typically raises your insurance by around 42%.

When the 25 MPH Limit Applies

Under Vehicle Code section 22352, the prima facie speed limit drops to 25 mph when you are approaching or passing a school building or school grounds that border a public road, provided children are on the scene. No local ordinance is required for this to apply. If a standard “SCHOOL” sign is posted and states “25 miles per hour when children are present,” you are bound by that limit whenever qualifying conditions exist.1California Legislative Information. “When children are present” has a specific meaning: children going to or leaving the school during school hours or recess. Children are not considered present if they are separated from the road by a fence, gate, or other physical barrier. A school with a tall fence along the sidewalk may not trigger the limit even during drop-off, while an unfenced campus almost certainly will.

AB 2583, signed in 2024 and effective until January 1, 2028, refined the rules. It formally defined “school zone” in the Vehicle Code and allows the 25 mph limit to apply during specific hours posted on the sign, not only when children are visible. Where the Limit Drops to 15 MPH

Cities and counties can go further than the statewide default. Under Vehicle Code section 22358.4, a local authority may adopt an ordinance establishing a 15 mph limit on residential streets with a posted limit of 30 mph or slower within a school zone.3California Legislative Information. Whether your area actually uses the 15 mph option depends on local decisions. Not every California school zone does. The sign tells you: if it says 15, that is the enforceable limit, and the penalties for violating it follow the same structure as any school-zone speeding ticket.

Recognizing an Active School Zone

California school zone signs use a fluorescent yellow-green background with black lettering, chosen specifically to stand out from standard road signs. A full assembly usually has three parts: a “SCHOOL” plaque on top, the speed limit sign in the middle, and a bottom plaque telling you when the limit applies — posted hours, “when children are present,” or “when flashing.” A “when flashing” sign must be paired with a beacon that shows when enforcement is active.4Federal Highway Administration. An advance “SCHOOL” warning sign must be installed before the first speed limit sign in each direction, and an “END SCHOOL SPEED LIMIT” sign marks where the reduced zone stops. If those signs are missing, obscured, or out of place, that becomes relevant if you fight a ticket.

What a Ticket Actually Costs

The number printed on a California traffic ticket is almost never what you pay. The Vehicle Code sets a modest base fine for infractions, up to $100 for a standard violation.5California Legislative Information. California Code Vehicle Code VEH 42001 The larger bill comes from layered penalty assessments, surcharges, and court fees that can roughly quadruple the base.

Under the 2026 Uniform Bail and Penalty Schedule, every $10 of base fine adds $22 to $29 in penalty assessments, including state, county, court construction, and DNA fund penalties. A 20% state surcharge applies to the base fine, and the court adds its own fees on top. For an unlisted infraction with a $35 base fine, the total comes to roughly $233. How much you were over the limit drives the final amount. Expect it to land well above what feels like a normal traffic ticket.

Points, Insurance, and Your License

A school zone speeding conviction adds one point to your California driving record. That point stays on for three years.

The DMV tracks accumulated points through a negligent operator system. Reach four points in 12 months, six in 24, or eight in 36, and the DMV imposes a one-year probation that includes a six-month license suspension.7California DMV. Insurance is usually the bigger financial hit. A school zone speeding conviction in California raises premiums by about 42% on average, which can mean hundreds of extra dollars a year for the three years the point remains on your record. That cumulative cost typically dwarfs the ticket itself.

Traffic School and How It Helps

Completing traffic school masks the point from your driving record, which keeps your insurance company from seeing the conviction. You are generally eligible if you hold a valid driver’s license, the ticket involved a noncommercial vehicle, and you have not attended traffic school within the past 18 months.8California Courts Self Help Guide. School zone speeding tickets are not on the excluded list. Tickets that don’t qualify include equipment violations and anything alcohol- or drug-related.8California Courts Self Help Guide. Traffic School You still pay the full fine, plus the traffic school fee. Given how much a single point can inflate premiums, it almost always pays for itself.

Automated Speed Cameras

AB 645, signed in 2023, authorized a speed camera pilot in six California cities: Los Angeles, San Jose, Oakland, Glendale, Long Beach, and San Francisco. The program runs until January 1, 2032, and school zones are explicitly approved camera locations.9California Legislative Information. AB 645

San Francisco became the first city to begin issuing automated citations. Fines range from $50 to $500 depending on how far over the limit the camera recorded. First-time violators caught going 11 to 15 mph over receive a warning rather than a fine; drivers exceeding the limit by 16 mph or more get fined immediately.10SFMTA. When It Becomes Reckless Driving

A driver significantly exceeding the school zone limit, or weaving through groups of children, may face more than an infraction. Prosecutors can charge reckless driving under Vehicle Code section 23103 when someone drives with willful or wanton disregard for the safety of others. A conviction is a misdemeanor carrying five to 90 days in county jail, a fine between $145 and $1,000, or both.11California Legislative Information. Fighting a School Zone Ticket

Missing or Improper Signage

The signage requirements above create enforceable obligations on the government, and failures create defenses for drivers. If the school zone lacked a properly placed advance warning sign, if the speed limit sign was obscured by vegetation or positioned incorrectly, or if the “END SCHOOL SPEED LIMIT” sign was missing so you couldn’t tell you were still in the zone, those are legitimate grounds to challenge the ticket. Judges do dismiss citations when the evidence shows a driver was not given adequate notice.

The Speed Trap Defense

California has one of the strongest speed trap laws in the country. Under Vehicle Code section 40802, radar and lidar enforcement of a prima facie speed limit generally requires a current engineering and traffic survey. If the survey is more than seven years old, or more than 14 years old with a qualifying engineer’s evaluation, the speed limit may be treated as an illegal speed trap and the radar or lidar evidence excluded.12California Legislative Information. California Code Vehicle Code VEH 40802 Many jurisdictions let their surveys lapse without realizing it, which makes this a real avenue.

Even where the survey is current, the equipment can be challenged. Officers must calibrate radar and lidar devices at the beginning and end of each shift, and the devices must meet operational standards. Courts use detailed checklists covering calibration procedures, external accuracy testing with tuning forks for radar, and documentation that the equipment functioned properly all day.13Santa Clara County Superior Court.
