SR22 insurance in Indiana is not a type of policy. It is a certificate your auto insurer files electronically with the Indiana Bureau of Motor Vehicles to prove you carry at least the state’s minimum liability coverage, and the BMV requires it after certain court convictions and insurance violations. If a required SR22 is not on file, your driving privileges are suspended until one is.
When Indiana Requires an SR22
The BMV orders an SR22 after a license suspension tied to specific causes. The agency describes those causes as “certain court-related offenses” or “insurance violations.”1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility The Indiana Driver’s Manual points to two of the most common triggers: being convicted of operating a vehicle without financial responsibility (driving uninsured), and failing to file proof of insurance with the BMV when asked.2Indiana Bureau of Motor Vehicles. Indiana Driver’s Manual Chapter 5 Court-related triggers include operating while intoxicated.
If you have been told you need an SR22, the court order or BMV suspension notice will spell out the reason and the length of the requirement. That paperwork is the starting point for everything else.
How Long You Have to Keep It
Duration depends entirely on why the SR22 was ordered. There is no single default.
- Insurance-related suspensions: the requirement is satisfied after 180 consecutive days of coverage.1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility
- First or second no-insurance suspension: three years on file.2Indiana Bureau of Motor Vehicles. Indiana Driver’s Manual Chapter 5
- Third or subsequent no-insurance suspension, for offenses after July 1, 2014: five years.2Indiana Bureau of Motor Vehicles. Indiana Driver’s Manual Chapter 5
A lapse inside that period does not restart the clock, but it triggers an immediate suspension. Your privileges stay suspended until the BMV receives a new effective SR22 or until the original requirement period runs out on its own, whichever comes first.1Indiana Bureau of Motor Vehicles. The Coverage an SR22 Has to Prove
The SR22 certifies that you carry at least Indiana’s minimum liability limits under Indiana Code 9-25-4-5:
- Bodily injury per person: $25,000
- Bodily injury per accident: $50,000
- Property damage per accident: $25,0003Indiana General Assembly. Indiana Code 9-25-4-5 – Minimum Amounts of Financial Responsibility
Those limits are written in shorthand as 25/50/25. Bodily injury liability pays for medical costs, rehabilitation, and lost wages when you injure someone. Property damage liability covers the other driver’s vehicle or any structures you hit. These numbers are the legal floor. A serious crash with multiple injuries or a late-model vehicle can run past $50,000 in bodily injury or $25,000 in property damage very quickly, and anything above your limits comes out of your pocket.
Collision, comprehensive, and medical payments coverage are not required for the SR22, but each one narrows your personal exposure if you add it.
How the Filing Works
You do not file the SR22 yourself. Your insurer files it electronically with the BMV once you have a qualifying policy in place.1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility The steps:
- Find an insurer that handles SR22 filings. Not every company does, and your current insurer may decline to continue your coverage after the underlying violation.
- Buy a policy that meets or exceeds the 25/50/25 minimums. If you already have qualifying coverage, your existing insurer can often add the SR22 endorsement without changing the policy.
- The insurer transmits the SR22 to the BMV. Once the BMV processes it, the suspension can be stayed and your privileges reinstated.2Indiana Bureau of Motor Vehicles. Indiana Driver’s Manual Chapter 5
The filing fee from the insurer usually runs $15 to $50. That is the smallest piece of the cost.
If You Do Not Own a Car
A non-owner SR22 policy satisfies the requirement when you drive borrowed or rented vehicles. It typically costs less than a standard policy because there is no vehicle of your own on it. The 180-day, three-year, and five-year duration rules still apply.
Switching Insurers Mid-Period
If you change companies while the SR22 is active, the new insurer has to file a fresh SR22 before the old policy lapses. A single day without an effective SR22 on file is enough to trigger a suspension. Have the new policy bound and the new SR22 filed before canceling the old one.
What It Does to Your Premiums
The filing fee is minor. The expense comes from the underlying violation. Insurers treat a conviction for driving uninsured or an OWI as high-risk, and that classification pushes premiums up sharply. How much depends on your record, the severity of the offense, prior coverage lapses, and the individual insurer’s underwriting. Some drivers see annual premiums double; some see worse.
Shopping around matters more here than in ordinary insurance buying, because the spread between what high-risk carriers charge can be very wide. Some insurers may also require the full policy term paid upfront rather than monthly. Getting quotes from three or four companies before signing is worth the time.
If Your Coverage Lapses
When an SR22 policy is canceled, lapses, or is not renewed, the insurer files an SR26 form with the BMV. The SR26 is the cancellation notice telling the BMV that qualifying coverage is gone.1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility Receipt of an SR26 inside your requirement period triggers an immediate suspension. The suspension holds until the BMV receives a new effective SR22, or until the original SR22 requirement period expires on its own.2Indiana Bureau of Motor Vehicles. Indiana Driver’s Manual Chapter 5
A lapse also brings BMV reinstatement fees, higher rates when you reapply because a gap now shows on your record, and the possibility that standard insurers will no longer write you a policy at all. Automatic payments are the simplest safeguard.
Driving While You Wait: Specialized Driving Privileges
If your license is suspended because of the underlying violation or an SR22 lapse, you can petition an Indiana court for specialized driving privileges under Indiana Code 9-30-16. These privileges can allow limited driving for work, school, medical care, or other essential purposes while your full license is suspended.4Indiana Judicial Branch. Specialized Driving Privileges – Special Processes and Procedures
You file the petition in the circuit or superior court of the county where you live, and you must serve it on the BMV and the local prosecuting attorney.4Indiana Judicial Branch. Specialized Driving Privileges – Special Processes and Procedures Not everyone qualifies. Specialized driving privileges are unavailable to people who have never been Indiana residents, drivers who refused a chemical test during an OWI stop, drivers whose offense involved a death, and certain repeat offenders. The court decides whether to grant the petition and sets the conditions. Violating a condition can get the privilege revoked.
Moving Out of Indiana
If you leave Indiana while an SR22 is still active, the BMV offers an Out of State Residency Affidavit that can waive a three-year or five-year SR22 requirement. The waiver is not available if your suspension was stayed with an SR22, or if you hold specialized driving privileges. In those cases, you keep the SR22 regardless of where you live.1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility
If you move back to Indiana before the original requirement period has expired, the BMV will require you to resume meeting the SR22 requirement until the expiration date.1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility Your new state may have its own SR22 or equivalent, so check with its motor vehicle agency. Your insurer also has to be licensed to file in that state. If they are not, you need a new insurer there who can.
Ending the Requirement
Once you have maintained continuous coverage for the full required period, the SR22 obligation ends. Removal is not automatic. Confirm with the BMV that your requirement has been satisfied before you change anything about your policy.1Indiana Bureau of Motor Vehicles. Proof of Financial Responsibility Your insurer will notify the BMV when you ask them to, but written confirmation from both the insurer and the BMV is worth getting before dropping the endorsement.
Rates typically ease gradually as the original conviction ages on your driving record, rather than dropping all at once when the SR22 is removed.
